We do not believe it is a valid complaint for the following reasons: The matter is complicated by the fact that a conservatorship preceded the probate We received a call from the personal representative on July 26, We were able to schedule a first meeting with him on August 17, We reviewed the matters and had follow up on August 18th, 24th and drafted the first probate documents on September 21, Attorney and client reviewed the drafts and made amendments to the drafts and were in contact with the personal representative on October 4, 2017, October 10, 11, 12, 16, 17, 18, 19, 23, 25, and 31st, November 1, 6, 8, 10, 11, In addition we were in contact with the attorney for the conservatorship during this time frame as well The revised probate documents were completed and filed November 16, and thereafter we in contact with the Court and the personal representative on November 16, 17, and Department of Human Service on November 29, Attorney attended the probate hearing on December 18, 2017, which was scheduled by the Court, and corresponded with the personal representative on December 28,2017, January 4, 5, 6, and 11, Personal Representative has indicated that he is appreciative and satisfied of the progress made and communicated to us in January, In our practice we find that it is not unusual that the personal representative, beneficiaries and other family members are frustrated with the time frame in the probate process which is dictated by the probate court rules, notice, claims and filing, etc
I am rejecting this response because:
Once again this firm is not getting the point which is they are sucking funds from this estate with multiple phone calls, delays, and making what should have been a simple process complicatedActually, why was this estate probated in the first place? There was no property involved ---- just a simple account held by the Presbyterian agency in Willmar which should have been transferred to the survivors without going through probateWhy weren't the funds transferred directly to the heirs according to ***'s wishes as declared in his will? What's the point of a will if ones wishes aren't followed ---- why does a law firm get involved but to suck as much as they can from the estate
A probate is not as simple as most would like to expect. Attorneys must follow the legal process set by law. We are unable to simplify a probate. There are no short cuts and we cannot short circuit the rules of the process. Although we all wish for it to be more simple. We all realize it is a legal matter that requires legal attention. Nothing done by our firm is in any way over complicating matters nor is the matter extended as a result of any action we have taken or which may not have been taken. To say otherwise is false. We have in all respects been diligent and straight forward with what is required and what is needed and in what we have done
