The Local NY Reviews (3)

What you are referring to is the NYC Hotel Occupancy tax of $2.50/night and the NY State Hotel Unit Fee to support *** Expansion of $1.50/nightWe've consulted with lawyers and accountants on this issue and determined that these taxes do indeed apply to those renting a bed or what New York
considers a "rooming unit" and are thus applicable to each guest booking a bed at The LocalNY law specifically states that these charges apply to dormitory-style accommodationOur rooms are not SRO units, and we consider each bed a private accommodationThis is how we have chosen to operate, and it is independent and unrelated to how other ***s chose to interpret the tax laws. For your reference, the taxes charged are the following:• NYC sales tax: 4.5%• NY State sales tax: 4%• MCTD state sales & use tax: 0.375%• NYC Hotel Occupancy Tax: 5.875%• NYC Hotel Room Occupancy Tax of $2.00/room /night• NYS *** expansion fund charge of $1.50/room/night We understand the taxes unfortunately add quite a bit to our room prices, so we make every effort to keep our prices as low as possible and, more importantly, to proactively inform guests of the taxes so that they may make an informed decision when choosing a place to stayTo do this, we state clearly on all of the booking sites that "Taxes not included - City, State and Occupancy taxes total 14.75% + $3.50/night"Additionally, your confirmation email states the sameAnd as a final step, we have everyone sign the cheagreement that also states the taxes. Unfortunately, we cannot refund the taxes that you paidWe stand by our policy which we believe is clearly stated to guests upon reserving, upon confirmation and again upon arrivalThank you for your feedback, and I hope this helps clear things up a bit

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID# ***, and have determined that my complaint has NOT been resolved because:
1) The NY Local is a ***, 2) The NY Local would have failed a New York State health inspection during my stay , 3) The NY Local is not a hotel according to New York State Hotel and Motel Occupancy Laws because it is not a hotel, motel, inn, bed and breakfast establishment, ski lodge, apartment hotel, a certain bungalow, condo, cottage, and/or cabin, and 4) it's 4-bed-femal dormitory are worse than SRO's because SRO's are at least a form of housing in which only one or two people are housed in individual rooms (the maximum occupancy of a SRO is two people per room).
In order for the Revdex.com to appropriately process your response, you MUST answer the question above

Review: The Local NY adds a NYC hotel room tax and [redacted] tax to bills of all their clients. However, this [redacted] should not make a NYC Hotel room tax applicable to the bills of their clients whom are renting SRO units (4 bedroom dormitory rooms). For Example, The [redacted] does not charge a NYC Hotel room tax to the bills of their clients (i.e. [redacted] : Please note NYC hotel tax not included in price. This is 14.75% in all rooms, this includes the hotel tax that is 5.875% and the sales tax is 8.875%. Private Room: additional NYC Hotel Room Occupancy Tax $3.50 / room per night. Rates DO NOT includes taxes and are subject to CHANGE without prior notice).Desired Settlement: The Local NY already refused to provide me with a refund despite the NYC hotel room tax charges its' reception made to my [redacted] account, and I still would appreciate a refund.

We've consulted with lawyers and accountants on this issue and determined that these taxes do indeed apply to those renting a bed or what New York considers a "rooming unit" and are thus applicable to each guest booking a bed at The Local. NY law specifically states that these charges apply to dormitory-style accommodation. Our rooms are not SRO units, and we consider each bed a private accommodation. This is how we have chosen to operate, and it is independent and unrelated to how other [redacted]s chose to interpret the tax laws. For your reference, the taxes charged are the following:• NYC sales tax: 4.5%• NY State sales tax: 4%• MCTD state sales & use tax: 0.375%• NYC Hotel Occupancy Tax: 5.875%• NYC Hotel Room Occupancy Tax of $2.00/room /night• NYS [redacted] expansion fund charge of $1.50/room/night We understand the taxes unfortunately add quite a bit to our room prices, so we make every effort to keep our prices as low as possible and, more importantly, to proactively inform guests of the taxes so that they may make an informed decision when choosing a place to stay. To do this, we state clearly on all of the booking sites that "Taxes not included - City, State and Occupancy taxes total 14.75% + $3.50/night". Additionally, your confirmation email states the same. And as a final step, we have everyone sign the check-in agreement that also states the taxes. Unfortunately, we cannot refund the taxes that you paid. We stand by our policy which we believe is clearly stated to guests upon reserving, upon confirmation and again upon arrival.
