To whom it may concern:I am writing today in the response to the complaint submitted to the Better BusinessBureau on January 30th by *** *** ***.Our response to his concerns:Our property is a non smoking propertyWe don't allow anyone to smoke in the units,on their decks or patios,
walkways, grass or bark areas, clubhouse or the parking lot.During the summer ofwe erected a small8xsmoking station with four sideslocated in a comer of the propertyThe closest building in location to this smokingstation is an estimated feet awayThe building *** lived in is an estimated 150feet away, around a comer with buildings in betweenOther than this station, the restof the property is still all non smoking.As far as following up on complaints our policy is as follows: When a tenant complainswe type notices to the unit they are complaining aboutIf the complainant does notknow for sure who the culprit is then we cannot enforce a rule based on assumption.Generally we will post a notice to the entire building if the circumstance fitsIfsomeone is in violation of their lease, we need solid evidence in order to pursue furtheraction.The following are complaints made to our office and our follow throughWe don'tshare correspondence with tenants about other tenants, therefore we were not able toinform *** of the direct actions that were taken as that information is confidential.The information below regarding complaints are copied and pasted directly from***'s notices be sent us.1/29/***'s unit sent an online maintenance request "do not really needanything but people need to be reminded, That smoking on there decks is not allowedit floats right up into other peoples home "1/30/The Lodges Office Posted general smoking notice to building.2/23/***'s unit submitted another online maintenance request "smoking onback decks really needs to stop The smoke comes right up into our home Thanksagain ***" No specifics were given we were unable to pursue any action.7/20/*** came into the office to discuss multiple items, specifically rentpayment, and smoking came up on the property.7/21/The Lodges office posted another general notice to the building.11/8/Eemailed from homestead.com "They are smoking on there decks rightnowit is beyond bad.itsboth units below me" *Manager emailed back about an hourlater "Thank you for letting me know!! I'll address the smoking!"11/9/Both downstairs units got official legal notices regarding smoking on theproperty.12/6/*** called with a quick voice message saying he believes someone issmoking right now at 6AM.12/6/Manager Quote from communication "discussed with *** who he thoughtit might beHe said it had to be either the unit just below them or the st floorHebelieves it to be *** due to the fact he simply opened his patio door and got a bigwhiff, but did not see who it was"12/6/Emailed Emily W***, direct supervisor, with a for cause confirmation for unitwe believed it to be after receiving the smoking complaint from ***This notice perOregon law gives a cure and remedy date or a vacate date of the tenant in violation oftheir lease.The final result of the said forecause is confidential therefore can not be discussed indetail.As you can see action was taken according to the evidence givenWe can only enforcerules that are broken if and when we know who is in non complianceOn November8th was the first official complaint pointing out a certain unitWe took action onNovember 9th We received our second official notice regarding the same tenanton December 6th We immediately took action following protocol and OregonLawAt no time did we force *** or anyone in his unit to move outThe choice forthem to move was their own decisionThe charges on his final accounting are just andfair.If there are any further questions or concerns please contact us at the above phonenumber and address or the PO Box on the bottom of this letter.Thank you,Stacy L***The Lodges
