February 11, 2016The Lost Trails LLC offers Guided Off-Road Adventures as one of its ActivitiesRequirements to participate in this activity are outlined on our website; here in part: *All participans must sign a liability waiver *All participants must sign a vehicle damage agreementUpon arrival all participants are asked to review and have the opporturnity to ask questions concerning the agreements prior to participating in the activity.A copy of the signed agreement(s) are enclosed for this incident's record.Concerning the subject incident, the rider drove too close to the trail edge and slammed into a boulder causing the ***bar to crack in half and ripping the ***bar off of the machine(A ***bar is an added safety feature Lost Trails has installed on all it's ATVs to help protect the rider from injury) When this type of incident occures; for the safety of the “incident rider” as well as all other riders in the group, the rider becomes a passenger with the guide, the damaged ATV is pushed off the trail until it can safely be brought back for inspection and the tour continues for the balance of the group to safely enjoy their tour.Upon returning to base the tour guide fills out an incident report (as stated in the “Vehicle Damage Agreement”) together it is reviewed and signed by the “incident rider” so he/she fully understands what course of action needs to take place and what obligations are requiered by all parties and a $damage deposit is secured from the "incident rider” (as per the Vehicle Damage Agreement)A copy of all documents are given to the customer to keep for their records.In this particular case the “incident rider” was advised that because of the time of year, Christmas and New Year Holidays, it would probably take a couple of weeks before we could determine the costs of the damge to the machine and we would call when we have all the costs for the repair.On January 10, (a) 1:19pm the “incident rider” was called and a review of the total costs of repairs and obligations for the damages sustained to the vehicle in his/her care for the incident occuring on Saturday, December 19, 2015.The total itemized costs and obligations were reviewed with our customer over the phone as follows:***bar $Plastic splash guard$ Metal footstep$Support bars$Nuts & bolts $Subtotal Labor ($75hr) Sub total Tax (6%) Sub total Shipping Subtotal 390.00Daily Fees ($x 11) 4400Total costs/obligations $4,790.00During the phone conversation we advised our customer that we stopped the “Clock” of the daily Tour Rate at (3) three days, which would reflect that portion of the costs to be $1,instead of $4,In addition, reducing this further we told him that we would just call it even at the $deposit that was secured at time of incident and he would have no further obligation for the damages.As a company it is our position that we have been more than fair in our business dealings with the circumstances of this incident.Supporting documents included:Signed and initialed “Liability Waiver' Signed and initialed “Vehicle damage Resposibility” agreement Signed “Incedent Report” Pictures of Damaged VehicleLost Trails, LLC
