In response to the accusations listed, I would respond as follows.First, the customers residence is in what is probably the poorest soil conditions in the area The developer choose the area because of cost only, not for soil type We do all the landscape and irrigation work in five
other developments There is no place with more naturally occurring rock, or less carefully prepped lots then where they live It comes as no surprise to me that they found stone, or debris in their yard, as the entire area consists of it We did in fact haul in five yards of topsoil in order to level the yard, and cover the base of grade We work for other builders for years At no time have we ever been accused of leaving trash under sod The accusation is ridiculous.Second, The sod installed was exactly the same sod as the owner demanded It came from the same farm It was installed within hours of delivery to Midland, rolled, fertilized, watered, and in good condition when we left We install tens of thousands of square feet of sod every month We never have problems with any of it We received an immediate complaint from the owner that it was dead through the builder I responded personally within hours The sod had indeed faded somewhat, as all sod does when it is cut, and reinstalled on dry rocky soil, in dry rocky Midland I told the builder that it would recover in a few days, as it always does This is a situation in sodding lawns The sod did not bounce back as fast as it normally does This was a function of the type of irrigation the owner has That being underground tubing We install most of the new irrigation in Midland We use ptype heads which water the lawn from the top down Sod responds much better to this type of irrigation, and recovers in days The owners irrigation lies under the lawn, and waters down into rocky soil The sod does not recover as well in this type of situation, as is roots must grow, and penetrate to receive water Most knowledgable people do not use this type under lawns as it is so slow to recover, and difficult to repair if there is a problem later on Most of the builders I work for refuse to use it On top of this, I understand that the system was installed by the owner This is usually a problem, as most homeowner are clueless about properly installing a system, or to watering rates I would strongly suspect that this is more the problem than the quality of grass that we installed, given our success rate else where.Third, The tree that was installed is not dead I agree with the homeowner that it is not probably what she envisioned However, I understand the owners impatience as she has already had to live with another poor doing tree In order to get to the truth of the matter, I did not install the tree The original landscaper whom I contacted replaced it as per his contract *** *** is a good man, but has not had the success in recent years that he should have had He apparently also had problems with the owner, and did not want further contact He replaced the tree, as he is an honest man But did not have a decent tree in his possession to do so I was a little disappointed in the quality myself, but agreed to accept the responsibility in order to help out a friend, smooth the process, and finish the job There was no intention of tricking the customer in any way I am responsible for the tree, and therefore the poor quality My stock is far more vigorous, and my reputation as such is unquestionable over years I will not agree to some “arborist” in Midland to be given carte blanche to treat a sick tree, when all that is wrong is that the tree was probably rooted in when dug for at least a year or two Trees thus transplanted almost always do poorly, and display the same symptoms as this one does If left alone, the tree would probably recover in the next year But given the owners drive for immediate gratification, I do not see this happening Therefore, because I accepted the responsibility for the installation, I will offer to fix the problem I will not pay some nebulous “expert’ to drag out treatments on a tree that I know what is wrong with I have decades of expertise over any tree guru in this area I shouldn’t have gotten involved in a lie, and I apologize to the owner for it If they would, they may go to my yard, and pick through several hundred healthy trees there As long as they stay within reasonable bounds as to size I will replace the poor tree with a healthy one which will fulfill the owners expectations They can also pick another species if they so choose, as long as it is in the same price range This should have been done in the first place, and none of this would have happened I would hope the owner understands that there was no intent to deceive, I was trying to help out a friend, who can use the help He just didn’t put in a tree that was vigorous, but was the best he had I hope this will be satisfactory to the owner

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.
First off, I would like to state that the only reason [redacted] was even contacted for this work is because contractors drove through our yard in the same place twice creating trenches through our yard. Prior to this we had no problems with the sod that we put down ourselves.It amazes me that he can say that the problem is the soil. We put down the same type of sod with no topsoil brought in, unlike the supposed "5 yards" that he brought in. Yet some how all of the sod we put down the first time amazingly grew in perfect and green. When we first installed the original sod we removed rocks, sifted the top layer of dirt, and raked everything to give our grass the best chance of surviving. The first day that [redacted] came out to our house to look at the damage done by the contractors he told us that our grass was beautiful. Seems that despite his claims, grass can grown just fine on the soil in our area if you care enough to take the proper precautions before putting down the sod.Also he can say the accusation is ridiculous as he wants, but when we pulled up the dead sod that his men installed there was a coke can and pieces of the of the irrigation pipe that they had cut off to replace left under the sod. Unless some one ran in after they left, pulled up the sod, stuck a coke can and irrigation pipe under the sod, and then put it back down, they were left there when his men installed. Also this was not trash left over from when they were building the house. Like I mentioned earlier, we prepared the ground before we first installed sod. Which included removing any trash or debris. He was not there when the sod was pulled up, he has no room to argue this point. Not only that but accusing us of being a liars reflects on how he runs his business and treats his customers.The accusation trying to blame the drip system for the grass not coming in is completely bogus as well. It amazes me how we are apparently like most homeowners who, according to him,"are clueless about properly installing a system, or to water rates". Yet some how prior to the issues that he was suppose to fix, our grass was green and we never had any problems after we put the sod down ourselves. This is just further slander by a man trying to make "professional knowledge and experience" claims to make the customer look like they know nothing compared to him. All of our work was done with the help of a man that was previously a professional contractor who prides himself in his work instead of trying to belittle his customers to make himself look better for the poor work that they did. In the response, [redacted] portrays himself as an expert that has connections. Yet before the sod was even installed, my wife managed to get a hold of him to ask what was taking so long to get the sod. He said that he was waiting for [redacted] in Odessa, TX to have a pallet of sod available for him to purchase. Since we didn't even know that [redacted] sold sod, she decided to give the [redacted] a call to check on this. After speaking with the buying manager at [redacted] to see what type of St. Augustine grass they supplied, we discovered that [redacted] does not even carry the type of St. Augustine that we had requested and was already in our yard. In the end we almost had to make him get in contact with [redacted] that provided him the sod. He did not originally want to contact [redacted] because he and the man that supplies the sod to [redacted] have a history and don't like each other due to past disputes. Had he contacted [redacted] initially he could have gotten the sod months earlier, yet he allowed his personal history to affect how he does business. Regarding the tree, [redacted] knows [redacted] personally. He says he's a good man, yet I find it odd that during our first meeting with [redacted] he said that he knew [redacted] and refereed to him as an alcoholic. Even then, [redacted] personality is not what is in question here. How he runs his business is.  His ability to ignore phone calls from concerned customers is right up there with [redacted]. At one point with [redacted] it almost felt like our calls were being screened because he did not want to deal with us. We originally did not want to ask for an arborist. We tried time after time to get a hold of [redacted]. My wife would call week after week, leaving messages and never hearing anything back. Finally I called him, as he did not have my number. I didn't bother leaving a message because I didn't want my calls screened too before I could talk to him. Amazingly a few hours later I managed to get a call back. After telling him my concerns he said he would swing by at some point and check on the tree and grass. We waited a couple of weeks and then tried to call him when we heard nothing. Finally when we were able to get a hold of him again, he still had not had a chance to come look at them... and never did. Back to the grass, because he never came to check on it or do anything about it we had to get in touch with [redacted] to get the problem with the dead sod resolved. They purchased a pallet of the same type of sod that [redacted]'s company installed, had it delivered to our house, and we installed it ourselves just like we had before. It astonished me that [redacted] was able to get a pallet of the correct sod from [redacted] in under a week considering how hard [redacted] had said it was to find that type of sod at the time. Amazingly the majority of the sod is growing in just fine as it did the last time we installed it. There are a few small patches that a struggling a little, but that is normal when installing sod and new growth is coming in those areas. This is amazing to me since we are apparently just clueless homeowners who have poor soil and a self installed irrigation system that couldn't possibly keep sod watered properly. Yet some how a majority of the sod that was installed by "professionals" is the sod that died.We will give the the tree until next spring to perk back up. If the tree does not come back, as [redacted] say it will, then we will go to [redacted]'s yard and pick one the trees there which will be supplied and installed at no cost to us. Also, we will be present when the tree is installed.
