[redacted] complaint of February 2, 2016.
On October 1, 2015, Mrs. [redacted] and her father Mr. [redacted] came to our Ontario office for a dual free consultation. On that same date, each family signed a retainer agreement and was provided with a questionnaire to complete and return back to the office in order for the assigned paralegal to proceed working on their matters.
After the consultation, the secretary initiated work on the matters creating a physical and digital file for both families.
Since the date of the consultation, our secretary placed numerous calls and left numerous voice message for both families to follow up with both clients and request the questionnaire to be mailed back. However, neither of them were responsive or returned any calls.
Then, on December 3, 2015, Mrs. [redacted] called [redacted], the paralegal assigned to the case, and explained that she had a hardship and requested a refund. [redacted] explained to Mrs. [redacted] that according to the retainer agreement client signed back on 10/1/2015 she is technically not entitled to any refund. Our retainer specifically states: "Unless the attorney withdraws before the completion of the services, or otherwise fails to perform services contemplated under this agreement, the flat fee will be earned in full and no portion of it will be refunded once any material services have been performed." Never the less, [redacted] was very sympathetic with Mrs. [redacted]'s claimed hardship and asked her to send an e-mail explaining her hardship and that she will do her utmost best to get her request approved.
On December 4, 2015 Mrs. [redacted] sent the e-mail regarding her hardship. [redacted] forwarded the hardship e-mail to the management and billing department.
On December 7, and for the first time Mr. [redacted] called our office to request a refund as well. The secretary promised to relay his message to billing and call him back. Pending the billing department decision, Mr. [redacted] placed multiple calls demanding updates. Mr. [redacted]'s request for refund was denied and the secretary called him and informed him of the billing department decision.
Due to the frequent calls that were placed by both clients requesting refunds, the billing department issued the refund to the Mr. [redacted], Mrs. [redacted]'s father instead of issuing it to Mrs. [redacted].
Mr. [redacted] received the check and cashed it despite the fact that he knew his request for a refund was denied. It was not until Mrs. [redacted] contacted our office inquiring about her refund when we discovered that the father not the daughter received the refund.
The company aims to consistently deliver a professional service to our customer. As a courtesy to Mrs. [redacted] and her claimed hardship, and despite the fact that the retainer agreement signed by clients on October 1, 2015 states that no refunds are to be issued, we will issue Mrs. [redacted] a full refund. We feel no apology is warranted as we have gone above and beyond to accommodate Mrs. [redacted]'s request.
