Thank you for your interest in this issue concerning Mr***To help, I'll give you a short & a detailed version of this issueThe short version: This client was informed several times that we require verification of terms of service &
details of his order prior to dispatching our tech for serviceAfter several attempts, this client failed to verify & accept terms of service & his appointment was cancelled as per company policy
Detailed version: This customer contacted us about his lawn mole infestationOur service is an alternative to mole trapping as our lawn treatment can help drive moles out & can help to keep them out of a client's lawnHowever, as our service can often cost $300-$& deals with controlling wild animals & isn't guaranteed, it's our policy that our prices & term of service be fully disclosed to the customer, such as: 1) while our service can be successful, like all forms of wild animal removal, success is not guaranteed, 2) there are no refunds, 3) that clients understand that their are things that they may be doing to cause infestation & what they may be counselled on steps they can take to assist their chances of success, etc, so we know that every client has a full and accurate understanding of the service that they are buying and even possible the roll that they can take to help reach their goalsOver the last years in business, this is normally transacted in about 3-emailsFor Mr***, we have emails correspondences where we did everything we could to try to get him to confirm this standardized confirmation of details and terms of serviceTo which he repeatedly failed to do, at one point he sited "that was on my previous email", referring to his own version of a confirmation which had no details of service & which accompanied other qualifying questionsSo, we tried again to get his confirmation to our standardized terms to which, rather than just replying "confirmed", he cherry-picked the terms he would agree to stating "Yes that is the day and time requestedWhy would you send this on a Saturday and on a Monday?", which, due to it's specificity, doesn't allow us to be sure that he read & agree to the terms of service or understand that he's due to pay $at serviceSo we followed up yet again and, rather than simply replying "confirmed", which every client in our history has done, he responds: "I already get enough emails
You already sent it once, why send it twice?
My time does count for something you know"
After so many failed attempts to verify that our terms & details of service have been fully disclosed & understood by the client, we informed the client "I'm sorryIt seems clear that our system of taking service orders has been a source of frustration for you; my apologiesOur process is designed to inform the client of the service, provide a price, then once all questions are answered, we provide an email with a summary of all of the details if your order to be corrected or confirmed (which, to this point, you've only actually confirm the day & time of service and no other details)It's safe to say that our process is simply not for you & we're, therefore, cancelling your appointment for serviceBest of luck." and with this, his appointment was cancelled
This client was scheduled to pay us $for that morning's serviceWhile that revenue is important to our small business, it's more important that all client who hire us fully understand exactly what to expect from the service as well as being educated on the role that they can play to support their own mole free effortClients who simply don't get this tend not to have much success & are therefor discouraged from hiring usThose who refuse to verify our terms of service are cancelledWe feel we owe this degree of disclosure to the people who trust us to help them and consider full disclosure to be a necessity of businessUnfortunately, we weren't able to convey this to Mr***
Thank you again for your service to the public!

We've reached out to this client several times over the last few days to try to have him better understand this issueThe client ordered services from us to help with his mole infestation: 1) soil treatment $& 2) mole trapping $The
trapping service is the one at issue as its contract addresses the dangers involved with using powerful, armed iron traps on his property and the safety flags which mark their locationsWe have videos showing that the client repeatedly tampered with the traps and markers; not only violating his signed agreement, but putting his family at risk of serious injuryThe client was informed of his infraction & warned in writing not to continue tampering and given a second chanceUpon our second visit, we found that the client ignored the warning & his contract as the markers were once again removed; leaving large, armed traps lost throughout the propertyAs a result of his continued disregard for safety, we exercised our right to terminate his contract without compensation as per the terms that the client agreed to
In greater detail, the client was provided these contracts for services in advance to review & sign if he wanted our serviceOne of the stipulations of this trapping contract is for safety which states that the traps that are left on his property are armed, are very dangerous and that they and their markers must be stayed away from & never tampered withIf they were tampered with, the contract could be terminated as agreed uponHowever, after signing the contract, being told to stay away from them & receiving a written warning on 5/6/(our 1st return visit) the client repeatedly tampered with (removed) the trap markers, making these areas with armed traps very dangerous & putting people and pets at great risk
However, instead of invoking our right to fine & terminate service at that moment, we attached the said warning to the client's invoice for moles caught of $which states "All flags were removed from trapsPlease be sure that nobody goes near trapping area as it is very dangerous!" The client denies receiving this highlighted warning but it's recorded that he paid the $bill, proving that he did, in fact, receive itAnd he's recently been provided a second copy for his records
After videoing the site once again, we re-set traps with new flags and returned days later to discover that the client had once again violated both his contract & his warning & removed the 2nd set of markersAt this point, the traps in the ground were armed and lostEventually, we were able to recover the traps with the use of the previously taken video; otherwise, they would have been lost until somebody tripped on them and became injured
These repeated violations are ample cause to enforce the safety stipulation in his contract and terminate serviceHowever, as a result of our treatment & trapping, his mole infestation was already gone by this point & traps were removed as per procedure
On 7/20/15, about 1/months into his month trapping agreement, the client contacts us requesting a resumption of serviceAfter chances & violations, we invoked our contractual right to cancel his service based on concerns of safety, and we didWith this news, the client was given ample time to vent his frustrationWe tried to explain his situation but was repeatedly cut offThe client was told after given more time to vent that we felt like we couldn't provide any further clarification, as we weren't allowed the chance to speak, & that the call would be ended; and it was
Following this, the client posted a report online which we've retained for our records including several documented falsehoodsThen we received emails from the client stating that he intends to continue to do our company more financial harm unless we pay him $to stop posting similar online reports, including those to your office (which, upon reading, isn't as defamatory as his previous post) & with local news outletsWe, of course, refuse to pay
I replied back to him requesting that he seeks counsel as he seemed unaware of the civil repercussions of knowingly posting information (in his initial posting) with the intent of causing a company harm, then demanding cash in exchange for no longer making these accusations
Hopefully he will seek the help that we suggested and he will limit the damage that he's continuing to do thus farAs for us, we are not willing to put armed traps back onto a client's property who has repeatedly demonstrated a complete disregard for safety or contractual responsibilitySo, we'll continue enforcing the terms of the contact the the client agreed to
