Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint This is a scam it's an unfair and cruel way to keep $from someone in a low wayI know what I signed and if the lease was with someone else then OK, I wouldn't have had a problem and understoodI am now trying to lease on my own and if I can't get my full refund then at least I should be able to recuperate half, it's not fair to find any small reason to scam people for $This community is a government community opt to help people with low income, yet, for any small reason try to scam people on the low by asking for a very high deposit to just "hold" the unit without any guarantee the tenant will get itThe application fee is one thing but to ask for a very high deposit just to hold it its absurdWhat kind of scam is this complex running!? By law a deposit is to be asked only when the tenant has qualified and it should be security to the first month's rentNow if this is a deposit to just "hold" the application it's ridiculous to keep the deposit in full if a person "allegedly" states informationIt's an unfair way to scam someone who was not aware of the eviction since I was not the only one on the leaseThe person I shared a previous lease with is willing to come forward and state how the eviction happenedI left the complex due to lack of professionalism and horrible maintenance and now I bump into the lowest scam by another complex, a complex that's supposed to be helpful, since it's new, you'd think they'd have better ways to help someone being that there are lots of older complex with horrible reviews and all they do is take money from a tenant, clearly Alta Gardens isn't any differentWhile I was there filling out an application I first noticed how Clair or Clara whatever the lease consultant's name was would never answer any phone call the numerous times the phone rangBefore I had this issue I had the same problem, I called over and over for a while and none of my calls were answeredIt's clear this complex is nothing but a scam in search of ways to rob people for moneyI refuse to lose my deposit to a complex who was no help but was quick to ask for money without even knowing if I qualified Regards, [redacted]

During the application process we require applicants to pay the application fee of $for the application and deposit $to reserve the unit and take it off the marketOn the application it ask for the applicant to check or list any negative rental history, the applicant wrote in that box "n/a"
On the second page of the application paragraph states the deposit can be retained as liquidated damages if the applicant fails to answer any question or gives informationSince applicant stated that she had no negative rental history and it came back that she had an eviction, the information listed on the application was falseOur community doesn't accept evictions so her application was denied and her deposit was retained as liquidated damages

The deposit shouldn't have been asked for if not sure if qualified or notBy the Texas State of Law a deposit is to be asked ONLY when the tenant has qualified for the unitThe previous eviction was signed with someone else therefore it shouldn't affect me signing a lease on my ownAll I ask is for my deposit of $back which I have a right to and as for me stating "n/a" on the application was because I was not aware of itThis is just a way for the complex to scam and rob me for $The reply states that they keep the deposit for "liquidated damages" which is ridiculous if there weren't any damages to anythingIf I didn't qualify for the unit how are there any damages? deposit taken when applying holds the apartment for an applicant during the
application process to guarantee it is not leased by another clientLiquidated
damages are not physical damages done to the apartmentThe liquidated damages
are considered the money that the community lost out on for holding an
apartment that another qualified client could have leasedApartment
communities cannot be held responsible for information that applicants are not
aware ofI have attached a copy of the application signed by the applicant and underlined on the second page the information in regards to the application deposit
