Dear *** ***,Thank you for contacting us about your complaint regarding the ADA compliance of our parking lotAs stated in your complaint, you feel that the Hotel Laguna is not practicing proper ADA requirementsThe Hotel Laguna parking lot is a private entity that is regulated by Laguna
Parking CompanyTheir services are to provide valet parking for all customers including those who display their State issued Handicap stickerAs you may have noticed our parking lot is packed with cars and requires, through the insurance company, that cars are handled by employees to ensure that there are no accidentsIf there were an accident, where your car hit another car, then the valet would be held responsible for allowing a non-insured individual to park a car in a controlled lot and would not be covered under their insuranceTherefore the individual would be held responsible and would have to pay damagesIn section (e) Valet parking facilities shall provide a passenger loading zone complying with located on an accessible route to the entrance of the facilityThe Hotel Laguna provides such a service and is com-plying with offering a loading zone for any disabled passenger.In the Standards act of it does not state that a private Valet lot is required to allow a disabled individual to park their own carIt is only required to provide a safe environment for loading and unloading of individuals who display a handicap stickerAlso stated in the same section that you mentioned in your complaint, 4.1.2(5)(a) states that if parking spaces are available for self-parking by employees or visitors that they are required to have spot per spacesThe parking lot at the hotel does not allow self-parking and therefore the provision is not required.You state that in the New Standards eliminate the above exemptions but upon further investigation it does notIt still states that under Valet ParkingParking facilities that provide valet parking services shall provide at least one passenger loading zone complying with At no point in any of the document does it state that Valet is required to allow an individual with a disabled sticker to park their own car.As a side note, of course if an individual drove in with a specially equipped car we would help assist them in parking of their carWe have done so in the past and will remain doing soYour car was not specially equipped and therefore allowed us to operate it in a fashion.Sincerely,*** ***
