I am rejecting this response because: the response is not reasonable and does not qualify as a solution to my complaintI have already paid for the costumes and this is why costumes has never been requested from GSEP/NJC, regardless the costumes was not a concern in my complaintThe $was paid for merchandise never received, or refund given, and this is what is in questionPictures that GSEP/NJC is currently using should not be used because no photo/media release contest form was offered in order to sign, and this is what is in questionBoth organizations business practices and ethics are being questionedTherefore, I reject the response from GSEP/NJC and request that my options of resolving the complaint be exercised Thank you, [redacted] ***

Ms[redacted],
"">Thank you for calling todayAfter checking our files due to the Revdex.com Complaint issued by [redacted]/consumer/parent, this is in part what we have found. The consumer is part of a family of six, who participated in our program, in fall 2014. Here are portions of our records, which can be detailed greater if a followup is warrantedThe consumer shared the family's financial hardship with our leaders. As a result the program awarded full scholarships to the consumer and her family in the fall of 2014, to include, dance supplies, shoes, costume usage, transportation to and from classes etcwith two stipulations. The family was allowed to participate in our program's annual holiday production, and take free dance classes. In exchange the parent/consumer would:- Organize and execute fundraising efforts for the program-Assist with our creative movement class/performance for children 2-years-old as a teaching assistantThe parent/consumer was cast as a lead in the showThe family of six all had lead rolesThe consumer's children were cast as the boy and girl leadDays before the production, the parent became disgruntled and quit the production, due to undisclosed personal issues with other cast members, and the family's dynamics. The expectation was for our program leaders to pick a side and dismiss half of the family from the show, or the other half would quit.Though the father and grandmother of the children, asked if the consumer's two children could remain with the production, (we greatly wanted to allow the kids the opportunity, as they had worked for months preparing), the parent/consumer refused to allow other family members to bring the children back.Today 11/11/we received a call from the Revdex.com stating that several letters had been sent regarding a complaint from the consumer/parentThe consumer provided an incorrect mailing address, causing us to not receive any Revdex.com correspondence. The consumer complaint consists in part:A$for two bags is being requested.BA claim that no parental permission was given for the family's children to appear in our promotional poster. Our response is as follows regarding 1-The parent assisted with fundraisers which failedThe parent assisted with two creative movement classesThere were a total of times the class met, rehearsed and performedThis is a violation of the scholarship agreementThe consumer and her two children's lead roles had to be recast days before the show, causing a hardship to the productionWe had to pay for more rehearsal time for understudies, and the consumer failed to return any of the costumesNot to mention the disappointment to all the children and cast. Our response to A,B.AOur records show the consumer left the program abruptlyAfter cursing out our artistic director via phone, the consumer/parent stated half of the family would be leaving the production, to include herself and her two childrenThe parent/consumer's, mother, brother and niece remained in the show and did an amazing *obHer mother, niece and brother also went on tour with the production. Our stance is that our consumers collect all belongings before exiting our programs, or shortly thereafter. A simple call, email or text is sufficientWe are months past the consumer's exitIf anything is left behind, we keep items in our lost and found for six months, then it is either donated, or given to the next family having financial hardships. We cannot say if the consumer collected all items before leaving the studio, nor were any requests made by the consumer for any items, such as bags etc. However, if the consumer wishes to reimburse the program for classes, dance supplies, scholarships, sweatshirts and T-Shirts, that everyone else had to purchase/pay for, we would feel that our efforts were not disregarded.A fair and realistic exchange would be the return of our costumes that the consumer still has.We will gladly give the consumer $for the costumes aloneWe need the costumes for the children in this years' production.Regarding the usage of photographs of the family, we have attached three of several signed releases giving permission to our program for the entire family, including the parent/consumer's likeness for promotional purposes. Also attached is the adorable photo of the consumer's son (soldier) in one of the costumes we are requesting be returnedThis photo is taken each year with different dancersIt is a huge honor for the children selectedWe are pleased this amazing little soldier will forever be a part of our promotional ad history, as he and his sister are two of the most talented children to enroll in our programThe attached picture from last year, will be retired next week. Our programs are not for every familyWe expect all our parents to meet participation fee obligations or contribute in volunteer roles such as fundraising and assisting with classesThis includes our scholarship parentsFinancial assistance is not an entitlement, it is a blessing, and most of our scholarship recipients embrace the blessing. In closing, we never lock the door behind a familyConsumers are free to exit the program if it is not a suitable fit. We simply ask for an exit reviewThe review ensures all loose ends, such as costume return, items left in lost and found, refunds, reimbursements, etcare closed outBut most importantly, the children deserve the right to say goodbye. The exit review in this case was a Revdex.com complaint, months after the consumer chose to exit.We wish the family the best, and would greatly appreciate the return of the costumes at a minimum.Ms[redacted] and [redacted]

I am rejecting this response because: the response is not reasonable and does not qualify as a solution to my complaint. I have already paid for the costumes and this is why costumes has never been requested from GSEP/NJC, regardless the costumes was not a concern in my complaint. The $90 was paid for merchandise never received, or refund given, and this is what is in question. Pictures that GSEP/NJC is currently using should not be used because no photo/media release contest form was offered in order to sign, and this is what is in question. Both organizations business practices and ethics are being questioned. Therefore, I reject the response from GSEP/NJC and request that my options of resolving the complaint be exercised.

Thank you,

I am rejecting this response because:
The response from GSEP is weak at best, full of irrelevant opinions, and false information that cannot be supported. This is distracting from the obvious truth and facts that support my complaint. I have provided Facebook Instant Message screen shot documents supporting that bags were paid for and was told the order was put in a few times. I was told this June and July 2014. The bags were still not received by the time my children and I left the program December 2014. I started volunteer work for GSEP with fundraising, and instructed a class after the loss of [redacted] and [redacted] father. For example, while attending their father’s funeral in Texas I facilitated one Creative Movement class. This was done out of the kindness of my heart that I assisted in time of their need. However, the bags were paid for prior to volunteering. The cheer bags were actually paid for two months after entering in GSEP and therefore, is a complete fabrication to insinuate the bags have anything to do with volunteering. In addition, GSEP is in no condition to scholarship much of any tuition especially mine and tuition was told to be paid at the beginning of every month. This included any additional fees. GSEP has struggled financially as a 503(c) which is indicated by the need for fundraisers, excessive fees, and having consumers purchase cheer bags that were never received. Is there a “Statute of Limitations” on submitting a complaint when paying for merchandise never received? 11 months? Erroneous!  Furthermore, I paid for all costumes for my children and I, and can provide bank statements reflecting charges for costumes including accessories that I paid. [redacted] was actually present when I made these purchases because she was instructing me as to the wardrobe needed. So, it is absolutely ridiculous to now request costumes that was paid by myself and is why the costumes were never requested prior to this response. [redacted] has been in possession of the 2014 records since shortly after she was informed of the Revdex.com complaint. This records indicate and show my payment for the cheer bags and tuition. This would probably be why [redacted] hasn’t provided them but instead provided a picture which has no value in resolving this complaint. I strongly request these records be submitted to the Revdex.com by [redacted], so that it can prove my complaint true and assist in resolving it.
In regards to photos, GSEP has more than one picture of my children and I on their websites. These photos need to be removed according to the, “Digital Millennium Copyright Act”. There was never any “Photography and Video Release Consent Form” given or signed but according to the response, a form was supposedly signed. Therefore, I request this signed form to be provided by GSEP to the Revdex.com to assist in resolving this complaint. You can rest assure that no form of any kind would be able to be produced because no form was ever offered. With that said, in relation to the DMCA all photography and/or video should be removed immediately. It is important to my children and I that no affiliation be made in connection with GSEP/[redacted] Conservatory. But, by GSEP posting photos of my children and I can give a clear misrepresentation of this. My children have moved on flourishing in other organizations and would never consider returning to GSEP/[redacted] Conservatory. My daughter is proudly now attending and affiliated with a prestige highly professional top-ranking dance school.
In conclusion, I have already indicted in the initial Revdex.com complaint how these issues can be resolved and hope they can be resolved soon.
Thank you!
