Attention RevDex.com:I am communicating on behalf of the Board of Directors for New Albany Park Condo Association on the matter of the above mentioned customer complaint, ID [redacted] The Board of Directors checked the above mentioned complaint numerous times over the 10 day span for the response, but no link was every provided to give a response through the website like in prior communications, nor any directions to send in a physical response via mail. The Board was under the impression they were waiting on a response from the Vazques family before they had the ability to respond. The Board's response is below:The Board of Directors at New Albany Park thanks [redacted] and ***, as well as the RevDex.com for their communication and assistance on this matter.After much discussion, the Board of Directors have elected to decline the opportunity for Arbitration on this matter. The Association holds firm it's position that the gutter system was serviced after originally reported so by The Vazqueses, and no other issues were reported prior to the issue at hand. Per the Bylaws of the Association, The Association is not responsible for interior repairs to the unit. The excessive rains during the time period when the intrusion happened overloaded the entire community's gutter and drainage system. The root of the problem that the customer has identified is that she believes that her gutters were not properly maintainedMaintenance of gutters is the responsibility of the Condominium Association that governs the community where she livesWhile the Customer’s explanation of what happened is accurate according to the property management company that works for the Condominium Association, Lifestyle Communities has no responsibility for these costsLifestyle Communities built the condominium unit that the customer owns, but is not responsible for maintaining it or any other part of the communityThe maintenance of the gutters is solely the responsibility of the Association, and the Association has determined through counsel that it does not have a responsibility to reimburse the customer for these costs per the referenced letter sent on June 24, The customer needs to take this issue up with the Condominium Association if she feels that this resolution is not in line with the Association’s obligations
