reservation was non-refundable and non-cancellable and the hotel does not guarantee a Empire State Building View. The guest booked a classical room with square footage up to 190 as noted on our own website. While the room the guest was assigned at 10:30pm at night does have a scaffolding net, the view is not impeded. The hallways are lit through out the hotel one way to create an ambiance. As the guest was offered other accommodations but was rejected, no refunded was provided as the reservation was non-refundable non-cancellable.

Review: My husband and I, both New Yorkers from SI, booked a room at the New Yorker. We were celebrating our one year wedding anniversary. We found that the New Yorker sounded and looked amazing on the website- the rooms ON THE WEBSITE as advertised looked clean, modern and spacious. ON THE WEBSITE there were incredible views of the Empire State Building, heart of the city. So we booked it for $433 for one nights stay 12/*/15 to 12/*/15. We got to the hotel on 12/*/15 the lobby resembled the picture on their website and that's about it. The gentleman that helped us "[redacted]" was very nice. We got on the elevator to go to room [redacted] which was said to have a view to the Empire State Building up until that point I was excited. When the elevator doors opened to the 28th floor, we were a bit disgusted at the musty disgusting smell and dingy lighting. We opened the door to our room to find - a room the size of a walk in closet. The room was about two full sized beds. As soon as we closed the door, I became very claustrophobic and nauseas the room began to spin. I just didn't feel well and then the disappointment set in, $433 for a walk in closet and dirty bathrooms (Which I have pictures) I go to open the curtains and to top it all of! There is scaffolding/construction obstructing the view of the buildings!!!! My husband called the lobby and spoke to Ronald the manager of the hotel he explained to him that it was our anniversary and that I was feeling sick bc the room was tiny we practically bumped into each other. Also, to tell him how no one told us of construction and obstruction of our view. He said he couldn't do anything to help us. He was very unprofessional and rude. At that point (25 mins into our stay) we got all of our stuff and checked out of the hotel, we got to the lobby and Driss tried to get us a diff room [redacted] but it was the same tiny room as the last. This is the worst hotel in the city and we have stayed in quite a few hotels in NYC. I wouldn't ever stay in this hotel even if it was free.Desired Settlement: To not falsely advertise their hotel. For the amount of money spent they should take out their descriptive "spacious", "modern". To also be more considerate of people's healths and to at least offer some sort of accommodation, a credit, and apology not "[redacted]" that's not that way to run a business -the WYNDHAM! Who owns hotels, resorts a multi million dollar business. they should be embarrassed of the way the hotel looks, tiny, dirty and dingy.

Review: My family and I went to new York and stayed in their hotel. Upon checking in at 3pm, 1 of the 2 rooms was not ready yet despite the check in time being 3pm. We made it up to the room to find it was not as was advertised and was significantly smaller than what was expected. Everything was outdated and older that what was advertised. We went to the event we had planned for the evening and came back to receive the keys to the other room and opened my windows to find that the room with a view that was promised with the increase in price was covered with scaffolding. There was also chipped paint with paint chips in the bathtub. None of this was acceptable for a $300/night room. I got ready to go downstairs to discuss the room with the front desk, but proceeded to pass out from exhaustion and my wife woke me the next morning when we were off to go to the next event we had planned and paid for. we made it back later that evening and upon return I made my way to the front desk to discuss with them the nature of the issues I had. the front desk woman informed us that the rooms advertised on the website were the executive suites and offered to upgrade us to that room, which I was fine with. the manager then told her that we would have to pay for the upgrade and I wasn't willing to with all the prior issues that had already occurred. He then informed me that there were two options, we could pay to upgrade the rooms, or they could refund the entire stay. I told them I would be back as my wife and mother in law had to be at a play. We took them to the play and came back and proceeded to check out of the hotel with them having talked with my bank to release the entire stay back to my accounts. This sum was approximately $1500. well $800 was released that evening with the promise of the other $700 to be released within the next couple days. The manager at the hotel even gave my bank the confirmation codes for the refund. This stay was occurring over the weekend of October [redacted] and we checked out on the [redacted] at approx. 830pm with the promise of all funds being refunded. This final release of $700 has not happened yet and I am extremely irate at the lies of advertising on their website, their lies by the management, and their lies by their corporate offices to have the situation having a resolution by the [redacted] of November as informed to be me by their corporate office and by Ann the GM for the New Yorker Hotel for her lack of concern for customer service.Desired Settlement: This is the resolution I would like to see happen.

1. A written apology to my wife for the inconvenience of having this much time pass with a situation regarding this much money.

2. A fulfillment of the promises by the management that evening to refund the total balance from the stay.

3. A personal call from Ann, the GM, regarding the situation as was promised by the [redacted] to know what exactly was going on and why its taken this long for this to be resolved.
