I would like my security deposit refunded for the apartment I didn't move into because it was UNINHABITABLE.
I was set to move in my apartment at the oaks at edgemont originally on Sept 6 2019. I was informed that it was not ready due to things still needing to be fixed, so it pushed my move in date back to Sept 19 2019. I went to the complex office to get paper work to have the lights turned on and I also asked to see the apartment that I was going to be renting. Leasing agent took me to the apartment to view it quickly because they were in there working on it and it seemed okay! The day I was set to move in I signed my lease on Sept.19 2019 and I went to clean it up before I moved my things in. I walk in its roaches on the floor, walls and the ceilings. I tried to set Raid foggers (4) off in it to kill them and allowed it to sit for 2 hrs. It however DID NOT work. I kilt roaches for another 1hr and the were still coming.I eventually gave up on killing them and left. I could not move in due to the roach infestation and allowing my children to be in that type of environment because roaches carry all types of bacteria and I have my baby's health (who is crawling) along with my other child and myself. So the VERY Next day Sept 20 2019 I went to the office and let her know I wasn't able to move in due to the infestation of roaches and as I am leaving pest control pulls up to spray the apartment the day AFTER I am suppose to already be in the apartment. So she called her manager and I told him what was going on and he automatically said I can get it sprayed, but that is all I can do. your funds are nonrefundable because you canceled your lease.The Agent did however offer another unit, but I declined because I didn't want to deal with the same thing over again. IT WAS ROACH INFESTED what did they want me to do move in anyway? No I would Like my refund because I COULD NOT MOVE IN. He and the leasing agent did say they would put in a ticket to the owners of the complex and get back with me, but I have had to call them and all they can say is We haven't heard anything back.I didn't even want to take it this far because all I want is my FULL deposit back.

Desired Outcome

I would just like to get my full refund on my deposit because I didn't move into the apartment because it was uninhabitable.

Resident did have an initial date on September . 6th to move into the unit , However we still had a few minor repairs to do in the unit . So we did move her date to September 19th. Previously before move in day she did view the unit and did a walk through as well. She was fine with the unit at that time . However we did have our highly recommended pest control *** go in before the unit was ready for move in on 08/30/2019,and 09/13/19. They treated the units with an actisol treatment which is a deeper treatment for the pest that takes 2 weeks to start to die down and 2 more treatments were done after that . They ask that when they treat the unit that we do not bomb after them . She stated that she did a bombing which inflicts with what they have already started. Also it stated in our lease that she did sign on 09/19/2020 on page 4 section 11 that by signing the lease the resident acknowledges that he/she has thoroughly examined the condition of the premises , and by taking possession thereof acknowledges that he/she received the unit in good condition. Our pest control treats every Friday , so she happen to see him the day of move in assuming that that was the first day they came because her move in date happen to fall on a Friday . So she came in the office and we offered her a new unit , she stated that she did not want to take the unit or any other . So she asked to receive a deposit back and we did not deny at the time , However the process is that my boss has to be informed .Which he was, and submit a ticket. Which he did . My move in day was on a THURSDAY NOT FRIDAY. So thy came to spray around my things if I was to have moved in the apartment!!! And that apartment should have been blocked until the the situation was cleared. No one wants to live like that. I should have been notified of the situation ahead of time and that I was being treated . It was to many roaches! UNINHABITABLE!!!!! and by law that is what is what is to be rented!!!!

We offered the resident a different unit to move into the same exact day as well. She denied before even wanting to taking it into consideration . We did try our best to make sure the resident had other options.

The Oaks manager is extremely rude and unapproachable.They take forever to repair any problem. Consistently lies to protect reports of her behavior.
From the beginning of the 12-mo. lease which started on May 27th of 2017, the Oaks apt. manager has consistently lied about the conditions of my unit before moving in which started us off on not so good terms. I had to clean up my unit from roaches being painted over and filthiness of my unit on move in day for which I have maintained pictures.
Rats would run rampant by the dumpsters because she wasn't getting the dumpster emptied and never notified residence there was no money to pay for trash collection although it's what I pay for in my rent. I also pay for extermination for which she said was being done that was not being done. I in effect was paying for services that were never rendered. Extermination was done occasionally, because I kept complaining about the roach lady they allowed to live there spreading roaches throughout the building without spraying her unit.
This manager also allowed individuals that smoked drugs and drink until intoxication, sell drugs and sex outside the apartment building until I kept calling the police, until eventually she hired police to work sometimes; but never consistently. I guess she just wanted to shut me and some of the other neighbors up from complaining about our safety with a murder (in front of the building) and teenager gatherings outside of her proposed curfew for teenagers (which again was untrue) that was not recognized by police as a violation of the complex, or any city ordinance.
On one occasion, I came up to notify the Manager *** of something involving my unit and she informed the owner *** , that I blocked her car in and kept her from leaving the office...total lies she should have been arrested, or fired for. I don't know the relationship that the owner of the complex and *** (the manager) have but it must be unconditional. Because each time she is reported it does no good. She *** becomes angry and it minimizes your service request to zero response from her, or *** (The Owner, XXX-XXX-XXXX). Her *** supervisor is stationed in *** SC and when I attempt to reach *** (xxxxx...never returns calls), she along with *** don't answer and never return calls.
The biggest concern for me now is that I am at the close of my lease and can't wait to move from this very bad experience.
1. My lease should be concluded at the end of May, yet *** is informing me that I have to move by the end of April, or my rent will increase for the last month (May) of my original contract, or sign a new lease agreement. I asked her to show me in my contract were I will have an increase in the last month of my lease agreement and she refused to show me the contract, saying that it is hers and she doesn't have to.

2. I'd like to get my possessions out and have my unit inspected before moving by mid May (within my lease) so that I can get my $400.00 deposit returned for which I'm sure they will attempt to steal. I would like the Revdex.com to know because I just feel that with all the problems faced throughout the lease this will be an upcoming problem all the way through the lease agreement that I will have to take them to small claims for the return of the deposit. Other residence who have left said that *** attempted to steal their security deposit and never returned the funds within the 30 day window *** suggested it would be returned. I'd like to have my funds within 15 days just like I was given when If I didn't pay my rent.

3. My electric bill was completely astronomical averaging over $200 per mo. due to faulty wiring etc. The power company will be sending out a rep.

4. This manager continues to talk to me inappropriately and at one point called me out my name in front of other residence

5. I intend to file this complaint with The NC State Attorney General's Office and The NC Apartment Association of ***.

I would like to be certain to receive my security deposit. The damage has been done in not receiving the services I paid for. But, I want to help others not wanting to experience what I experienced from this organization...especially management *** and those responsible (*** and *** for not assisting with attempting to provide services they would have demanded for themselves had they paid for them. I want a smooth transition out!!!! I contacted Revdex.com so that this organization that monitors bad organizational practices can be aware of this foul organization and its practices. I would like to get my security deposit back and I think I should not have to clean up the unit to be move in ready...The Oaks management and it's owners did not provide me with this luxury!!! I'd like to have my funds within 10-15 days just like I was given If I didn't pay my rent. This is the email sent to *** boss *** in *** xxxxx *** SC XXXXX: There will most likely be no response...she has promised to manage *** and never did! Good Morning Ms. *** I have been waiting for about a month to hear from you regarding the lease ledger...It will show the date I moved in...which will be May of 2017. I paid for the addtl. Days ending the month of May from the move in date of May 27th at a pro-rate. I have attempted to call you on many occasions and have received no follow-up as you informed me you would almost a year ago. I will be moving at the end of May as my least contract is complete; can you confirm...because *** and *** state the contract is theirs not mines? The concern I have this time is *** informed me that I have to submit a lease renewal by the end of April (want make that same mistake twice) or move by the end of April, although I moved there (outside 12 mo. Agreement) although I moved into my unit in May 27th 2017 and signed a 12-month lease...could you please see into this matter and check back with me at XXX-XXX-XXXX ex. *** or my cell after 4 p.m. to XXX-XXX-XXXX thank you. I couldn't get this e-mail out to you because it was the wrong e-mail address. I picked up my ledger with the little superstar *** being as rude as possible. She also denied me a copy of my lease that I originally signed in May of last year. Something, as you know I have a right to ask for again if need be. Before we believe the hype and lie of hers and cover up...I asked nicely. Or if you could just follow up with an e-mail...it would be appreciated. Thank you Thank you

To whom it may concern,

Mr. xxxxx became a resident at The Oaks at Edgemont Apartments on May 27th, 2017, and his lease expired on April 30, 2018. On Mr. xxxxx walk through of the apartment prior to move in on 5/23/17 he stated the apartment was in need of more cleaning and had a few other requests. We then sent one of our maintenance personnel to clean his unit and to take care of the other issues he had seen. When he moved in on May 27th 2017, Mr. xxxxx was very adamant in regards to his tub being resurfaced, we then told him his tub was ok and did not need to be resurfaced. He then stated he wanted proof from a professional company stating it did not need to be resurfaced which was done by xxxxx. The only reason he asked for that is because his neighbors tub was resurfaced so he felt he needed the same even though his tub was in good condition. He also requested that he be home when work is being done on his unit so we accommodated that request and sent maintenance personnel in only when Mr. xxxxx was home to receive them which also hindered our ability to respond to his requests catering to his work schedule.

On June 6th , 2017, two of our maintenance personnel went in along with me as the property manager because he didn't want them in his apartment alone and requested that I be present. Any and all issues he had were addressed that day by the maintenance guy but while I was there monitoring the work he was making sexually harassing statements towards me in front of my maintenance guys and I told him immediately that I did not appreciate him speaking to me in that matter and he still proceeded. Mr. xxxxx was engaged at that time and I was married and I told him repeatedly in front of my maintenance guys who can attest to this to stop with the sexual harassment and innuendos and that I'm a married woman and am not that type of girl. He made me very uncomfortable the entire time I was there with his lecherous talk and stare downs. After this incident and my complete rejection of his sexual advances everything started to be a bit more difficult to deal with Mr. xxxxx.

On one incident, Mr. xxxxx came to the office after hours while I was closing up the office and blocked my car in with his truck so I had to call the police. The police arrived and Mr. xxxxx had to move his car to let me back out of my parking space. He made small talk with the police officer saying he was an ex police officer but I was told by another resident who knows Mr.xxxxx very well that he was fired as a police officer because of sexual harassment. I cannot verify that but that was what was told to me by another resident who has a long history with Mr. xxxxx. He also has made several false accusations and started to spread rumors about me to other residents which were not true as he does not know me at a personal level. I feel Mr. xxxxx was giving me and my staff a hard time in retaliation for me not going along with his sexual comments the day we worked in his unit. We have worked in his unit upon request along with working by his schedule which would consist of us going to his unit when he is there at the time he requested. We went in his unit the following requested dates: 06/06/17, 12/04/17, 02/21/17, and 02/22/2018.

In regards to his complaint about pest control, our property is contracted with xxxxx and every unit on property is sprayed once a quarter or 4 times per year. We also have the exterior perimeter of each and every building on property sprayed once per quarter on top of the interior spraying which is above and beyond what is required and much more than any of our competitors do in this submarket. This is contracted work with arguably the best pest control company in the nation so as far as pest control goes our property is properly sprayed and maintained year round. xxxxx was also called back into his unit and sprayed on 05/18/17, 07/27/2017, 09/17/17, 12/28/17, 02/01/18 and 02/22/18 so he really needs to keep his unit in better order because there is only so much xxxxx can do. Every conversation we have had with Mr. xxxxx is recorded, and any work order input by Mr. xxxxx is documented. Mr. xxxxx also took it upon himself to give the whole apartment complex mine and my boss's personal cell phone numbers.

Oaks at Edgemont Apartments maintains a 96% plus occupancy level year round. If any of what Mr. xxxxx states in his complaint was true the property would be 50% occupied. We pride ourselves on taking care of our residents and providing a affordable and quality place for them to stay. We feel that we took care of Mr. xxxxx issues and wish him the best of luck during his relocation process. Our apologies go out to Mr. xxxxx for it being such an "uncomfortable" stay during his lease term, but are comforted by the fact that other relatives of Mr.xxxxx have renewed their leases and continue to call Oaks at Edgemont Apartments home.

What you have received regarding a response from them is indecent and untrue. No sexual comments made at all. It's sounds like she is dreaming...very poor experience, very poor mentally damaged individual to even hear these remarks about sexual advances...ridiculous...she definitely is not the one that I would make any kind of advancements too!!! We had problems with them addressing concerns at that time and when they came to address any concern it was months later, after the rats, roaches, drug sales in and around the building, entering my unit without permission, or notification...A complete mess and a complete liar!!!!
