Revdex.com:
I have reviewed the response made by the business in reference to complaint ID 11247699, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
Our fence was broken, and the contract with Erie Fence, was initiated long before our home was put up for sale. The initial contract was signed in July, resulting from damage done to our fence by a contractor working on the property next door. This work was never completed, and in November, a windstorm caused more significant damage to a different section of the fence. I asked the owner if we could change which section of the fence he would fix in the contract, and he agreed. A new contract was signed on November 22nd, and he informed us that, weather permitting, it would only take a couple weeks to complete. The weather was fine for several weeks throughout the winter, but the work was never done. In late December, I was told by the secretary that the work would be done "after the holidays." I continued to call, and by January, I was told that the work had not been done because of his wife's illness. Our home did not go up for sale until February, and at that point, I called out of concern that our home would sell before the work was done (as it had been months since this process started). The owner was apologetic, and explained the situation about his wife. I tried to be understanding, and we agreed that if the house sold before the work could be done, that he would refund our deposit. Two weeks later, our house was under contract for sale, and I called the owner to notify. He said he would get a check in the mail. Nothing arrived for a couple weeks, so I called back, and he said it had just gone out. When it arrived, it was less 10% of the original contract amount ($36). The owner had made no mention of this "restocking fee" in conversation, nor was it listed on the contract. I called him back and asked for a full refund. He responded on my voicemail, calling me a monster and heartless, because his wife had died. He explained to him that all I wanted was for him to return our money in full, because no work had been done. He responded by saying he does not work for free, but in truth, no work was actually done, so I failed to see how he is entitled to this money. While his contract did not designate a time frame that the work would be done by, it is only reasonable that it would and should be done in a timely manner. While I certainly understand that life circumstances did delay this process, all the more reason for him to just make a clean slate out of this, and return our money in full.  In summary, this process has nothing to do with the sale of our home, other than the fact that the owner failed to have the work done in a timely manner, and now we are moving. The owner has no knowledge of the parameters of our contract, but for the record, there was nothing pertaining to the fence included. He is simply deferring the argument, and extending the process. This will continue to remain unresolved, so long as a full refund is not issued.
Regards,
Timothy Wiles
