Review: The Parking Spot damaged my vehicles tire on August [redacted] and shortly thereafter agreed to repay me the cost of the tire, $199.18. After many emails and calls they finally contacted me again last week and said the the would take care of it. The problem is that the form says:

"That the Undersigned, being of lawful age, for the sole consideration of $199.18 to the Undersigned in hand paid, receipt whereof is hereby acknowledged, do/does hereby and for my/our/its heirs, executors, administrators, successors and ..."

They say that they can not order a check until I sign this. This states that I have been paid in full. I offered to exchange this release for a check and they refused stating that this is what they have been doing for years. I told them that sign this under witness would in effect be perjury.Desired Settlement: I would like to exchange the release for the check or sign a statement stating that upon receipt of a check in the amount of $199.18 I will release them

Review: My car was parked at the Parking Spot from 9/**/2015 to 10/**/2015.When I picked up my car (on 10/**), the casing around the front seat was broken, exposing the mechanics of the seat.I reported this damage to the General Manager, Daniel S[redacted]. He indicated that he would report this to their insurance and he would get back to me.I have received no call back. When I called the Parking Spot today, they indicated that Daniel no longer worked there. Further, the General Manager was on the phone and could not take my call.Desired Settlement: I would like the damage done to my car to be repaired back to its previous state.

Review: We left our Lexus ES330 on July *,2015. We returned to pick it up on July ** 2015. When they brought the car out there was damage to the passenger side mirror. They took photos of the damaged side mirror. They said there would be a review of their security cameras and they would get back to us. I got a call on July **, 2015 not promising compensation but to send an auditor to take pictures. My husband called the travel agency that recommended them with a coupon for The Parking Spot. They must have lighted a fire under them because they called me back with another promise of an auditor to take pictures. A week later and still no call. My husband called them to find out what the delay is and they informed him that no claim has been filed. Today is exactly one month since we returned. I want to fix my mirror but I want them to record the damage. I got an estimate of 690.07 in reparations.

The parking spot has submitted a claim to [redacted], their insurance company. I believe they falsified a damage record that stated there was damage to the passenger side mirror prior to us leaving it in their establishment because [redacted] denied the claim. I did not bring my car in with any damage to the mirror. Two weeks later the mirror was shattered. I have an estimate of $690.00 for a new casing and mirror. I called [redacted] and talked to a supervisor. I talked with Laslo F[redacted]. He walked me through the security camera video that he had. He told me that the video was grainy and he could not see it clearly enough for judgement. I asked him if he saw the pictures of our damage claim. He replied that there was obvious damage, as the mirror was hanging out of the casing by the wires and there was a gaping hole on the front of the casing. We came to an agreement that we would settle for $500.00. I would assume the responsibility of not taking my own precaution of trusting them, and take my own pictures to show proof of an intact car. I am aware now that anyone can draw up a false record of damage and predate it to cover their butts. I am not falsely claiming this as I know for a fact that the damage was done sometime after our departure and before our arrival to pick it up. I will never use the Parking Spot again and encourage anyone traveling to use an alternate business.

Review: I parked my car there from 6:41 AM on 10/**/13 until 11:34 PM on 10/**/13. It was quite dark when I left at after 11:30 at night. The next morning I noticed that the right rear bumper was damaged, obviously by them. (They had inspected the car when I dropped it off and that damage was not noted by them on the form they filled out). I called that day (10/**/13) and spoke to someone named [redacted]. He informed me that they would review the cameras and call me. They did not call. I called on Oct. [redacted] and spoke to a manager named [redacted]. He suggested I email him a picture of the damage, which I did. He then referred it to their insurance company, [redacted]. The reference # is [redacted]. A woman named [redacted] called me and said that since I had left the lot, there was nothing they can do. I find this unacceptable. They clearly damaged my car. If they really did review the cameras they would see that they damaged it.Desired Settlement: I need to replace the right rear bumper. It will cost me about $500. The car is a 2010 Honda Civic. I want them to pay me the money to do the repair. I am happy to provide an estimate at any point in time.

I am asking this business to honor my contract of taking good care of my car. I am not asking for a refund of services. I have attached the picture of the damage to my car which they did. It will cost me $500 to repair my car. They took the time to inspect my car when I dropped it off. The damage was not noted on their report because there was no damage. They clearly were not careful with my car and damaged it. Therefore they should pay for the repair.

Liability was denied by the facility’s insurance carrier, [redacted], solely because the claim was not reported on-site. All patrons of The Parking Spot at JFK receive a valet claim check which clearly states the following:

“This is your only Contract, and this Contract limits the liability of the owner and management company of this parking facility (owner and management company are collectively referred to as the “Company”). When Company accepts possession of vehicle and keys, you and Company agree: Company does not become an insurer and shall not be liable for fire, theft, loss or damage to vehicle, or mechanical malfunction; Company shall not be liable for fire, theft, loss or damage to any personal property or articles left in the vehicle, nor will Company accept possession for bailment thereof; no employee of Company has the authority to bind Company to create such bailment; Customer agrees to inspect vehicle and to report any claim of damage or loss in writing prior to leaving facility and if not so made, any such claim is waived by Customer. Vehicles left over 30 days may be impounded at vehicle owner’s expense, and sold for expense and storage fees, unless prior authorization is received from the Facility Manager. The Company must receive this ticket and full payment of parking charges before your vehicle will be released from the parking facility. This contract is not assignable. Customer waives all rights in conflict with the foregoing. No employee may modify or waive any of terms of this contract (other than Facility Manager’s limited right to permit cars to remain over 30 days). ANY CLAIM FOR DAMAGES TO VEHICLE MUST BE MADE BEFORE LEAVING PREMISES.”

Furthermore, cameras are installed on the two entrance lanes but not the singular exit lane. Admittedly, damage was not evident when the claimant’s vehicle entered the premises, nor was it marked on the valet ticket. However, damage claims caused by the facility cannot be conclusively determined unless claimed on-site. In the case of [redacted], the claimant left the premises on 10/**/13 and communicated with the facility the next day (10/**/13) to report the damage to his vehicle. As a result, the company cannot categorically determine if the damage occurred on-site and will reinforce the insurance carrier’s decision to deny the claim.
