People's Choice says I owe them 10% of what my insurance is covering for my damaged roof, but they didn't do their job.
On Dec 2017, Mr. from People's Choice, came to my house to do an assessment after hurricane Irma. Then I signed all the paperwork that People's Choice sent to me. When I spoke with Mr. Tyler twice, he said they were still fighting with the Citizens home insurance about my claim. After that I never heard from Mr. Tyler or anyone from People's Choice for over a year. On Jan 2019, I signed a contract with Rising Star Roofing to fix my roof. I also mailed a registered letter to People's Choice to cancel their services, but it was returned to me. After calling several times and leaving some voicemails, Mr. Tyler finally returned my call and told me a lawyer would contact me. Now People's Choice wants me to pay 10% of what Citizen's insurance covered for my damaged roof. On *** 2020, I found out that People's Choice had changed their address and that's why my registered letter was returned to me, but I was never notified by People's Choice of the change. Attached is the contract from People's Choice with their old address.

Desired Outcome

I shouldn't have to pay the 10% to People's Choice since they didn't help me or return my calls for over a year.

The People's Choice Public Adjuster (TPC) is concerned with Ms ***'s frustration but believes it should be directed at Rising Star Roofing as the following will attest:
On December 11, 2017 Ms. signed a contract with TPC for property damage resulting from Hurricane Irma. TPC filed the claim with Citizens Insurance, inspected the damage, developed an $87986 thousand estimate and sent it to Citizens with other required documents. Insurance carriers have 90 days to respond to these documents. On February 5, 2018 the claim was denied and TPC forwarded it to legal counsel to file suit (this is a typical process on 70% of insurance claims and is necessary to enforce the carrier's policy). At that point, TPC's regular contact with Ms. was transferred to her attorney Rhina Field. Despite TPC's advice to Ms. she signed an Assignment of Benefits with Rising Star Roofing (RSR). In fact, RSR negotiated the claim - a felony in the State of Florida - receiving a settlement of $53 thousand dollars, much less than the estimate and against the advice of counsel, Ms. Field. RSR is in possession of the settlement check payable to Ms., TPC and RSR, is refusing to repair her roof, is giving Ms. unscrupulous information and holding the check hostage. RSR has no understanding of insurance carrier policy or practice and is not authorized to negotiate settlement or withhold payment from Ms. or TPC. Revdex.com should be aware there is pending litigation versus RSR in this matter. In addition, Ms. allegation that she hasn't heard from TPC in a year is false; someone from Ms. Field's office or TPC has spoken to her regularly. In fact, had Ms. allowed her attorney and TPC to settle this claim, she likely would have secured a settlement much closer to TPC's estimate and would have her money in hand.

After signing the contract with TPC on December 11, 2017, I called Mr. Kenny Tyler twice in the month of January 2018 to figure out what was going on with my claim because I hadn't heard from Mr. Tyler or anyone at TPC. TPC did not inform me that on February 5, 2018 the claim was denied. After we spoke twice in January 2018, I continued to call Mr. Tyler by phone several times but he would not answer or return any of my calls. Nobody from TPC ever contacted me for all of 2018. So in December 2018, I mailed a registered letter to cancel my contract with TPC because I hadn't heard from them and my roof was getting worse. In January 2019, the registered mail was returned to me. Also in January 2019, I decided to sign a contract with Rising Star Roofing because of the worsening condition of my roof and molds growing. In September 2019, I accidentally dialed Mr. Tyler's phone and he actually answered this time. I asked him why he hadn't returned my calls, what was going on with my claim and why was my registered letter returned to me. He would not answer my questions and kept deflecting. It was at this time he told me about the lawyer, Rina Field, and gave me her contact info. Mr. Tyler's explanation was very confusing and I didn't realize that Ms. Field was my lawyer. I thought Ms. Field was TPC's lawyer and that I would have to communicate through her instead of Mr. Tyler. TPC and Ms. Field's claims that RSR is refusing to repair my roof is false. I was delaying RSR to repair my roof because I didn't understand the contract. RSR was waiting for me to sign for them to start repairs. TPC is lying about someone from TPC speaking to me regularly in 2018. That is why I sent the registered letter to cancel the contract with TPC. If TPC was in contact with me regularly in 2018 like they say, why would I cancel my contract with TPC? Attached is the registered letter I sent to TPC that was returned to me as well as an estimate from TPC containing their address.

Because of the current litigation - Case No: CACE-XX-XXXX-SCXXXXXX Palm Beach County & related cases in Broward County- our response will be short. Ms. complaints are baseless. In an attempt to muddy the waters and avoid payment, she has signed multiple contracts with attorneys and subcontractors. Our Letter of Representation is attached and quite clear and our records disprove her allegations. We request that the Revdex.com close this case and let the matter be resolved by the court.

The People's Choice's comments regarding me signing multiple contract with attorneys and subcontractors is baseless. The People's Choice is not reliable and are inconsistent with their business practices.

I was happy with the end result but it took a lot to get there. I asked and was told repeatedly that there would never be any out of pocket expenses with them. Beware! Because there is, and it's a big one.
I specifically asked and was assured that never would I have to pay for anything out of my own pocket. That was true until my settlement check arrived and they wanted $4000 from me for them to endorse the check (their name goes on your settlement check). Not only that but was harangued rudely by the owner of the company. I had to wait months to finally save enough to get my own check. The reason I asked repeatedly about out of pocket expenses was because I knew I didn't have money to pay for anything.
My opinion is they flatly lied to me and the owner could not have been any more rude to me and my wife. I would explore other options.

We are pleased we were able to secure over $56000 for you, a 66% increase in your carrier's initial offer. Perhaps the issues in collecting the amount owed to TPC - your nsf check & the over 5 month delay on your part - could be a contributing factor to your dissatisfaction. I still had to wait 5 months to get my check because you required out of pocket funds to get you to endorse the check. So, it was out of pocket. It also cost me 5 months of additional time and I was rudely harrassed by the owner of the company. I told you in the beginning I wouldn't have that kind of cash on hand and meant it. Your harassment was my biggest turn off. I would never recommend your company and making it known. Beware to all, there will be out of pocket expenses. I believe People's Choice was deceitful or misleading at best.

I still had to wait 5 months to get my check because you required out of pocket funds to get you to endorse the check. So, it was out of pocket.
