11/17/*** *** contacted The Peoples National Bank to inform us that his vehicle was a total loss and *** *** was handling the claim, I also advised him that he needed to cancel his extended warranty through the dealerAt that time the consumer stated the he needed to get another vehicle
and wanted to know if we would be willing to finance a new vehicle for him and I said we would be more than happy to process an application for another vehicle loan when he found one he wanted to purchaseOn 11/18/*** *** notified us that a settlement claim of $7,for the date of loss on 11/13/would be paid to the bank and on that date a Gap claim was filed since the settlement amount would not pay off the loan."As per Gap policy contract: Net Payoff: The amount of the Lender's interest as of the Date of Loss, as represented by the portion of the Borrower's unpaid balance, according to the original payment schedule of the Financing Contract that is secured by the CollateralThe Net Payoff will not include any Delinquent Payments, unearned interest and finance charges, or any unearned insurancepremiums (including, but not limited to credit life and vehicle service contract coverage's)It will include any lease pre-payment provisions as provided in any Financing Contract when the provisions have been provided in writing to the Company."On 12/6/we received settlement amount from *** *** in the amount of $7,that amount was applied to the principal balance of the loanOn 12/9/we received the Gap settlement in the amount of $1,and the amount was applied to the principal balance of the loan, On 12/22/we received the Service Contract pro-rated refund in the amount of $and that amount was applied to the principle balance of the loan, this left a principal balance of $a late charge was assessed on 1/17/I tried to reach out to the *** *** by phone several times with no return call*** *** spouse contacted the bank on 2/6/and when asked why the consumer did not return my call she stated that they were busy.On 2/11/*** *** spouse came to our office to pay off the remaining personal balance on the loanI gave her a receipt and a copy of the payoff in the amount of $72.46, because that they paid by personal check I told *** *** that we would mail out the original paid note once the check cleared and I also could not give her the original note because she was not on loan contractI also asked her if they purchased a vehicle and she stated that they did and received financing through the dealer.On 2/13/there was a voice message from the spouse left on 2/11/after business hours stating that he wanted a copy of the insurance settlement breakdown and also the Gap insurance settlement breakdown, I returned her voicemail on 2/13/and *** *** requested that I fax the information to her and I called to confirm that she received the fax
