"steadfastly rejected" our offerThe Pet Food Bank offered to resolve the matter with her, but according to her instruction, that offer was declined.There is no "written agreement" between *** *** of Akita Angels and The Pet Food Bank, but *** offered to resolve it in "good faith"Due to the continued escalating harassment and threatening tone of the emails, *** has discontinued to responding to *** *** of Akita Angels after she "declined" the offer of reimbursement with the return of the food, treats and cleaners. The pet food donation received by *** *** of *** *** was sealed in a container when it arrived to our location from the distributorWhen the pet food donation was loaded on her truck, the pet food was still sealed in the original container received from the distributor. We are also attaching a copy of the *** Good Samaritan Food Donation Act. Sincerely,The Pet Food Bank

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below. Ms*** continues to lie and perpuate fraudThe complete chain of emails, from start to finish, that we provided with the filing with Revdex.com, proves thatOur original email to Ms*** and her response, and the transferring of funds to seal that written Agreement, constitutes a written Agreement under California LawIn our original email to Ms*** we ask if she has dog food, and she replies, stating, in part, "$for a premium-brand pallet." We replied, agreeing to purchase a premium-brand pallet of dog food and transferred the funds to herIt goes without saying that we would assume that the product Ms*** is selling or otherwise distributing is safe, untained, has not been tampered with, is not expired, and is legally allowed to be distributed, and of course meets the criteria for dog food safety as established by the appropriate government agenciesMs*** did not provide food that is safe and legally allowed to be distributed to others and our position in this regard is proven by the photos of the torn, previously opened, and re-taped bags, many of which have large labels on them that say "DEFECTIVE" on them, which means they are customer-purchased-returned-product under a manufacturer's product guarantee and as it was to be destroyed, NOT resold to unsuspecting parties such as *** ***We have spoken with management at the various dog food stores and chains whose names and numbers are on those bags that Ms*** provided to us and they are upset with Ms***, to say the least, and have indicated they and the distributers will be taking action against Ms*** and ***.We also provided photos to Revdex.com which showed the sheer level of infestation of the food, and which seemed to be isolated to the bags that were very clearly consumer returnsThis food is not safe for consumption by any companion animal and the representative at the *** *** *** ***, Environmental Health Department-Los Angeles & Orange County, as well as the FDA, has confirmed that.The emails we provided also show that Ms*** did not in fact ever allow us the opportunity to return the food to her, which is our only legal obligationMs*** clearly states in an early email that “she didn’t know the food was infested” which would imply that “had she known, she’d not have sold it to us.” However, in her next email, having seen the photos and knowing the food she provided is infested and unusable, she attempts to justify the goods given to us by stating “you got buckets and cleaners and treats”, all items which were not nor were ever part of the original written agreementInstead, she states curtly “provide your address so the product can be picked up by another rescue who can use the food.” Our only legal obligation would be to return the food to her and if Ms*** was an ethical human being, she’d refund the portion or all of the money paid to her for the returnInstead, Ms*** demands that we provide our address so that some other, unknown person and/or animal rescue can come over to our location, and pick up this defective and damaged and unsafe food because, as she states “ they can use the food.” I can confidently assert that another rescue would not use the food for anything other than feeding animals, and, I’m certain that no rescue would knowingly purchase $of damaged, defective, expired, rodent-feces and insect-infested food and feed it to animals who are in an animal rescueI am also confident that Ms*** would not feed this food to her own dogsWe are a large breed rescue and do not allow “strangers” to just roll up onto our property, uninvited, and enter locked gates on private property where our animals are housedFurthermore, we will not “be in the middle” of Ms***’s fraudulent and misleading and illegal business practices and transfer this food to another party so it can be fed to their animals, namely, because when those animals become sick or die, we are not going to be the ones that transferred this food to them at her direction.Public tax records show that Ms*** took in over $160K in cash donations last yearSo *** earned, aka, “took in” $160,in cash last year, money that was given to *** in exchange for food that was set for destruction and was never allowed to be sold to another party or otherwise distributedThe IRS will, I’m certain, be looking carefully into the *** for violations to include the selling of food and food that is unsafe as it was tagged for destructionIn addition, Ms*** “sets the price” for her food, as evidenced by our email to her, supporting our position that she sells the food, and which further discredits her position that it is a “donation.” Furthermore, the IRS REQUIRES all charities to voluntarily and mandatorily provide a written receipt to the “donor” that states, “no goods or services were provided in exchange for this voluntary donation”, a receipt that she won’t provide as she can’t, as goods were provided in exchange and as she “sets” the “donation”, it becomes a “sale.”*** ***, as a consumer, has an expectation that Ms*** and *** would conduct business in a legal and lawful manner, especially if she is taking in a substantial amount of money each year, tax free, for food that she likely obtained out of a dumpster from the back of a pet food store or illegally from one of five dog food distributers that serve CaliforniaWe are also a public charity, and our board includes an attorney and an EA (Enrolled IRS Agent.) We are a *** corporation and in good standing with the *** *** *** ***, Registry of Charitable Trusts, the agency in CA which requires all charitable trusts to remain current withIf Revdex.com visits www.***, they will find that *** has been “delinquent” in maintaining its registration with the Registry of Charitable Trusts and on December 19, notified them, in writing, that they have been delinquent and failed to maintain registration with the RCT from to now.Finally, our email chain proves that at no time did we “threaten” or make “escalating threats” to MsS she states and she ceased communications with us for no reason other than she has no option but to return our moneyIf our statement “that we will pursue this matter in small claims” is construed by Ms*** as a threat, then perhaps Ms*** should take a business course to learn that is how disputes are resolved when two parties cannot reach an agreement.Ms***, who took in over $160,last year alone and claims over $300,in “assets” should do the right thing and return our $250.00, as that product, which she placed, in our truck, was never legally allowed to be sold or otherwise distributed to anyone, and especially for a profitWe hope that the Revdex.com can continue to persuade Ms*** to do the right thing and without further disputeRegards, *** *** We also provided photos that proved the photos that showed the sheer level of infestation which seemed to isolated to the bags that were consumer returns, or those that
