Complaint: [redacted] I am rejecting this response because: I did sign a contract which I have yet to receive a copy of. In the contract, I selected a package with specified sizes of prints that were to be delivered. At a later date, I also ordered additional prints which were NOT part of any contract. All of the prints arrived at the same time, I did not receive ANY of the prints in the sizes that I purchased, I would consider those MISSING. I spoke with [redacted] on the phone right after I received the prints in the mail. She told me send her an email of the missing prints, which I did. This was her response: [redacted] ,I am so sorry for these mistakes. In my contract it does state that I am not responsible for the quality of prints. I know I said I would reimburse you for the missing prints which I have no problem with, but not for the ones that came out incorrectly. The contract which was also signed by myself, is introduced to all customers. In stating this I feel if I reimburse you for the wrong prints produced from the print company, I would have to do that for all clients that have any kind of issue, which I do not do. I hope that you do understand where I am coming from as a professional. Again I am very sorry for this mishap and I will reimburse you with a check for the missing prints. I will send it with your USB once it arrives. Thank you.The Photograp{her} [redacted] I would like a refund on the prints. Regards, [redacted] ***

I offered months ago to send her a copy of the contract to which she did not respondI checked the order of printsI did not check them after they were made by the print company, when they were delivered or passed on to the costumerThe same way that I wouldn't check them if the client ordered them from walmartI made an effort to fix the problem more then once, to which she replied that she would try her luck elsewhere

I am rejecting her statement as well, for these reasons. In the e-mail that she showed for her example I stated that I am not responsible for the quality of prints. Quality would include any manufacturing mishaps; such as size, color, miss-prints, orientation, miss-cuts, etc. I do not consider "missing prints" to be prints that are off in size; for example a 1/2 inch in height and an inch in width. "Missing prints" would be prints that were never delivered from the print company. I am not liable for what happens to the prints produced from the print company. She did receive all of her prints listed, as she showed in the e-mail example. The $150 price included a print package of her choice and a USB of all edited images. There are eight print packages to choose from that all equal the same total of $30. The USB is a total of $80. She then ordered an extra $35 worth of prints. Bringing her print total, through myself, to only $65. The excess $40 is the sitting fee. In an effort to resolve her concerns, I stated in an e-mail that I wrote to her on November 19th, 2014 that I would be happy to help her order the prints again through one of my alternative print companies at their whole sale price. She said thank you, but continued to say that she would try her luck at [redacted]. Thank You

I am rejecting this response because: I have yet to receive a copy of the contract.  I am very disappointed that a professional photographer would not check the order of prints that are to be sent to the customer, try to fix the problem and expect return business.

There are no missing prints. All the prints are there. As stated before "quality" does include many things, one of them being "missing". I am not liable for the quality produced by private print companies. A contract is entered as an understanding, by signing the contract she understood that. [redacted] In her email she said she would reimburse me for the missing prints.  All of them were missing, I didn't receive any of the sizes that I ordered. The package of $150 that I paid for was photography and prints.  The additional $35 for extra prints on top of the package that I ordered.  [redacted]

This is an email regarding the letter I received from the Revdex.com in regard to a ContextualSpelling" id="45" data-gr-id="45">costumer complaint. I would like to Respond to this Complaint by stating my position.
In regards to the refund that she is expecting, many emails have been exchanged. I acknowledged that her prints were very poor in quality even though I did not look at them myself, because I normally don't. I was very sorry for the fact that her prints were not in that great of quality. I stated to her that in my contract, which she psychically sat down, read and signed in front of me and her husband, it says that I am not liable for the quality of prints. In there it also states that I do not do refunds. Which she understood and willingly signed. She said that she never received a copy of this contract and I stated that I was more then happy to send her one, either by email or hard copy in an email. I said that I would be more then happy to reimburse her for the prints that she said were "missing" which was discussed in a phone call. She said that she received the prints but many were poor quality, miss colored and "missing". She then proceeds to later state that none were missing they just weren't the exact size that she was expecting. When I emailed her explaining this she said the she understood about the quality and that she didn't receive any of the correct sizes. Not responding to me about the missing prints. She later went on to say that she would just wait until she received her USB and try her luck at [redacted]t. Again there is no "missing" pictures, which is what I stated I would reimburse, they are just not the sizes that she expected, which is not what I agreed to. The purchase price that she stated is $193.00. Which is incorrect. Since the photo session was only $150.00 and the extra prints that she ordered was only a total amount of $35.53. Bringing her overall total to $185.53.The reimbursement that she is asking for is $75.00. Which makes no sense since her prints only cost her a total of $35.53. There is an email which states this. If this includes her purchases made through other people for her pictures I am not responsible for the money that she spends elsewhere from the USB of pictures, received from me. In response to the emails that "were not responded to". This is untrue. I responded to every one of her emails and phone calls. The last connection that we made was on November 20, 2014 by email. I have no missed calls from her. I did find an email from her which was located in my Junk folder today, when I received this complaint and went to look. This email is one that I obviously never received. Thank you.
