The Pointe at West Chester

Review: I signed a 12 month lease in December 2013. I was granted rent relief for the remaining two weeks in December and all of January 2014. It was made clear at that time during my tour of the facility and in reviewing the contract I would be responsible to payback that discount in full should I terminate the lease prematurely and bear responsibilty for two months rent with 60 days notice. The figure represented on the lease as the penalty is within $100 of the two months rent, the discount payback, and what I was told were administrative fees and utility considerations. I moved out 7/1/2014 and supplied notice of the 60 days required 6/30/2014. I received my $500 deposit back as well. In turn I paid the rent for both July and August as well as the rent penalty for the discount in full, $2543. They have confirmed receipt. Now I am being told my account will be sent to collections as I have neglected to pay an additional two month penalty despite the unit being rented effective 9/1/2014. I have approached their management team with what I feel is a gross misrepresentation of intent and been denied any consideration. I understand completely the 60 days notice and my financial responsibility therein as well as the rent penalty for the discount received but requiring another 2 months despite the unit being occupied 9/1 is egregious.Desired Settlement: I would ask that the BB work to have the 2 month penalty absolved in full based on the explanation above. I also have all of this in writing and despite their contractual material I also feel the Sales process was misleading intentionally and ambiguity built into the contract leaving the customer with the trust of the property manager as your guide.
