I am receipt of the complaint from the [redacted] I am a bit confused We really did not deal much with [redacted] but had most of our field work contact with [redacted] , her Husband The scratch on the wall was brought to [redacted] attention the day of the pool excavation when it happened, it is a couple of inches long, he told us not to worry about it(please see photo of the wall the scratch is barely visible) He said he had lots of the stucco color and he would touch it up The fire pit was not driven over by our personnel, it is possible that a delivery truck that brought the steel rebar for the pool may have drove over it, it is loose rock stacked in a circle At the time of the pool construction the grass had grown high around the rocks and the owner had covered the rocks with branches, please see attached photo (it is hard to see but if you look closely you will see some lumber and next to it the rocks, one rock seems to be knocked over) This photo was taken after [redacted] complained, again we met Kyle on the job and he said its no big deal, don't worry about it Please look at the photos of the clearly marked (with rebar and yellow tape) sprinkler heads, I have several photos that we took during construction, you can clearly see the marked sprinklers The customer said during coping our people ran over the sprinklers Please examine the photos and the blowups of these photos, you can clearly see the marked sprinklers with the markers and yellow tape still intact, with the coping completed and my crew cleaning up for the day Please also notice the large mounds of dirt that were left for the owner to grade out, they surround the sprinklers When we came back after the coping was poured the owners deck contractor had graded for decks these rebar stakes and yellow ribbons were gone and the piles of dirt around the pool were leveled out we did not damage these sprinklers The owner supplied the gas line to the pool heater, this gas line and regulator are not functioning, currently the heater is not working and the manufacturer [redacted] has been trouble shooting the problem We have a direct contact with [redacted] , [redacted] the customer is free to call them The factory has determined the gas line and regulator are the problem [redacted] is working with the people who installed the gas line and regulator to get it fixed Contrary to what the owner said we did not install the heater improperly, rather the heater came from the factory with the wrong gas orificeonce this was determined we immediately changed it This can also be confirmed with [redacted] *** Unfortunately the gas people did not follow the gas line installation instructions from the manufacturer, which are posted in the heater Until the gas line and regulator are corrected by the owners contractor the heater will not work On 8/4/the pool equipment was started up, a relay in the auto-cover motor was defective and it could not be reliably operated, it was changed out on 8/8/four days laterThis was over a weekend We have met with [redacted] on the Job and taken care of the tile grout complaint that they had We also discussed the Revdex.com complaint, he was not aware that his wife had complained to the Revdex.com and his stand on the fire pit, wall scratch, and sprinklers remained the same, “don't worry about it” He is diligently working to get his gas line and regulator fixed so that we can fire the heater back up, ( we have made service calls on this heater which are related to the gas line and regulator not being right and have not charged the owner at all for any of these calls In fact [redacted] still owes the remainder of the final payment on the swimming pool, (we believe she accidently transposed two numbers when writing the check which made it a couple of hundred dollars short) We noticed that the complaint coincides with our very polite request for this final payment to be made right In closing, it is our sincere intent to see that the [redacted] are happy with their pool Once they have their gas line straightened out we will be right up to get the heater going I am not interested in fighting with [redacted] over a couple hundred dollars that they still owe, they can keep it Sincerely, [redacted]

The owner in his first complaint accused us of doing a pour job of digging up his utilities and damaging themClearly the owner has now stated that we were not negligent and that his utilities were pristine after we dug them upOur contract with the owner states under "Responcibilities of Buyer"All existing services (gas water electrical sewer cable) "are the responsibility of the owner" it is a shame that the owner will not recognize that we did a good job (better than his Electritian who damaged a cable digging it up which was half of the repair cost)We were very carefull not to be negligentIn the absence of being negligent the responsibility for the utilities lies with the owner

The customer felt that we had negligently damaged his year old underground electric lines We were very careful with the lines when we dug them upWe took pictures of the lines just before back filling the trench to show their conditionThese lines were inspected by an engineer the
building dept and our Construction super MicahNot to mention the plumber and Electritian who installed the lines in the trench The pictures and information have been sent to the customerWe were not negligent in any wayAdditionally our contract excludes liability for underground utilitiesI am sorry the customer is having problems with these old root infested lines....Thanks*** * *** **PresidentReardon Construction Enterprises

We were very carefull not to be negligent. In the absence of being negligent the responsibility for the utilities lies with the owner.

I am rejecting this response because:There is little logic in it. It is ridiculous to assert that the electrician damaged the line that he repaired.  The only logical explanation for the line failure is damage from the last party that exposed it, i.e. the pool installer.I will not rescind my complaint.  I will continue to reject your responses.  We are entirely reasonable people that expect quality work for the amount of money we paid (maybe this is an old fashioned notion).As far as I am concerned this conversation is over.
