*** was informed in March that the late fee changed to if a payment was lateShe is reminded of this policy monthly in multiple email reminders for payment as well as in invoices
I have been instructed that both notice, as
well as regular policy information needs to be given to enforce late feesBoth have been given, she has been informed of this monthly (approximately times- as she is notified each month since March of through Jan2015) as well as has paid this before at least one time prior without complaint to the business, her supervisors or the Revdex.com- when her payment was over two weeks late (which has occurred times total in months)
The late fee is as informed, She was told this information and stated that she would refuse to pay that amountI told her that if she chose to do that, I would need to cancel her supervision- WITH a day noticeWhich meant and continues to mean that if she does not pay the full amount of her supervision invoice, I will be forced to give her a day notice to end supervision
Also, her supervisors have been consulted on this, as has the MN board of social workThe policy has been both deemed appropriate and reasonable by all, and her supervisors have stated that if she continues with her erratic and negative behavior, regardless of payment, they will terminate supervision due to liability risk for themselvesAll of the above parties consulted are in complete agreement in both the policy, the fairness of such, as well as the need to enforce it fairly to all consumers- which includes ***
Again, the late fee continues to be in full effect as I have been told by my business attorney that it is more than fair, and completely legal to change the amount given notice, which I have given times to ***, far exceeding the one time requirementAlso, if termination does occur, the contract I have with her will remain in full effect, as nothing has been breached and a day notice will be given to her

I'm concerned about the personal tone of ***'s response on behalf of the Professional Matrix and am also concerned that there seems to be more of a focus on getting validation from other parties (not relevant to the disagreement at hand) on whether the Professional Matrix has made the "right" choice instead of the best business professionally sound choiceThere is also no evidence that any of what she says about the parties agreeing with her is true eitherEither way, I would like this to resolve this disagreement professionally without resorting to slandering my character or making it personal
I am concerned about the mixed-messages that I have received from the Professional Matrix throughout my contract with them from March through nowI would like a clarification on why the contract/agreement I signed in March would say $late fee as one of the terms instead of the $late fee that the Professional Matrix states started already when I started supervision services at that timeIf it was truly the $late fee in March as *** claims, I would also like clarification on why the invoice I also received near the end of March would also say state that the late fee is $and is nonnegotiableSince this $late fee term was listed both in the agreement and the invoice received from the Professional Matrix, I assumed my contract would be specifically for $
Besides this mixed message of late fee charges, there have been other mix-ups on the part of the Professional Matrix that include inconsistent payment tracking system along with me receiving invoices and personal information for other clients of the Professional MatrixThis inconsistent payment tracking system is the reason why *** has accused me of having late payments in her response, but in actuality, I have only had one late payment with one late payment feeI have all my cashed paychecks to prove that what I say is true and that I have only had one late payment and one late payment fee in which we are now disagreeing aboutI'm not sure if these statements are intentional or a mistake on the part of The Professional Matrix as we have already established these were mistakes on the Professional Matrix's part over email (which I have copies of) throughout the past several monthsRegardless, these mistakes on the part of the Professional Matrix have me concerned that the late fee charges are another mistake that the Professional Matrix is unwilling to take ownership of and practice good business conduct seeing that they were never clear on there being a new change to the late fee and that they did not honor a contract that was signed in late March in which they specifically stated that the $late fee was non-negotiableAnd yet, *** stated that the late fee was $in MarchThis is quite a contradiction
At this point, since the Professional Matrix is unwilling to prorate for next month, then I would like to cancel supervision without receiving February supervision and just receive the $backI request this because I sincerely don't feel comfortable entering back into a supervisee relationship with supervisors who *** claims have not been neutral in the contents of a disagreement that is only legally between myself and the Professional Matrix businessDue to this potential blurring of boundaries and lack of neutrality, I feel our supervisor-supervisee relationship has been breached and I truly don't feel comfortable anymore entering backing into one more month of supervisionI truly hope we can come to a compromise or agreement on how to resolve this situation as I sincerely feel these concerns are important considerations in order to have an effective and ethical supervision relationship

Notice was given prior to any late payments renderedThis policy was changed long before Dec2014, however below is the email I sent her *** on 10/reminding her that her payment was due on the 5th of NovemberOnce the payment was not received, I also emailed her on 11/with no response from herIt was not until the 14th that she replied stating she sent in the paymentShe was made aware in emails alone of the late payment fee of for this month (including the notice prior to the payment being late)See email below
TPM will offer to refund her month she paid in advance if she chooses to not receive supervision in Febwhich would be TPM allowing her to forgo the day notice
TM will not refunding her the increase in late fees she has paid however, as the late fee amount and notification of such is both legal, and ethical
If she chooses to end her supervision immediately, of course the month in advance will be refunded in the full amount to herIf she chooses to have her last month of supervision occur in Feb, 2015, the month in advance she paid initially will cover the amount and therefore no refund will be given
TPM has resented both options to her and it will be her choiceThe only remaining grievance is refund she would like for the late fee she paid since her payment was weeks late, and that will not be given to her
