[redacted] continues to use a clerical error on his original contract as a reason for withholding final payment We are not required to offer any upgraded warranties on our [redacted] roofs We offered the year [redacted] Plus Warranty at no additional charge as a professional courtesy, as it is just good business He keeps referring to a clerical error and referencing an expired certificate, when we have already sent him information confirming that we are [redacted] certified We provided him with the regional manager's phone number in order to confirm that we are certified as well as sent him his warranty number, that we were able to push thru without final payment as a measure of good faith and to reassure him that we are indeed certified with *** Attached you will find [redacted] 's [redacted] Plus Warranty (dated 11/3/16) from ***, which would have been impossible to get if we were not [redacted] certified With regards to [redacted] referencing us asking for final payment in order to warranty his roof, he is correct The reason we were asking for his final payment, immediately after the job was finished (other than it is stated in the contract he signed), is because [redacted] requires the contractor to be paid in full, as part of the terms and conditions of his warranty This is stated on page 2, last paragraph of the [redacted] Plus Warranty under Effectivenes and was explained to [redacted] on several occasions Please see attached[redacted] should also be aware, that [redacted] reserves the right to cancel his warranty for non payment to contractor, if we notify them of such status He should also be aware, that he is voiding his workmanship warranty with The Siding Guys, LLP by having, in his own words, "multiple competitors ripping apart our work" trying to find issues as he has stated to Steve on 11/7/ In his above response, he is now claiming that he is not withholding payment due the warranty (he now knows there is a documented paper trail that we are [redacted] certified and his claims are false) With regards to now him claiming that he is withholding payment due to "damages," please read all of the emails and our attempts, to correct any concerns that he hadEven though we felt that a lot of his claims of damage were false With regards to where we stand today, we would still like the opportunity to come to a peaceful conclusion with [redacted] Our final offer will be, which we feel is more than generous considering he has assassinated the character of our company and work:$to clean up minor scuff marks (which we would have done if he hadn't asked us not to return to the property)New Pool Cover and Aquatic Blocks (which as we already stated to [redacted] that we purchased them as soon he had confirmed the model number and is sitting in our office.)A letter of apology to the workers for assuming that they were illegally working in the US based on their ethnicityIf [redacted] does not feel that these are reasonable terms, we will have to unfortunately, place a mechanics lien against his house, notify [redacted] that he has not paid us in full (which will void his year [redacted] Plus Warranty), as well as take legal action for breach of contract per the terms and conditions (on page 6) of the contract he signed on 10/18/16.It is extremely disappointing that we have a customer that is not satisfied with our work In all the years that we have been in business, we pride ourselves on our workmanship, our professionalism, and our perfect accredited rating with the Revdex.com We hope that he will find the above terms acceptable so we can come to a peaceful resolution

I am rejecting this response because:I will start at the beginning of of The Siding Guys responseThey state that once they asked for final payment I began coming up with a long list when in fact when Steve was on the job I had brought him over on 10/28/and showed him what was going on as I stated in my original complaintThen again as in my original on 10/29/I contacted *** to let him know about what was going on that day as his was the only number I hadHe states that I did not allow them to do a final cleanup but in fact Steve was there on 10/31/while I was at work doing a cleanup which I also stated in the original complaint and had to return when I had gotten home from workHe states I had agreed to a credit and I never did.He then talks about his *** certification which I did confirm through ***, his paper work that is supplied in the contract showed it expired in June which was actually renewed in Aug and went through Aug which again lapsedThey are in the process of renewing at this time according to ***He states that I am not paying them the remaining half because of their certification issue and it it is because of the damages they causedI also told them that payment in full would have been made upon completion of repairsHe states that I am just looking for a new deck when in fact the deck was just installed in September 2016.He questions my pool cover when it was just purchased in September He states that I made racially charged comments to get out of paying when I said in the original that I wanted to know if they were legally employedThey also stated to myself that payment had to made within days of completion otherwise *** would not honor the Weather stopper warranty without proof of payment in fullThis was a scare tactic as *** actually allows days to registerI am now in the process of having a roofing consultant look at the roof and contractors taking care of the damage that was created as part of the roof replacement that the Siding Guys will not take ownership of as stated in a phone conversation on 11/7/with Steve the controlling ownerHe said that he he had to fight me on the deck that he would just fight me on everything until it goes to court

I am rejecting this response because:I would like to start with why the building inspector had showed up here on 12/7/and it was not because The Siding Guys had called him for an inspection but because I had called the the Building department on 12/6/to inquire about being notified that they had pulled their permit in the amount of the job being only dollars when the job was really but you have to minus gutters which was because you do not need a permit for thatIn my opinion that shows how truthful this businesss isThe siding guys want to offer me which does not even cover the damages that were created to the deck while they were here working not to mention the siding or fence or pool patio for which I have submitted photos ofI am expecting the half that was paid and also the damagesThey also mention the warrentey is void for the labor for which I understand and I will have a new warrenty with the new roof that is being install at this timeI will not even go into the permit that he mentions because that does not involve myself. They Siding Guys say I am not willing to work with them but that is falseI am just not not wiiling to take a lose on this which is what they are asking me to do

*** *** called us to get an estimate for a reroof. After we got a proposal together and sent it to him, he asked to include replacement of a skylight and new gutters as well. We revised the proposal and sent him the updated one. *** *** entered into a contract with
us on October 18th, 2016. At this time, he was requesting a strip and reroof, replace old skylight, and new guttersPermit was pulled on October 26th, 2016. We began work on October 28th, 2016. After the work was completed, but before we had chance to do our final cleanup, when we asked for final payment *** *** began coming up with a long list of items, that were either damage, missing, or destroyed. In an effort to resolve this, *** *** spoke with owners and our office manager in order to address his concerns.Although we are not taking responsibility for the entire list, in an effort to resolve this matter we agreed that we would replace his pool cover, give a $credit, and complete our final cleanup. This all would have been done if *** *** did not state that he did not want us on his property or to return for cleanup. Even after *** *** made statements and accusations to the Revdex.com, the owners still wanted to work with *** *** to resolve the issue. *** *** agreed with one of owners to receive $towards the outstanding balance of over $8,500, new pool cover, and agreed to allow us back on site to finish up with the cleanup / touch upsThe following day, *** *** again tried to get out of paying his bill, by making the statement that we were not *** certified. Once again one of the owners provided him with our certification number, and the phone number for the regional manager for ***. We thought that this had resolved the issue and that payment would be received. However, the following day, *** *** stated that he would require over $4,700, in newly discovered damages to his deck. He then told us that he no intention of paying his balance and that he wanted a full refund. After that, he had stated he had had another competitor return to his house and that he would be removing all of our work, at our expense. At The Siding Guys, we take pride in our work and have never had issues to this degree with any of our customers. We would still be willing to work with *** ***, if he had reasonable expectations. It’s not fair that he feels he is entitled to over $18,of free work, and also a free deck. We also feel it’s disturbing as an equal opportunity employer, that *** *** can make some of the racial charged comments about the workers at his house and use it as a justification to get out of paying his bill. To show his unwillingness to want to truly settle this situation, we have multiple emails/texts/voicemails stating that we are more than willing to work with him on this matter. His biggest issue was that he felt that we were not *** certified and had concerns about his warranty. We provided *** *** with our *** certification number (which we also informed *** *** that he had the *** certification number on page of his contract), as well as the phone number for the regional territory manager for ***, and we also provided him with his *** warranty number so that he can confirm, that we are indeed certified and have fulfilled our contract by completing his roof and the warranty process.As an example of his unwillingness to work with us in coming to a resolution of said issues, please see below transcript of emails.**Please note that the emails start at the bottom of page and work up.... *** I'm not sure how even to respond to your last comment... It's never an intent to cause damage to a property we are working on, but unfortunately the wind was quite strong that day and some things were blown around. You keep saying damage to your property, however, scuff marks on your deck, a couple caps missing off a fence, a pool cover damaged (which we are replacing), and some granules in the lawn, is hardly the type of damage that you are talking about. In the course of installing such a large roof, (square), there unfortunately will be a few things that need to be cleaned up at the end, which I think we have demonstrated that we are more than willing to do. You told me yourself that you are just learning about roofs, and what it takes to install themWhen undertaking such a big job, there will be small things that might need to be cleaned up at the end. However, these minor touch ups, don't warrant you holding back a payment of $8,500, especially when we have more than demonstrated our intent to take care of said issues. I understand your frustration in your effort to make sure that we take care of things on our end, but you making the type of statements that you just did, keeps showing me, your unwillingness to work with us to come to a resolutionWe are, by no means, trying to give you a hard time about taking care of said issues. I am rejecting this response because:The Siding guys continue to makeup excuses for the reason I have not paid the remaining balace including their [redacted] certification and the ethnicity of the gentlmen doing the work. When in fact it is one reason and one reason only. The damage that they created in the process of installing a new roof at my residence. When on the 11/8/16 responce page 2 of 5 he ackknowledges that I am holding back the remainder because of the said issues and then again on page 3 of 5  dated Nov 2, 2016 he mentions it also. Then on page 3 of 5 dated 11/2/16 I tell him not until all repairs are made will they recieve the balance. The Siding Guys also continue to say that I have said that the gentlemen doing the work are working illegally in the US because of their ethnicity when the fact is I have only mentioned working legally as on their payroll. You can look at any of my responces and see  that I have never mentioned what they say I have. As far as as their [redacted] certifiction you can contact [redacted] directly and confirm what I have stated as far as their lapses in certification. When I suggest calling [redacted] directly I am not talking about the local rep they had me talk to as they mention. With [redacted] the way it work's from what I was told directly from [redacted] as far as the warrentey goes and certification as long as the renew their certification within a certain amount of time that [redacted] would still cover the roofs the Siding Guys did while not certified. At this time their is no resolving this issue without the use of the legal system as The Siding Guys have made excuses for non paymeant on my part and minimized the damage they created while on my property. My roofing consulant has completed his observation with a report and the roof will be replaced as their is no just fixing it. My deck will be repaired as their claims of just scuff marks in composite deck boards 20 feet in length that cannot just be pieced together and must be totally replaced because of the shingles hitting it and being walked on, door's on the deck to the house scratched from shingles hitting them,plastic railings that are scratched,  the pool area cement stained with tar from the shingles that  being torn off were landing on it, broken siding from their ladders that were fallng hitting the house, a down spout for the gutters being eliminated without asking me will be reinstalled and where the down spout was removed they used white caulk on a gray house where the screw holes were. Shingle material inside my brand new air conditiong, coil on the side of the house dented from ladder leaningon it, I have pictures of all said damages as I showed the owner Steve when he was at my house.
