Initial Business Response /* (1000, 5, 2015/05/05) */
Skyway Theatre was rented by a concert promotions company for a Mos Def concert on April 4, 2015. The artist told the concert promotions company that he wasn't able to perform on the contracted for date and the promoter was forced to...

reschedule the concert for April 25, 2015. To assist the promoter and contact people who purchased tickets through our website, we sent out an email on March 23, 2015 to every person who purchased tickets from our website and offered a refund to anyone who contacted us. We did refunds through our website to people who bought tickets through our website. In addition to the direct contact, our venue posted the date change on our ticketing site, facebook page and website to try and reach anyone else who was interested in the concert so they were aware of the new date.
The complaint in question is in regards to a ticket that was purchased at Electric Fetus, a retail store. We have no record or knowledge of these tickets sold, as the funds go from Electric Fetus to the promoter. Skyway Theatre does not account for, pass through or otherwise handle the funds that go from Electric Fetus to the promoter. We have no access to the funds or to a record that the individual bought the ticket.
On April 27th, two days after the concert, Skyway Theatre received a call from Mr. [redacted] in regards to the refunding of his ticket. After discussing with him the circumstance, we informed him that we did not handle that ticket sale and did not process the money or have any record of it.In order to help Mr. [redacted], we took his name and number and contacted the promoter with his information, so the promoter could give him a refund. We contacted the promoter on the morning of Monday, April 27th by email in regards to Mr. [redacted] buying his ticket at Electric Fetus, and included Mr. [redacted]'s contact information so the promoter could contact him. The promoter (who is the one who made the profit from the ticket sales and had all ticket sale proceeds) emailed Mr. [redacted] on the afternoon of April 27th and included his address and phone number, with an offer for a ticket refund. I have attached a copy of that email, which was sent to Mr. [redacted] and copied to Skyway Theatre. I have attached the email below.
As a venue which hosts numerous concerts, people sometimes believe that Skyway Theatre is the "promoter" of every event and has control over all ticket sales. However in the case of the Mos Def concert, the promoter rented the venue for the night to throw a concert. As such, Skyway Theatre was merely the location that they rented to throw the cobncert, however the profits from the concert go to the promoter and the artist. Skyway Theatre acted in good faith to assist Mr. [redacted] in getting his refund, however when we asked him if he had contacted Electric Fetus (where he purchased the tickets) he said he had not. We tried to explain that we didn't have his money and didn't handle it or process it in any way. Further, when he called our offices we assisted him as much as was possible. However Skyway Theatre cannot be held responsible for refunding for a ticket that wasn't purchased on our website or from our box office, as we have no record of his purchase, nor do we have the funds to be refunded. Skyway Theatre was satisfied with the quick response from the promoter, who offered a refund immediately and as noted, included his name and contact information so Mr. [redacted] could contact him and receive his refund.
