We received the complaint information regarding [redacted] and his tenancy at [redacted] We found a few inaccuracies in SSG [redacted] letter1) Mr [redacted] states that the unauthorized pet was at [redacted] for a weekSurprisingly, we found numerous chew toys, gnawed soup bones and 30-piles of dog excrement in the small back yardTwenty or more children's toys were chewed into pieces, the lawn furniture was destroyed, the handles on the ice chest were chewed off, a regulation-sized football had canine punctures, "kiddie" swimming pools were chewed on and there were piles of dog and cat hair throughout the home2) In addition to the dog, the [redacted] had an unauthorized cat as wellMr [redacted] claims that the cat was a stray and had jumped in through a windowWe found cat excrement throughout the home and a cat-urine stench in all the carpetsAfter a week of checking on the home, we noticed that the cat had been locked up in the home with a small bowl of food and waterThere was a tremendous amount of rubbish left in the home and the cat was hiding amongst the piles, eating its own excrement and finding water where it couldWe trapped the cat and turned the animal over to city servicesWe also found two fully used cat litter boxes, two bags of cat treats, a box of new cat litter and a cat scratching toyWe don't believe that stray cats travel with their own litter boxes3) Mr [redacted] claims that we did not repair the roofWe didSame day we found the dog4) SSG [redacted] 1s` SGT call was returned same dayHe called onceMaybe twice.5) Folkerson Property Management, Ltd does not historically complete rental reference checks for other rental agenciesThe potential for liability is too greatBut if we did provide that service, what would we say? "Unauthorized dog destroyed back yard and parts of homeUnauthorized cat destroyed carpetsBags of rotting food left in kitchen, garbage strewn throughout home.....?" 6) Finally, the Texas Apartment Lease that the [redacted] signed governs future communicationAnd, Mr [redacted] statement that the rent check was left on an office floor for two weeks is a complete fabricationThe rent check was held pending potential legal action for evictionOnce possession of the home was transferred, we deposited the check for rent owedMr [redacted] mentioned prominently and several times that he was deployed and in a combat zoneWe have tremendous respect for the military, we are a product of the military, and have served many military owners and tenants in our years of businessBut, we have a lot of respect for others who quietly give grace, compassion and dedication to others in their service of work or personal livesWe have respect for the New Mexico state trooper that patrols miles of desolation with no immediate back-up, the priest that convinced first responders to lift a wrecked truck high enough so that he could climb under and administer Last Rites to a dying driver and an executive for a U.SCongressman that scours area nursing homes on her own time in search of veterans that need help with benefitsWe respect a lot of people, Mr [redacted] Damages to [redacted] were not an accidentLease violations were not beyond your controlThe owner of this property deserved betterItemized security deposit dispersal that was sent to you will show the way forward

We received the complaint from [redacted] regarding his security deposit refund for [redacted] 'We responded to [redacted] 's concerns a month ago and portions dons of that response are applicable to [redacted] 's current complaintsWe reviewed [redacted] 's six concerns regarding the security deposit for [redacted] — cleaning, services performed, activity at the home, age, air filiters, another walk-through - and have audited the file, carefullyWe endeavored to answer his questions thoughtfully and complete Cleaning—We found multiple items that needed cleaning or further effort and some of these areas were pointed out to [redacted] on the checkout In particular, some of the outside windows needed to be cleaned; some switches and light plates need to be cleaned; multiple scratches and gouges on walls, baseboards, and door frames; cobwebs in corners of ceilings and walls, food splatters on baseboards and cabinets in kitchen area; food caked and rusted drip pans; dirty oven, grease and debris behind the oven; grease on adjoining cabinets to oven; noodles and sauces on the side of the oven; calcium deposits on kitchen sink, calcium deposits and stains inside stainless-steel dishwasher; food and debris splatters on island kitchen cabinets; tops of ceiling fan blades and motors dusty; calcium deposits on plumbing fixtures; urine stains at base of commodes; heavily-stained toilet seats; marks on walls throughout the home and both master shower and hall tub need extensive cleaning of soap sm and calcium buildup [redacted] opted to not clean the home and turned in the house keys with two months remaining on the lease

the military, we were surrounded by men and women of integrity, loyalty to country, belief in God and pillars of family life - heroesAnd although it happens from time-to-time, it is always a shock when a military member cavalierly breaks a lease; especially when it is an officerWe have just never gotten used to that. *** and *** *** *** rented *** *** ***, *** *** for one yearAt the end of that year, the *** signed a renewal to the lease for another yearShortly after signing the lease renewal, the *** put purchase money deposit down on another home and apparently executed a sales contract*** *** cites barking dogs, anxiety, and not her initial intentionNone of this is in dispute. What is in dispute are complaints that information that can be found in the lease and addendums was only transmitted verballyThe lease clearly covers what happens when a tenant breaks their lease. The *** claim we did not respond to request for a checkoutWe e-mailed both *** and *** a Friday noon appointmentWhen we did not hear back for a conformation, we mailed the printed e-mail chain to their new addressRegretfully, the *** had moved out of *** *** ***, *** *** and in with a friend in Copperas Cove and the address they gave as a forwarding address was the home they had not purchased, yet.The *** claim that we were not trying to lease the homeCareful documentation of calls and e-mails prove otherwiseAnd, as we had rented another large home in *** ***, all candidates and more were referred to the *** property.The *** tenants prior to the *** also purchased a home during their first year of tenancyThey turned in proper notice, scheduled a checkout in writing, met us at the home and handed over the keysAnd, the combat infantry veteran provided receipts and poof that the home was ready for transfer back to the management company- in a little better shape.We have a contract pending on *** *** *** and truly hope this will lead to the conclusion of our business with *** and *** ***Sincerely,*** *** *** *** ***

I am rejecting this response because:we never received an email from [redacted]. In fact, he never responded to our emails. It is very easy to hit reply and print screen and then state you sent the email when in fact you really didn't. [redacted] never responded to our emails. In fact he only emails us when it pertains to him. I will send his emails and all the dates I received from him when I get back in country and get back to my emails. I am out of country and working solely with limited WIFI. He sent us a email approximately two weeks ago asking us to remove our lawn mower from the garage because of the new tenant. We were surprised a tenant was even pending because he never called any of my prospective tenants back nor responded to my previous email referencing those tenants. I will send copies of those messages from all those prospective tenants who kept writing me to tell me not only was he ever in the office but he was never calling them or emailing them back. They even sent messages through [redacted]s website since the house does not state pending on his website. However, he still never responded. When I emailed him about this as his job is to find a tenant in a reasonable amount of time, he never replied to me either. He also sent us an email two weeks ago telling us maintenance crew couldn't get into the home because the keyless lock was locked in which I simply replied we didn't have access to that lock either. If the maintenance people couldn't get in to a keyless lock and [redacted] can't get into a keyless lock, how could we? Just another excuse for delaying the amount of time it takes him to get his house prepared. Yes we did try setting up a close out. In fact, I will send several emails regarding that and several phone calls to him. Yet he send this fictitious print out of something he supposedly sent? My lawyer is able to make that same email as well as anyone else. Let's see if [redacted] can show his computer and the date it was sent to my lawyer. Because I can show my lawyer my computer and email and everything I have from [redacted]. yes we were living with people in Copperas Cove. That is a correct statement. The closing date was pushed back for various reasons and we were already moved out of the [redacted] home. That was out of our control. There were many factors which I emailed [redacted] why I was moving out. I initially thought I would be stationed in Texas for two years (due to my assignment) however after I signed the lease and went to training with the Military I found out I would not get a replacement for three-four years. I thought I could suck up all them obnoxious dogs next door for one more year but when I found out I was gonna be there longer I decided I would just retire out of Texas and get my own home away from everyone and not deal with all them dogs. I know normally Military tours are typically three years but I was on a special assignment only being two years. But since their are no other candidates that have finished school, I will be in Texas longer than anticipated. Our home is still listed on his site as active with no pending tenant as he states. If this were true, then why would it not state pending as all his other homes state this too. I have two other co-workers that have had the same problem with [redacted] and their homes are still not rented out. Interesting all these complaints about his company and he blames the tenant all the time. I did my part. I even told him I would do my part till he finds a tenant. We mowed the grass, trimmed the bushes, cleaned the home frequently, sprayed.. despite moving out. Until he told us two weeks ago that we had to remove our stuff not allowing us anymore to take over the care of the home as his team prepares for the  new tenant. Hopefully, he doesn't send me a bill for his preparation or not doing those things anymore since I have the email of him telling me to remove it all. We are even paying rent still. So we are doing our part yet no communication from him. I had several renters with excellent credit, no animals, etc that have been trying to contact him and wanted to move in last week yet he never emails, or calls them back. I will send that info when I get back into country in another two weeks. This is just ridiculous. How long does he have a potential candidate for renting the home? It's been two weeks. His company does a background and credit check within 24 hours and lets you know right away and you sign a lease. Once you sign the lease you are a tenant not a potential tenant anymore. I have coworkers who used [redacted] and they had the same problems. [redacted] never did the walk through and never sent a response. Communication is everything!!! It's been two weeks since he emailed us. So does he have a tenant or does he not? Why has he not communicated with us? Or called any potential tenants back? If you are actively seeking a renter then you should be responding to them. He is not even doing the simple things he should be doing.

Our records indicate that the [redacted] family rented the Amarillo home more than two years ago, has been sent the final  itemized security accounting by both Folkerson Property Management, Ltd. In multiple timely fashions, and by the collection agency. We have sent more than eight notices to the [redacted] family both regular mail, delivery confirmation and signed by Mr. [redacted]. Damages to [redacted] Killeen by the [redacted] family are not at issue. The home needed to be cleaned, filters needed to be changed, carpets were heavily soaked with pet urine and marked with feces stains. We believe the charges to be accurate, fair and should be paid.
