Mr [redacted] came down to, Atkinson Truck Sales, lnc, on April 6,to look for a Tr¡-Axle DumpTruckAfter selecting one, We came into my office to discussWe agreed on pricing and work to bedoneI asked Mr [redacted] for a deposit so we could start on getting the Truck ready for him ( [redacted] ).He asked me if the deposit was refundable, I told him noMr [redacted] then stated that he would notleave one until he got his financing approvedI was understanding of thatSo he left and went back to [redacted] On April 10, 2015, he got the approval and was good with the termsI emailed him theBuyer's order and Wiring Information on the 13th of AprilMr [redacted] received the email and wired usthe deposit on the 15th of AprilWe started getting the Truck ready for him to pick up that Saturday(18th)After several weeks of him not picking up the TruckMr [redacted] called and asked if I knew ofany insurance companiesHe was having a hard time finding insurance that was affordable to himHeasked several times to give him more time to work on this, and we didAfter not getting insurance in hisprice range, he told me that he was not going to be able to get the TruckHe asked if deposit would bereturnedI told him that it would not[redacted]
I have reviewed the response offer made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below.When I went to the lot, I was shown a truck that the salesman guaranteed he could get me approved forBefore an approval came, the salesman (***) asked for a depositI said I would wait for the approvalI did not get approved for the truck, that's why I left the location without leaving a depositThe salesman called me a few days later informing me there was another truck that had just came in that I could get approved for based on the price of the truck and the dealership doing no additional work to the truckI never asked them or told them to do any additional workI was informed by the salesman that in order for them to sell the truck as a dealer there were a few things they had to do to pass VA inspectionThat was not work or repairs I requested, but whatever they were required to do to sell the truck as a dealerI was not informed that my deposit was nonrefundableI did not sign anything that stated my deposit was nonrefundableWhen I called the salesman to request a refund of my deposit, he stated that he needed to get the authorization from his managerHe never said my deposit was nonrefundableI called and spoke to Mr***, he never stated my deposit was nonrefundableMr [redacted] stated that he needed to check my information and call me backMr [redacted] never returned the call to give any information regarding my depositAll I'm asking for is the return of my deposit Regards, [redacted]
[redacted] said consumer came into the shop and wanted to buy a truck He was told if they did all the stuff to the truck he wanted the deposit would be non-refundable He left saying he had to get his affairs in order A few weeks later he wired the deposit, work was done to the truck, then he decided later he no longer wanted the truck
