The Terrace did not provide the services agreed to in the lease agreement. They also neglected our mom and made multiple medication errors.
Our mom is in the beginning stages of dementia so we needed to find an assisted living facility to help us provide the care that she requires. We chose The Terrace at Mountain Creek and moved out mother in on 2/1/19. We were at the facility on nearly a daily basis to try to work out the constant problems that kept coming up. We went above and beyond what any reasonable person should do to try to avoid moving our mother again. Obviously moving her is incredibly stressful for her so we did everything we could to avoid that. Unfortunately, it became absolutely necessary once her safety was at risk and we moved her out after just 4 months. In our lease agreement The Terrace was supposed to provide weekly linen service, housekeeping, a Plan of Care, provide maintenance in the apartment, family care conferences and personal hygiene prompts among other things and NONE of these things were provided. We were also supposed to pay an additional $400/mo for medication administration. The medication was given at all times of the day. Sometimes morning meds were not given until 2:30pm! On one occassion she was offered medication for a second time in the same day. My mother was staying with me and they had given her pills to me so that I could give them to her while she stayed at my house. The day I brought her back I had already given her her evening dose of medications but they tried to give her a second dose. Her medication was clearly marked in individually dated packets that come directly from the pharmacy. There was not a second package in their med cart that evening so I don't know who's medication they offered to her and they don't know either. Thankfully she refused the meds and was ok. According to the medication administration reports, in the month of April and May she did not receive more than 200 pills that were supposed to be given. No one can tell me why. On another occasion she was supposed to discontinue a certain medication because it was causing her heart rate to drop too low. Instead of discontinuing that med they continued to give it to her and mistakenly discontinued a different medication! They are losing residents at an alarming rate right now. They cannot keep aides or nurses on staff. I have talked to 2 other family members who have had loved ones sent to the hospital in the last 30 days due to medication errors or neglect. One lady is still in rehab after 2 weeks. Her daughter is not going to bring her back. The other gentleman is not doing well at all since his medication errors and is still being evaluated to determine what long term affects he may suffer. Since they are so short handed many, many residents go 5 days or longer without showers. Medications wind up missing. They have run our of cups in the dining room recently and served iced tea in a bowl to a stroke patient who only has use of one arm! Dirty linens and soiled briefs are left on the floors and on the beds regularly. The place smells like urine. *** are investigating them currently regarding my mothers case and a suicide that took place back on March 1, 2019. They should be shut down. I have requested a refund of the community fee that we paid and the rent since they breached the contract but no one will respond to me at all.

Desired Outcome

I would like to request a full refund of the community fee and the lease payments for the months that my mother lived at the terrace for the neglect she suffered and the agreed upon services she did not receive.

10/7/19 I got an email from the executive director on 9/11/19 saying he was willing to speak to me. I have tried repeatedly to reach him for a discussion with no response. I have called his cell phone multiple times to try to get him and his voice mail was full so I could not leave a message. Then I emailed him to let him know I was trying to contact him with no response. I texted him with no response. I also called The Terrace twice. The first time the receptionist said he was not available. The second time I was told he was very busy dealing with the health department and all the problems in the building so he could not speak at that moment but would return my call. That was two weeks ago. I don't believe he has any intention of responding. I am not planning to call again.
