Mr. and Mrs. [redacted] had a job completed by The Tradesmen on January 22, 2015.  On the work order that was signed by them, it states "Homeowner agrees to provide all necessary permits for the following work at homeowners expense.  Contract price does not include the...

permit."  Permits for awnings are on a park by park basis. It is the homeowners responsibility to check with their management and provide all necessary permits needed.  We recently bought The Tradesmen, Inc. and received a call from the [redacted]'s late September 2017 explaining their problem.  We purchased the database from the company, the warranties for previous work were not inherited, however a representative from our company was sent out to see what needed to be done and wrote a work order for the needed corrections.  The license number is the same on the new work order due to the transition period of changing all forms from the purchase.  The corrections were made and the balance is due.  Our company should not be shorted and the homeowner should not get a free job due to their own neglect of not providing a permit.   [redacted] Barttels

I am rejecting this response because:Lack of communication from their Agent  [redacted]  on 1-2015 not advising us of permit responsibility. Constructing awning over property line by 2 feet. Not asking Park management where property line is. Park Management having 3 yearly inspections and NEVER advising us the awning was in violation of property line and permit. Being served a 60 day eviction notice from Property Management's Attorney [redacted] causing us  trauma for something we were not advised of. Inspection violation letter dated  6-23-2017 sent to Park Management by [redacted], SD County Environmental Health Specialist.  It never received by us until 9-15-17. We believe it was responsibility of both contractor and park management to advise us what steps needed to be taken to avoid this situation at present. We feel the Park Management is liable for lack of documentation in a proper manner from County Inspector  and contractor is liable for lack of advisement to homeowner in policy and procedures to obtain permit. County Building Permits advised me the cost was $195.00. Contractors advised me they would file permits for me stating they were too complicated. The cost was $495.00 and never expressed reasoning for excessive cost.  After payment of permit an unknown person believed to be the owner, advised me he was not sure the reconstruction of awning could be done at all after the $495.00 payment making me have a worthless permit. This same person advised me around 2 days after this conversation he would get back to me and get a ruling on this.Awning was finally completed 11-14-17. Two weeks later [redacted]  phone call on 11-29-17 informs us she would deduct the balance of $1350.00 from debit card on file if we did not call back that day. This is a reprehensible act on her part and lacking in professionalism and class. SDCCU was advised of this and blocked card at my request. I am advising my attorney [redacted]  of all communications and responses and will forward  copy of  this response to him. Having a 60 day eviction notice  for an awning permit  violation, where we have been living there since 2000 has caused severe trauma for my family. The eviction notice was stopped but the scars of this remain. From our perspective we feel violated.
