I have reviewed the response offer made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below first off I actuall Don't have a clue what they are talking about as saying I was driving and the tow truck passed me [redacted] called me asking where the car was,that the guy was sitting in front of my house to pick up the carThat was a lie, I told her I was getting belongings from the car, actually made a point of having witnesses to see and hear that,as well as neighbor'sThey also witnessed every conversation with this company,and as far as not making paymentsI never said that I didn't have any moneyI told them that I wasn't going to pay any more until they agreed to fix the vehicleI have made points to have all conversations in front of witnesses and on speaker phoneThere is no heat ac at times no power at all not even ER flashersActually an employee actually helped us move the vehicle once out of the middle of the street after completely dieing at a busy intersection after stopping at a red lightAs of September 3rdThat was my first payment dueAlsoTaxes were not paid because I actually have the bill for them that came in on the 15the of August

Ms [redacted] purchased a Chevrolet Malibu dr Sdn on 2/25/from America Auto Sales IncAt the time of sale it was explained to the customer that this vehicle had previouly had a short in the cluster which is a common problem among Malibu's of this year, make and modelThe instrument cluster has been replaced and becuase of that the mileage reading 125,was NOT ACTUALMaking the odometer N/A ExemptAt the time of sale on 2/25/an odometer disclosure statement was signed by the acting sales manager and the purchaser, as well as a buyers guide stating the discrepancyat the time of sale the customer was made aware of the discrepancy of the mileage on the above mentioned vehicleAmerica Auto Sales Incand it's employee acted within the bounds of disclosure to the customer at the time of saleAmerica Auto Sales Inc and it's employee's take pride in the fact that we conduct our business in a fair and honest manner.Any Further questions or concerns please reach out to me at [redacted] [redacted] [redacted] Thank you, [redacted]

America auto did not know the miles on this vehicle as the odometer was shorted out as occurs commonly on this make and model vehicle, we did not know actual millage or speculate/guess at what millage was on vehicleWe rarely ever have any vehicle with any mile discrepancy but this one was still very nice so we offered is for very fair price Which would be why we informed you of this and had you sign not only or documents, but a total of documents stating that we do not know milesThe problem is you totaled the vehicle wia couple weeks of purchasing and want America auto to give you another car at no cost or your money backYou have not mentioned America auto is losing thousands of dollars on this contract because you didn't carry gap insurance and that we are not pursuing you for the remainderBut with respect it does take more than manipulating facts, and creating a Revdex.com complaint to try to force one of our companies to give you your down payment back on a vehicle you've totaledYour proposed offer does not make sense to me, when everything was explained perfectly to you and you were happy until you totaled vehicle when truth is, you did not have gap insurance and insurance would not have given you any money back if the vehicle only had 1,actual miles on itThis was a good, dependable vehicle that you were happy with it until you wreaked iti suppose it would be a great resolution for you to total a car, cost the dealership thousands, the dealership not pursuing you for remainder of contract, and requesting your down payment backWe are sorry and truly appreciated your business, but the resolution we are offering is to simply take the loss on the thousands your insurance is not gonna pay

The company's response to your post is as follows: America Auto is not in the business of scamming people out of dollarsthis complaint is filled with so many lies I don't honestly know where to start but i'll try to summarizeMs*** bought the vehicle and never paid a dime towards her tags, or her first payment, which is when we became concernedHer first set of lies was the vehicle is not able to be driven due to bad clutch and bumper issueWhich we knew was odd because we put a brand new clutch before the vehicle was sold as well is this is a year old vehicle with around 75,miles and in great shapeBut then after missing her tag payment date, and her actual payment date, she followed that up with not showing up to the garage for the appointment to fix any concern on vehicle for free and quit answering her phoneFinally we were able to reach her and she said she didn't have money for payment, tags or anything as well as she could not bring the vehicle to us to repair, so we sent a tow truck to pick up the vehicle, and when the tow truck arrives, she passed him leaving the house in the vehicleSo again more concerns with this accountThe vehicle is in my possession, and is sitting in the same spot it's been in since arrived and was looked overThe vehicle has no clutch issue, has no bumper issue, has no electrical issue and frankly i'm getting a Revdex.com complaint because the customer still owes her title, tax and tags, her first and now her second payment is due or about to be, and as she stated she has nothing to even pay toward it, as well as her insurance canceled while she was still drivingSo to summarizedidn't pay title tax tags, didn't pay payment, missed appointment for us to look at and fix concerns at no charge, canceled insurance while still driving as witnessed from tow company, then calls after all of this and says she's ready to pick up vehicle?!? Respectfully we are very grateful for our customers, but this complaint has no grounds beyond almost anything i've come in contact with

For your reference, details of the offer I reviewed appear I *** ***, reject this resolution because your seller *** *** told me that the mileage was off by 5-miles when progressive investigated and reported to me the car had 191,milesShe should not have lied to me as a customer regardless of thisThat is not good business and I'm not sure why you as an owner as standing by her when it's clearly a significant differenceUnderstand I would not have purchased a used car with that many miles when I have children and I do not appreciate the fact she did not explain that to me just because you guys wanted to sell the carYou have to have known the actual mileage and that should have been explained when the sale was madeMy insurance company even said that it did not make senseI pray we get this resolved so that you have satisfied customers who come backBeing honest to customer should be a priority not just getting moneyPlus the whole time she was very agitated and rushing through the paperworkAlso if the paperwork stated not actual then she should never had stated it was 5-miles offThank you

Good day,I wanted to get back to the Revdex.com as to what has transpired since you all had to dropped your investigationdue to no reply back from The Good Feet Store of Gilbert, AZI had contacted a local news investigationteam about this issue (about two weeks ago)I didn't hear back from them however
when I contacted The Good Feet Store Corporate Headquarters in California I mention this to themThey contacted the ownerof that franchise and I was informed to take my Gift card (in store credit only) back to the store and theywould credit my charge cardSuccessful use of patience and name dropping wins outIn my opinionthey still deserve your rating for not communicating back with you.Steve P***

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me.  As long as I don't have to be responsible for the remaining balance on this vehicle then I will accept the business resolution to resolve this issue. I will wait for the business to perform this action and, if it does, will consider this complaint resolved.Thank you.
