I Placed an order a month ago and it has not been shipped. I have tried to contact the company to no avail. I M Survival is a third party seller on Amazon.com. I purchased the pants from them, via Amazons website on August 5. When I received the pants, I tried them on and they did not fit. So I bought an envelope and postage to ship them back. The pants were in brand-new, unused condition. The postage totaled $7.68, I paid this amount in addition to the purchase price of the pants. When I M Survival received the returned item, they refunded my credit card $21.77. When I sent an email inquiring about the remaining $18.22, I received the following reply, Return policy and fees are clearly stated and apply to all returns. Not only can I not find their return policy, they did not provide it to me. When I inquired further with I M Survival, the replied, stop harassing us.Attempts I made to resolve this dispute through Amazon has proven futile. They claim that I received what I ordered and if I returned it, being charged a restocking fee is reasonable. I am contending that an $18.22 fee for returning a brand-new item is completely unreasonable.Product_Or_Service: Lightweight Tactical PantsDesired Settlementrefund my $18.22Business Response /[redacted]/In accordance with fees charged, packing and shipping costs, fulfillment, inventory control, taxes, loss of value, and the inability to resell returned items as new, we have a standard return policy on all items sold on Amazon to cover these standard expenses. This policy which is located under our return policy on Amazon and clearly states buyers are responsible for any return shipping fees and the actual shipping cost of items that were sent to them as well as a 35% restocking fee as long as the item is returned in a condition that can be resold with all tags and packaging. This customer bought a pair of pants, determined they were the wrong size for him and requested a return. He was given the return authorization with the return policy and he sent them back. Upon receipt we inspected the condition, determined he met the criteria for an acceptable returned now like new item, and issued a refund immediately to him minus the stated fees in the return policy. Our company stands behind the products we sell and are happy to accept returns when needed. Our policy was put in place to limit losses and has served us well for years without issue or complaints. It is unfortunate the customer feels that he does not have to follow an agreed to stated return policy and after numerous derogatory comments and threats from the customer we decided to stop further communication. During these communications the customer escalated and opened an A-Z claim case to Amazon and demanded a full refund. Amazon returned with the results of their findings on this case and backed our policy and denied his claim. The case was closed and awarded in our favor. With this result, the customer has now contacted the Revdex.com as he said he would in his harassment and threats communicated through Amazon's internal email system and is attempting to cause malicious harm to our company and threaten a US Veteran.Actual excerpt from Amazon email communication with customer after he become fully unhinged-From us sent to customer- "Please stop harassing us with your derogatory comments and threats."Response from customer - "I haven't even begun yet. Refund my $18.22 immediately."Customer feedback left - Negative 1/5:"BUYER BEWARE!!! This crook will take your money if you return anything to him. Unfortunately we see the customer is continuing to harass us as he stated he would.We are satisfied with our policy and that the customer was refunded exactly what they were owed from the transaction. We also look forward to this complaint being closed following Amazon's lead finding no fault in our policy or actions.Consumer Response /[redacted]/Triangle Touch of Class has a completely unreasonable return/refund policy, a 35% restocking fee for a returned item in brand-new condition with the tags still attached is an outrage. I returned the item at my own cost, $7.68 for US mail, plus materials. It is HIS cost of doing business, not mine. He should stop pushing all risk and cost onto his customers.Contrary to his response, my behavior/conduct/emails have ABSOLUTELY NOTHING to do with the unreason ability of his "restocking fee." I am outraged that he would steal $18.22 from me for trying on a pair of pants from his store and basically returning them to his shelf. I have every right to vocalize my displeasure, complain to whomever I feel necessary, and leave all the negative reviews that I wish. His veteran status is entirely irrelevant to anything related to this matter.If he chooses to continue to do business in a way that alienates all of his customers, he will no longer have any. Final Business Response /[redacted]/We are sorry if you do not feel that you have to adhere to a policy that you legally agreed to. As stated the policy is there for good reason. How you feel about that policy is your choice and doesn't affect that it is enforced. If you want to continue to cross over into liable we may need to legally address that with anymore continued harassment from you. "anymore continued harassment"? Is he referring to my Revdex.com complaint as continued harassment? Let the record show that anyone voicing a complaint about his unreasonable return policy, will be threatened with legal action. Apparently he thinks it is harassment to have a problem with the way he does business.There is no valid reason that He took $18.22 from me for a pair of pants I paid to ship back to him, and he can now sell them as new. Having a "policy" does not equate to reason-ability.It is curious that his return policy on his website states there is a 15% restocking fee, but for Amazon.com purchases there is a 35% restocking fee.
