to whom it may concern, We are a used car dealership and everything is being sold AS IS NO WARRANTY unless the customer purchase "EXTENDED WARRANTY" in this case the customer DID NOT purchase extended warrantyWhen the Car was sold it was in good working condition and it did not need anything, other wise we will not been able to pass SMOG with the carOil Change and anything the car needed a month or months later is the customer responsibility and we have a signed form signed by the customer stating" CUSTOMER RESPONSIBLE FOR ANY MAITENANCE ON THE CAR AFTER PURCHASE" weather its oil changes, battery spark plugs, coils and any other servicesIts a used car and any car used or new needs regular maintenanceRECALLS ARE DONE FOR FREE AT any BMW Dealership the customer can schedule to get it done directly with BMWThe Car Was running fine and it did not have any codes in the system at the time of purchaseAGAIN CAR WAS SOLD AS IS and customer signed that they understandDEALERS ARE NOT ALOWED TO WORK ON SOLD CARS AFTER SALE PER CALIFORNIA LAW

Hello ***, we collected $for transfer and registration & Sales tax to send to Nevada DMV Which we already mailed out to Nevada DMV along with the vehicle titlewe gave you Temporary registration that is valid for days from the date you purchased the vehiclethis temporary registration
has nothing to do with Nevada DMV this is issued by California DMVWe told you that we are taking care of the transfer and you will receive the registration within the daysyou were not supposed to do anything other than doing vin verification & smog, but you have decided to pay registration without having the title, which I don't even know how they allowed you to do itwhat you did put a wrench in this process and complicated thingsrecently we received the original package with a letter from dmv requesting a copy of the contract which we re-mailed out to them and we are waiting on them to respond back to you or to usas of now there is nothing we can do other than waiting for Nevada dmv to finish the processif they send us the registration money back we will then mail the refund back to youI cant refund anything now to you, there is a process that we have to go through because we are a licensed vehicle dealer by the state

Hello, We did not say there is a new battery in the car and we will never say that unless we put in a new battery our selfWhen you asked we said that the car has a NEWER battery, regardless that has nothing to do with the problems your having because when we sold the car it was working properly therefore it passed smogThe problems you're having after purchase are your responsibilitycar was purchased AS IS (SEE ATTACHED PROOF)you took the car to or mechanics and each told you a different story because non of them are qualified mechanics and I believe non of them is an actual licensed mechanicPETER is not a mechanic, he does side mechanic jobs for extra moneyThe car does not need to have an original BMW battery to run, as long as the battery meets the right specifications it will work properly, otherwise O'reilly, Autozone, Napa Auto Parts and other stores won't be able to sell batteriesSEE ATTACHED AS IS SIGNED AND AWCKNOLEDGED FORMSThank youAgain, We are not allowed by California Law to do any work on cars we sold

I have reviewed the response made by the business in reference to my concern, and find that this resolution is satisfactory to me. I however feel that the business is not being fair by trying to say that it is my fault that things have gone this way. The dealer rep [redacted] stated to me on 12-18-16 that he would send me a copy of the check that was sent out. He did not so that was another negligent act on his/dealerships part that added to all of this dishonest feelings/perception that I had of them. My feelings of dishonesty regarding this business are lessened as they have finally done what they should have from the start which was send me all the written docs regarding the transaction. But no you decided to be lazy,negligent, and arrogant towards me and my request so that is still my perception of this business and will let the public know on the internet because what they did was not how a transaction of this size should have been handled. Only after I have gone through the trouble of seeking a third party mediation have you decided to act swiftly. If this was a ebay purchase over the net for a couple hundred dollars I would not have even gone this route but this was an in person $20,000.00 transaction that was made. The consumer should have been respected a lot more. Public deserves to hear/see this complaint.

Consumer states: I was told that I was receiving a new battery when I got my car. It is not working and I believe I should get a new battery.

Mr. [redacted],You are creating a problem for no reason, in regards to this whole process because you are refusing to understand the process. In the form you signed we clearly wrote for you to do smog and Vin verification and we said we will mail out the documents to DMV. The person you spoke to at Nevada DMV doesn't seem like they know how the process work because they work only with private transfers not dealer transfers. I don't know where your coming with all of these dishonesty, this is a process that the paperwork have to go through. these transfers take time and for that exact reason we gave you a 90 day temporary registration issued by CA DMV. We are licensed by DEALER by CA DMV and have to do things according to DMV process and not your way of doing business. There is lienholder on your vehicle which require us to do the transfer to secure our lien holders interest. We tried reaching out to you today but you did not answer the phone. We wanted to re-explain the process and update you on a letter than we received in the mail today. we have attached the letters between us and Nevada DMV. if you don't understand you can always call us to go over them.Due to you paying for registration to DMV, they returned our check today with the letters attached dated DEC 22nd. was received today. We have adjusted the new amount and mailed out a new check and mailed out to you the difference of $463.75I have also attached the letter we received before this last one asking for copy of the contract dated 12/6the reason the paperwork was not mailed out sooner because DEALERS don't always have the title for vehicles because it takes time to be received from DMV or previous lien holders. Therefore, when CA DEALERS sell the vehicles we issue 90 day Temporary registration to cover any waiting periods in between. We were very honest with you and did not do anything wrong, you just got confused by the process and by the person who gave you the wrong information at your local DMV. PLEASE JUST WAIT AND DO NOT CONTACT DMV UNLESS THEY CALL YOU ABOUT THE PACKAGE WE SENT THEM. BECAUSE IM AFFRAID YOU WILL INTERUPT THE PAPERWORK WE SENT THEM AGAIN. Thank you
