Dear Revdex.com:
I have spoken to Mr. [redacted] on the phone last Wednesday, August 19, 2015 regarding this issue and let him know we will be crediting him for the common area utilities that he paid under his first lease term (from November 2013 – March 2014). The total credit he will be receiving on his account is $81.64.
As I explained to Mr. [redacted] on the phone, Veranda Highpointe being a brand new building and having a unique set up for the utilities with master electric, gas, water, and sewer meters coming into the building and sub-meter equipment for all apartment usage; the intention was always for residents to pay their apartment utilities to Veranda Highpointe for actual consumption (read from sub-meter equipment), and to pay a portion of the common area utilities to Veranda Highpointe as well (as is a common practice at all apartment communities across the nation). All of the billing is done by a third party billing company and this is the message we verbally communicated to residents as they were signing their lease with us at move in.
The Utility Addendum used as part of the National Apartment Lease at Veranda didn’t clearly map out both sets of billing functions (individual sub-metering and common area billing), and the management team didn’t realize this until after we had billed through our third party billing company Conservice for 3 months. At the time we realized this, we contacted our local counsel and sent out a notification to all residents letting them know they were in fact responsible for a portion of the common area utilities and corrected the addendum for all leases going forward. Mr. [redacted] renewed his lease in April of 2014 and signed the corrected Utility Addendum and has been paying the common area utilities from that time through present.
Veranda Highpointe Management has credited any residents that have brought to our attention they did not have the correct lease addendum signed during their first lease term. The corrected addendum has been in place since February of 2014 for all new and renewal leases. The building was not fully occupied until December of 2014.
Sincerely,
[redacted], VP – Property Operations
