I am choosing this to be an acceptable response as I do not wish to escalate this matter furtherHowever, I do wish to point out that there are numerous factual inaccuracies in the business response, not limited to the omission of several emails in which my wife and I complain about the excessive noise and dust and debris in our apartmentFurthermore, the emails included in the response also have references to the noise, contrary to the assertion that there is no mention of noise in the numerous emailsOur intention upon re-signing our original lease was to remain at *** ** *** *** until June 2018, but we were forced to accelerate our home purchase search and purchase a home because of the excessive noise and dustAdditionally, we were told by the building management on several occasions that The façade repair was a shorter term project, and would not continue for the entire duration of our leaseWhile we did purchase a home upon leaving *** ** *** ***, we purchased this home because the living conditions were unacceptable at the apartment, And contrary to the claims in the businesses response, our reason for leaving was not solely to purchase a home.We do not wish to engage in a back-and-forth with the landlord, as it is not productiveHowever, may my response to this complaint indicate that we find their statement to be inaccurateWe will be happy for the Revdex.com to close this complaint.Thank you

We are responding to a written complaint submitted to you by [redacted] and [redacted] [redacted]. This Landlord, [redacted], L.P. and [redacted] (herein after referred to as “Landlord”) entered into a Written lease with [redacted] and [redacted] (herein after referred to as “Tenants”) for the residential apartment located at [redacted], Apartment [redacted] (herein referred to as “leased premises”). The Lease was for a one year term from July 1, 2016 through June 30, 2017. On May 10, 2017, the Tenants agreed in Writing to renew the Lease for a subsequent one year period. At the time of executing this renewal, the Tenants advised that they were searching for a home to purchase. The Tenants then requested a releasefrom the one year renewal and submitted the attached form dated October 4, 2017. The formrequests the reason for termination and the Tenants wrote “buying house”. The facade renovationnoise was not listed on the form.Although the Landlord had no obligation to grant this early termination request, they permitted the Tenants to reduce the renewal term to a 6 month term (with a month to month option). This is particularly significant because it meant that the Landlord would have a vacancy in the middle of winter, which is a more dif?cult time to re-rent an apartment. As such, the Tenants have already received a concession from the Landlord. The Landlord agreed to end their lease term on an earlier date Without termination fees or penalty. In October, the Tenants sent the attached e-mail regarding their house purchase. You will see from the extensive correspondence that my client was working with the Tenants. It is also signi?cant to note the absence of noise complaints in their e-mails.As to the facade, the property routinely performs inspections of the facade to comply with city code and ensure property safety. The expert report issued to Landlord on August 1, 2016 required Landlord to do repairs in order to comply with city code. Please see attached report from [redacted] and [redacted], structural engineers. lt is important to note that these repairs commenced in March, 2017, before Tenant’s executed the renewal document in May, 2017. Accordingly, the Tenants agreed to renew their Lease while the facade repair had already commenced at the property. In addition, no other Tenants were released from their Lease early and no other rent reductions were given to anyone else at the property while the Landlord performed facade work which was legally required by the city.The Tenants have already been released from 6 months of their Lease as a concession. The Landlord had no legal obligation to waive all fees and penalties which are typically assessed for an early Lease termination situation. This was done as a courtesy for these residents. Furthermore, it is Landlord’s belief, as evidenced by their non-renewal form that the true reasonfor their early departure is the home purchase. Accordingly, this Landlord has abided by the Lease terms and no further funds are due to Tenants.
