Me and my mother including my husband and one other roommate with three dependents were tenants with The Village at Auburn from November 2019 ? July 1st, 2020. I decided with my husband that we will be looking for other apartments to stay but my mother and the other roommates decided to transfer to a smaller unit. Once they made that decision, we inquired about the transfer process they agreed to speak to ***. She informed us that we would not be charged an additional deposit. We agreed to the terms. Once the transfer process began *** informed us that they indeed must pay a security deposit and the deposit amount was the same as the current deposit amount. The apartment they transferred to be a smaller apartment and they did not use a credit check and refused to determine the new deposit amount for the new apartment. As stay at home orders begin in the state and Covid-19 cases increasing. My mother and former roommate to keep their risk of contracting the virus low, decided to go forward with the transfer process and pay the outrageous amount of security deposit.
We moved out on July 1st and cleaned the apartment. We returned all the keys that were issued to us and removed all our belongings. My mother was due to transfer to her new apartment as well on the same day. On the day of her move-in she notices multiple damages to her carpet and a large stain. The doors to her laundry room were falling off and she found small nails along the carpet in every room. The nails were especially concerning because she is sharing the apartment with two small children.
Weeks later after contacting them multiple times about our security deposit for the previous apartment they finally got back to us. *** informed us that the deposit was sent to my husband at his address. To our surprise we did not provide them with a forwarding address. After reaching out to them again about the deposit, she then informed us that the deposit has been added to my mother's account that associated with her new apartment. That was odd. In addition, *** mention that our entire deposit was taken for damages to the carpet. Our deposit was $1073. They took $1030 for damages to carpet. That was outrageous in our option as we were tenants for nearly two years. In addition to the state the carpet associated with mother's current apartment.

Desired Outcome

Refund We desire a refund of the security deposit in the amount of $1073 and carpet replacement.

In response to the recent complaint, we follow allowable fair housing requirements and charges based on the actual condition of the home at move out. We are happy to provide a copy of any photos, invoices and damage items to the resident upon move out as actual proof of said charges. Each home is inspected by our on-site team as well as outside vendors for confirmation of any necessary charges.

Upon move out the resident provided both keys and forwarding address information for any deposit required, we sent that according to instructions provided from the resident.

If additional items are required we can provide those to the resident as proof of cost pass along.

(1) *** Management failed to adhere to all sections of North Carolina General Statutes �� 42-50.to 42-56 regarding security deposits by not providing an itemized to my written forwarding address even though it was provided.

(2) *** Management has failed and continued to fail to meet all requirements as laid out in section 809 of the Fair Debt Collections Practices Act. I am simply seeking a formal verification of the alleged debt and have yet to be provided with official and verifiable proof of the alleged debt.

(3) After having been rebuffed numerous times in my attempt to resolve complaint 2, I attempted to seek contact with a legal representative of *** Management and have been ignored and/or rebuffed each time.

Desired Outcome

Explanation of Charges That *** Management adhere to the law as required. If *** Management is unable, or unwilling, that I be put in contact with a legal representative of *** Management to discuss why.

The fire alarm in my apartment keeps going off because there is water leaking above it. I have complained about it and they only did a quick fix.
The first time I called maintainence after I called 911. The firemen informed me the battery was dead on the alarm and took it down temporarily. I put in an order with maintainence shortly after because No one responded to my call. Later that week I noticed water was leaking. My mother had maintainence look at it when she was in town. The did not attempt to resolve the issue. Within the past month they had someone come put the alarm back in place and patch the ceiling. However, a week later it was dripping water and the alarm was continuously going off.

Desired Outcome

I want the to do one of two things. They need to goo in and repair the leak and put my fire alarm back in place. Otherwise, if they can't fix it they need to provide moving services and move me into another apartment.
