Hi [redacted] , I am sorry that you were under the impression that the model was available to be rented or that we had a one bedroom that resembled the model, as the model is a two bedroomIn your previous message, you did state that the large one bedroom was out of your price range, which is why we offered you the smaller on bedroomUnfortunately we are unable to refund you application and admin fees as the criteria you signed does state that the application fees are non refundable and the admin fee is non refundable after hours unless the applicant is deniedThank you

After reviewing this complaint I do recall working with this resident when they moved outI called the collection agency we originally filed with and Spoke with *** stated that The resident in question *** *** gave authorization to the agency to speak with her mother back in
November after receiving the collectionAt that time The collection was disputedBased on the collection agency, all documentation provided by both parties did prove that this collection is Valid and owed to the community by Mrand Miss ***

I am rejecting this response because:Your business is CLEARLY not understanding the situationAS STATED IN MY PREVIOUS MESSAGE, I initially wanted the small one bedroom, (no price problem!) BUT THEIR WEBSITE WAS NOT WORKING which is why THEIR employee instructed me to apply for the bedroom and then she would switch it to the correct unitAGAIN, NOT MY MISTAKE BUT THEIRS! I don't understand why this is such a hard thing for your business to understand? They told me the small one bedroom looked exactly like their model room except without the extra room and bathroom when I took the tourWE NEVER WANTED ANY OTHER APARTMENT, IT WAS ALWAYS THE SAME SMALL ONE BEDROOMThey wouldn't show us the unit we would be moving into so that is why I REQUESTED PICTURES OF THE UNIT only to find out it is not what they had advertised to meAgain, I was the one that requested the pictures! After I came to them with this issue, THAT IS WHEN THEY OFFERED ME THE LARGE ONE BEDROOM but I told them it was out of my price range AND not the unit I INITIALLY wantedThere was never a question about what apartment we wanted or a price problem, I don't understand why your business would respond with such an irrelevant and completely different scenarioMy husband *** has been the one that has been contacting the manager, there should be NO reason for you to not have any record of all his calls and emailsPlease read carefully because you CLEARLY have no idea what is happening and I don't want to receive another message like the one you sent, that doesn't have any correct information AT ALL.Regards,

Mr*** had his mother reach out to us and we advised we would need him to put something in writing as to his disputeHe would need to attach his documentation and let us know why he felt he should not have the chargesNo official written documentation with pictures were submittedWe were
threatened with a legal suit so we called our attorney and were advised that we are Not to release our office documentation unless the judge ask for it in discovery. I am attaching but Please DO NOT SHAREI am also attaching service requestsIt looks like all were completed in a timely manner and I don't see one for Mildew or mold nor do I see one for a request in regards to filters. Mr ***' mother called our corporate office and he may have also sent an email to our community cares web address but with what he provided they felt charges were appropriate.Because he moved in Prior to Peak Living taking over, I don't know if there was an issue prior that was never resolved but we handled the requests and the move out as we would every move outMove out walk through are completed Monday - Friday 9-The lease agreement states that the apartment must be returned in the condition receivedThe nail holes due to a TV mount is Not wear and tear.Unless Mr*** can prove Documents that were turned into the office with a company representatives signature, I cannot honorPlease let me know if you need any other information. The applicants were shown two apartments- one being our model, which is unavailable to rent, and the other was a one bedroom apartment which was available to rentThey applied for a two bedroom apartment online, but advised us that thie apartment they applied for was out of their budgetWe
suggested the one bedroom that they were shown and they still felt is was higher than they would likeWe sent photos of a third apartment that they did not like and decided to cancelUnfortunately we are unable to refund any monies the applicants paid as they were given the application criteria and were advised that the application fees are non-refundable and the admin fee is refundable only if the applicant is denied or cancels within hoursThe applicants did not try to reach the manager on site, as we traced calls and emails and had not received any calls to the manager or emails to her email address with the company

I am rejecting this response because:Please read carefully. You did NOT offer me the small one bedroom apartment, that is the apartment I REQUESTED from the beginning. You offered me the large one bedroom apartment AFTER I complained and I rejected that offer. I don't know why you keep saying this after I have explained this to you 3 times now. My understanding was that the small one bedroom looked like your model room BECAUSE THAT IS EXACTLY WHAT YOUR EMPLOYEE TOLD ME. Now, that is false advertisement and is against the law. I need to be compensated for your employees error. State and federal laws are in place to protect consumers from false or misleading advertising. These laws make deceptive claims illegal. No business may make false, misleading, or deceptive claims about a product regarding its price, QUALITY, or purpose. If I have to take this further, I will.
