I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # ***. I have to respectfully disagree on all of the contentions and responses as provided by the Wilbur Group except the fact that I had requested additional work from day However as stated by the Wilbur Group, none of this was included in the original scope and it was not my decision to include the additional scope of work in the original work order Wilbur group chose not to include in the original work order for their own reasons that I am unaware off In all my verbal and written communications with the representatives of Wilbur Group from Day till the reduced scope was completed, I have repeatedly asked for the Quote for the additional workThey never gave me the revised quote till the reduced scope was completedOnce I requested them to provide a closure to my work order and provide me with the refund that is when they came and provide me with the revised quote This quote for the concrete and epoxy work done for the garage was not acceptable to me (please note, nothing was in written or even verbally agreed earlier) and therefore, the request for refund and eventually a request to come and complete the remaining scope of work to the extent of the refund was requested. Please note the additional scope of work that I had requested was only some concrete and epoxy work done in my garage and some patio work in the back yard(this was not to happen immediately and was to be discussed and priced latter) We had briefly discussed the new concrete pad for my cooling unit outside the house, however after knowing the fact that for completing the new concrete pad, the existing Freon gas from my two cooling unit would have to be emptied and refilled, I had communicated verbally immediately not even to consider that as an additional work There were no discussions pertaining to the wall construction in the basement and not sure what Wilbur group means by ON and ON. None of the additional work that was only verbally discussed was intended to offset with the original scope because I did not know the cost associated to the additional work It was the representatives (Tom and ***) of Wilbur group that suggested as they are the experts and they were aware that the walls were already dry in Oct-and once they rip up the walls, they will exactly know the reduced scope of work, they suggested that they could either chose to offset the credit with the additional work (if I agreed upon the cost and work in writing) or provide me with a refund However as stated by *** in one of his e-mail that was attached as the discussing of refund being a “Phantom Verbal Agreement”, the representatives of the Wilbur group have denied providing me with the refund.The statement that I was stopping the workers of the Wilbur group is again totally an incorrect statement as me and my wife never interfered in their workOn DAY (one) before the start of the work, *** asked me for the scope of work, and I had clearly informed him, that you are the expert in this job, and we have the scope signed in the written work orderBased on how much the walls were dry, Wilbur group must determine how much to rip the walls and reduce or increase the scope accordingly and provide me with a revised reduced or increased change order for each room However *** mentioned that we will write one change order at the end of the completion of the project I do not understand how I could stop the work, as I had taken a day off only on the first day and was home on a Saturday After going over the scope of the work as per the work order on the first day and have the Wilbur group determine the extent of the work based on their expertise, whether to reduce or increase the scope, I was at my work place for all the remaining days My wife never got involved in any the decision making or their work during the remaining days of workIt was Wilbur group representative that were either starting or stopping the work for the reasons beyond my knowledgeLet me re-instate the number of day the Wilbur group were present in my house. • Day 1: Demolition - Crew member out of which only were involved in Demolition - All three rooms done in Approxhrs • Day 2: Insulation and Baseboard Installation: Crew member - All insulation and baseboard installation was done in a day• Day 3: Plaster of Baseboard: Crew There was another guy but was not present or working in my houseHe was in the car all the timePlaster in all three rooms were done in a day• Day 4: Paint: Crew member; Painted all three rooms in one day• Day 5: Floor Polish: Completed floor polish in approxhours (from 9:AM to 12:PM) - Only coat applied and I showed you the scratches when you were present • Day 6: Touch ups (crew for approxhour)The only scope that I went back and forth over phone conversations with ***, where Wilbur Group had not mobilized any of their crew was for Carpet installation as HomeDepot was providing free labor on InstallationI asked the Wilbur Group, if they could match the Free Labor on Installation, and Wilbur Group disagreed Once Wilbur group disagreed, I informed him to remove it from the scope of work and provide me and with a change order and, *** agreed verballyHowever, as always he repeated that they will write one change order at the end of the completion of the project.Please note that the work order agreement signed by Wilbur Group and myself was not written on an hourly basisIt was written on a line item by line item with a square foot area and a dollar amount associated to each line itemI have the calculations of the square footage of work completed in the attached excel file, which was agreed by the Wilbur group Therefore Wilbur group contention of hours of work totaling to $8,is not acceptable based on the way the agreement was signed by both the parties and stating that the basic labor cost exceeded the amount given to Wilbur Group at the outset of the job is also not acceptable They need to charge me based on each line item and the square footage that was completed and not on hourly basis.I would request the Wilbur group to stop mentioning scope of work, hours and amounts that was never agreed in the written work order (including but not limited to, Hourly rates, additional work that was only discussed verbally and never converted into a formal written agreement).Please note that the refund is not always written in the agreement, however amount due and refund are implied contractual obligation by both the parties If work completed is more than the agreed and signed work order, I will have to pay the differential amount to Wilbur group, however if the work completed is less than the agreed amount, a refund is supposed to be provided by the Wilbur groupIn my case, Wilbur group owes me a refund of $2853/- as agreed by *** through various e-mails, because they reduced the scope of work significantly, with an assumption that they will get the additional work (even when Wilbur group did not provide me with quotes at the beginning or during the progress of the original scope of work).Another incorrect statement Wilbur group is stating that I am adding new scope that I want to be done The third option (in the attached PDF file) that I requested was to come and complete the work to the extent of the refund amount based on our signed agreement I never mentioned to Wilbur group that an additional coat will diminish the scratch marks that were embedded on his pre-finished floor as again I am not the expert in flooring I informed the Wilbur Group that per industry practices two coats are applied to refinish the hardwood floor, irrespective of whether it is a pre-finished floor or not, which is what I had requested him in Option that is also attached as a PDF file.There have been no further discussions with the scope of the work to be completed to offset the credit amount of $2853, until now after reading the response provided by the Wilbur group to return and finishing the ceilings, and one wall.Please mediate with Wilbur group to resolve the issue and have Wilbur group arrange a refund of $2853/as soon as possible.
