Complaint: [redacted] I am rejecting this response because: in a Thurston County Court of Law on December 5th, 2015, the presiding judge provided clarification and reasoning to? the plaintiff? (MrH***) concerning my small claims case against MrH***.? ? The clarification provided to MrH [redacted] was that MrH [redacted] did not have valid justification to withhold the remaining portion of my deposit ? The judge indicated to MrH [redacted] that he could not prevent me from cancelling services ? The judge? followed up with MrH [redacted] that? just because I cancelled his services, he did not have the legal means to withhold monies to paid for services that were not rendered ? Judgment was found in my favor for the full amount, in which MrH [redacted] has since paid in full; thus, this case is now closed Sincerely, [redacted] ?

To Whom It may concernWe were? hired to do work for the [redacted] 's.? We had torn out the existing back yard and built a large custom planter box and used pre existing irrigation lines to water bedWe also prepped remaining back yard for a concrete patio as well.? Before going into this job we asked if there was a blue print for irrigation system so we new where the lines were at.? The [redacted] 's said they just bought home and did not know.? ? We expressed concern at that time that there could be complications in job no knowing where the lines were at.? We hired sub contractors to conduct and complete patio and staining, they did damage line during work.? We did not charge [redacted] 's for the repairs even though we had told them ahead of time if we damage lines due to no blue prints it would be additional costs.? ? We then finished job and the [redacted] 's were happy and paid for remaining balance and the job was completed.? In our contract it states we are not responsible for acts of god, and or reasons beyond our control.? Not having a diagram for buried piping is one, and we did everything in out power to accompany the [redacted] 's to satisfy them including not charging for repairs to piping.? For the concrete cracking there in no proof that the water leak was a cause of cracking, and concrete's nature to crack or not crack is never a controlled option.? you can add rebar for strength which we did, and a high strength resin mix which we did to prevent cracking but you unfortunately cannot? make a guarantee that it will not crack.? There are a number of possibilities to concrete cracking and the customers should not point fingers as it could be the chemical properties, the shrinkage as it dries,? and or settling.? We did inform the [redacted] 's to stop turning the water on and off which they for some reason refused to keep showing and looking at it leak.? You can research concrete cracking and anyone or any place does not, and will not guarantee cracking.? I did inform the [redacted] 's when they contacted me that I could look at it again but would need to conduct a quote to fix or repair but insisted I complete work on it asap in one week time!? I told them that was unrealistic and not going to happen, and they then became very enraged and telling me what I was going to do, as well as pay out of pocket for it.? I informed them that could go after other contractor who did the work and ask them questions on job, they since closed? or company concrete was made at for assistance as we were paid in full and work was completed we no longer had anything to do with project after job was closed.? Criss stated that consumer wanted to cancel and wanted a full refund According to the contract that the consumer signed, there is a 50% cancellation feeThe consumer is upset and doesn't want to pay the feeCriss has tried numerous times to contact the consumer via a phone call and
emails.
The Consumer is now taking him to courtAnd will not communicate with him to resolve the issue.

Complaint: ***I am rejecting this response because: per the complaint that I filed, it was clearly noted that I requested to have the remaining portion of the pre-paid deposit ($890) refunded not the full amount that I pre-paid; indicating that Criss is not accurately reflecting the facts of what I have requested
No contract (or equivalent documentation) was ever signed nor any early cancellation fees communicated to me so I am concerned that Criss is not accurately reflecting the facts of the situationI would ask Criss to provide/produce documentation where he and I agreed to the cancellation fees that he refers to.Criss contacted me after I had filed legal action against himCriss actually contacted me on the same day that he was served by the Thurston County Sheriff’s departmentCriss has only sent me emails which are attached to this response so Criss is not accurately communicating the factsTo-date, Criss has not called my phone concerning this situation

What happened is that the consumer signed up with me in The contract at that time period was a hard-copy and he was given copies of the contract at that timeAfter 2013, we went to an emailed contractHe authorized for the work completed for a full annual year and sent in a full payment by checkCheck was cashed and work was completedIn August of 2015, he felt there were issues with the servicesThat is when he emailed and mentioned he had issuesWe tried to make amends in a preofessional fashion and that was when he declined all of our offers after we tried to fix the situationI told him we could do in-store credit or gift certificateSo he could utilize our services, but the consumer was unwilling and demanded a cash refundOn all my contracts, it says a 50% of the total contract amount for refund and if he wanted to cancel at that point, it would be have been more than the remaining balance left on the accountAugust 13th is the date we started talking about issues with the consumer, but that is when he went ahead and filed in court

No contract (or equivalent documentation) was ever signed nor any early cancellation fees communicated to me so I am concerned that Criss is not accurately reflecting the facts of the situation. I would ask Criss to provide/produce documentation where he and I agreed to the cancellation fees that he refers to.Criss contacted me after I had filed legal action against him. Criss actually contacted me on the same day that he was served by the Thurston County Sheriff’s department. Criss has only sent me 2 emails which are attached to this response so Criss is not accurately communicating the facts. To-date, Criss has not called my phone concerning this situation.
