Thanks for the chance to respond regarding this itemI’ll start with basic timelinesI received an email from the complainant’s Realtor on Oct 11, The text is shown below:“ The sellers were home during our walk through and were able to show buyers the stakes they had put in for the rear
property cornersIf they can put out the two for the front corners, that will satisfy the condition for property corners to be markedI gave the owners the keys from the lockbox and they are going to be bringing those to the title company along with the lockbox so that will be there for you office to pick up when convenientI did mention to sellers to just bring all keys and garage door openers to the title company for sellers once they are officially closedSince the owners have dogs, it was mentioned there was copious amounts of dog debris in the yard and buyers were hoping sellers would have the courtesy of not leaving it in that condition since they do not have petsLastly, sellers and buyers are going to meet at the property at 8:30am on Thursmorning in order to take a quick peek as then the property will be completely empty and ready to go so you are aware and in case someone from your office wanted to be presentThanks for your time and assistance with allKind regards,-- ***” This transaction for the property the complainant currently lives in was signed and closed on October 12th, The complainant’s Realtor also was not present for closing as she was out of townI also did not attend the closing at the closing title company due to scheduling conflictsThis was the last I had heardBased off the email communication from the complainant’s Realtor, I had assumed that they had conducted another walkthrough of the property and had been satisfiedThis assumption is because no Realtor should allow a closing to occur if the buyer is unsatisfied with the condition/items/etc of the propertyThis is because once the transaction is completely signed over, all contingencies have been wiped outIn this case, the stakes are at issueThe dog excrement was never written in as a contingencyThis is the only time I have ever heard of the dog issue and cannot speak to the matter, I have not seen it firsthandIf complainant still had issues with the stakes or lack thereof, they should have been advised to not sign final documentsThis is the advice I give every single one of my own buyers and I have delayed closing due to this type of situation beforeI then received the following email on October 30th, This was a significant amount of time after closing: “Hi *** *** *** I am just following up and also forwarding the email sent to you prior to our *** *** *** closingI'm hoping we can collectively find a solution to the front corners not getting marked as was required by the sellers as noted when I did the initial walk through, the sellers had shown the buyers where the back corners were staked but did not have the front corners doneI mentioned this to the sellers and they said it would get doneHowever, since neither you or I were in town for closing, it did not get done by the sellers as they were obligated to doAt this point, I had a frank discussion with the buyers and they are adamant that the front corners are markedDo you have contacts with surveyors in the area? I am going to have to get quotes on having the front staked as these clients will not accept anything other.Any input you have would be greatly appreciatedThank you for your time and assistanceKind regards,-- Ginny” At this point I emailed the previous owners for more information about the stakesThis is their response:“ On the morning of closing *** (husband of complainant?) stopped by for the final walk throughI showed him how the staked property lines in the back lined up to the front of the yard and roadThen I walked him to the spot on both sides where the property lines were in front, as told to us by the previous owner when we bought the houseI told him how many feet from the line of spruce trees we planted where the property line wasIt was in line with a no trespassing sign the neighbor across the road hadHe noted thatOn the other side (West) I showed him where the property line was, just inside of the white pine tree lineThere was a cut down stump there as wellHe noted that and said he was fine with this, but I did offer find some stakes from our utility shed to stick them inHe told me it was OK as I showed himIf he had insisted, I would have staked them before we went down to closeWhen we gave him the keys and garage door openers at the Title Company after he signed the papers, he wished us well, as we did to himI forwarded this information to the complainant’s RealtorI stated that my previous clients were now living on the west coast and would not be coming back to Wisconsin to place two wooden stakes in to the ground I also reiterated to the Realtor that we never should have closed if conditions were unsatisfactoryAt the time, I made the mistake of possibly offering someone to put in some stakes but I realized afterwards that it would be a liabilityI do not know the exact locations; the complainant’s husband knows the positions much better than IIf I put the stakes in the wrong position, then what liability would I open myself up to? Approximately three days later, the complainant, Resnick, began a digital and online harassment campaign against *** Team Realty GroupThis would have been something I was fine with except she took it a step further by posting on friend’s social media pages as wellAt the time, I decided to not take any legal action against herI am empathetic to someone feeling as if they have been wrongedIn this case, I absolutely know that her agent should have prevented closing if there were any issueThis is the reason a consumer hires a Realtor, to protect and represent their interestsFinal Thoughts I am empathetic to MsResnickIf I feel that I’ve been wronged, I would try to seek some type of redressI wouldn’t harass that individual and ancillary friends to do soIf I knew the exact location of the stakes without doubt, and had reassurances that complainant would not continue harassment or redress, I would drive out there, stick some stakes in the ground and forget the whole ordealIn this case, complainant’s Realtor should have conducted themselves as stated in form BBuyer Agency“agents owe certain duties to all parties to a transaction: (b) The duty to exercise reasonable skill and care in providing brokerage services.” My proposal is to have complainant’s husband place stakes in property where previous owners pointed out the stakes to himSincerely, *** ***

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
Yes, according to Mr. [redacted]’s response, we asked for the buyers to put out the two front corner stakes after the first walk-through to satisfy the condition for the property corners to be marked “per Columbia County Zoning and Land,” which is the wording Mr. [redacted] put in the counter-offer. Is Mr. [redacted] suggesting the owner was able to get some stakes from their shed and randomly figuring out where they go - “per Columbia County Zoning and Land”?  Yes, the message from The Business begins with an email from OUR realtor, to which Mr. [redacted] never did respond. Our realtor, Ginny Quirk, did point out what yet had to be done, NONE of it was addressed, and what Mr. [redacted] fails to address is that he never bothered to respond to Ginny Quirk’s email, texts or voicemail messages which she sent two days prior to closing regarding the status of his seller’s having the front stakes in. Dog poo all over the yard was not a contingency, we did not expect to see anything left to that degree.  Not closing on the date was not an option, we had been paying to stay in a hotel because the seller’s changed the closing date and moved it out further. Mr. [redacted] was impossible for our realtor to get ahold of so nothing in his way of conducting business would have encouraged us to think that delaying the closing would have been helpful.  He was just not present for his clients or for questions we needed to get answered through our realtors.The seller’s response was interesting in that they mentioned they went back outside with [redacted] on the morning of the closing. The text following in parenthesis from the seller never happened. There was a walk-through the day before, our realtor contacted Mr. [redacted] to let him know the stakes were not in, Mr. [redacted] never responded (as usual). Not sure they the seller believed this took place on the morning of the closing? (On the morning of closing [redacted] (husband of complainant?) stopped by for the final walk through. I showed him how the staked property lines in the back lined up to the front of the yard and road. Then I walked him to the spot on both sides where the property lines were in front, as told to us by the previous owner when we bought the house. I told him how many feet from the line of spruce trees we planted where the property line was. It was in line with a no trespassing sign the neighbor across the road had. He noted that.) It’s sad that Mr. [redacted] is more interested in his own liability than to complete the staking according to the wording he himself worked into the offer, “per Columbia Zoning and Land." After Mr. [redacted] made the change, Mr. [redacted] did not make sure the staking was done.It’s interesting Mr. [redacted] considers that I posted on Facebook as an online digital harassment campaign.  I posted the same information that was sent to Revdex.com, which was truthful and accurate. [redacted] Team Realty Group has a Facebook page and you are also able to rate their services. My response was consistent with what I am relaying to Revdex.com. As for the friend’s social media page, the friend was commenting on the services of [redacted] Realty, of which I was also commenting. The mention of legal action does make me wonder if Mr. [redacted] hasn’t gotten his priorities mixed up. Service, of course, is number one. Mr. [redacted] offered to come and stake out the 2 front stakes himself. We said, sure. Then he backed out, because, of course, he really doesn’t know where to place them. I will be relieved when this is taken care of.
