[redacted] concerning credit reporting concerns and the requested reaffirmation or refinance of his mortgage. We are sorry to hear that a customer's experience at Third Federal Savings fell short of their expectation. Upon researching the customer's account, our records indicate that on August 12, 2015 [redacted] contacted our office and spoke with a bankruptcy specialist regarding loan payments that were not being reported to the credit bureaus. The specialist advised [redacted] that due to the Chapter 7 bankruptcy discharge, we were no longer able to report any payments that were being made. We have confirmed that the information that we are reporting to the credit bureaus is accurate under the Fair Credit Reporting Act and that none of our records indicate the mortgage loan was ever reported as a short sale. With regards to the complaint that Third Federal did not make [redacted] aware of or discuss a reaffirmation of his loan, a reaffirmation would have needed to be discussed directly with the attorney that handled the bankruptcy. Third Federal does not advise or direct a customer to reaffirm a mortgage debt. However, if interested the customer is welcome to apply for another modification with us. Upon researching the customers concerns this is what we discovered that Mr*** called in on 8/26/to customer service to discuss implementing a rate relock on his current Third Federal mortgage accountThe rate relock was not done without Mr***'s consent and approvalOn a recorded line Mr*** agreed to the new rate of 2.85% , provided us his credit card information and gave us permission to charge his credit card the $rate relock fee. On 9/13/we did reach out to Mr*** to discuss his dissatisfaction with :he product/service he paid forTogether came to an agreed upon resolution that works for both Third Federal and Mr***. of Upon researching the customer's mortgage loan this is what we found. Consumers claim: "Third Federal incorrectly advised us on the escrow amount for our mortgage loan on our new homeIf they had done a good job of estimating our taxes in the first place we would not be in this position." Response: Due to lending regulations, Third Federal can only collect from the customer the amount the county is reporting on the tax bill plus a two month cushionThe first tax bill provided by *** County in for the ***'s property was sold on the lot value onlyIn *** County reported taxes which reflected the new evaluation value o- the property og the ne.w constructionThis increase and shortage is typical with new construction as property taxes are paid in the We did send MrMrs*** correspondence on September 25, which contained an important reminder irlir their escrow account and that what we were collecting was based on land value only and to plan accordingly for a hill and escrow shortage in the next year. I have attached a copy of the letter sent.Consumers claim: "We knew there would be a small discrepancy so we paid an extra $per month on the mortgage to “account tor the difference." Response: In review of the customer's statements we have not received an extra $per month from the customersSince the loan originated in January the only additional monies received has been $which was applied to the reduction of loan principal. In closing, our intent is not to upset Mrs***We take pride in providing superior customer serviceOur regional manager in Florida, Deborah C*** reached out to the ***s in an attempt to explain the escrow shortage in more detail and with the hopes of coming to a compromise that would satisfy the customerDeborah spoke to Mr*** on February 10, and Mrs*** on February 11, Deborah went into detail with the ***'s on the tax bills to us by *** County and also reviewed their escrow contributions verses the tax bills Third Federal paid *** their behalf thus resulting in the shortageWe were able to reach an agreed upon resolution. For your reference, details of the offer I reviewed appear below. I have reviewed my online statement and they were up to date if anything one was late. Again I have I asked in the past if they could send me my statements at my request so I do not miss, forget and know the full amount due. I was told no, I had to call each month. I have consulted a lawyer and was told that they could send me a statement if I request and not hold them accountable for violating bankruptcy lawsIf they truly wanted to make sure they received their payments and I do not get forclosed they would of sent me my statements at my request. That is NOT breaking any laws. Again, if they wanted to help or keep me from forclosure they would not have froze my account whereas when my bank sent payments they were refused. This makes absolutely no sense to refuse my money. This is a very small amount $and if anything one month late. I can provide a print out of my online payments proving that. Two months as they say is not long and of course if I NEVER receive a payment I will miss an occasional one. If they wanted to work with me they would send paper statements at my request and unfreeze my account to accept money rather then trying to get rid of load over a minute amount. I have paid all payments for about years now. This is unacceptable practice. Again, I have requested in the past

complaint. Please find below what our research has revealed. Claim 1: "I have received a second notice from Third Federal in regards to a default. The Letter is dated 1/27/16 and it states I was in default on 11/28/15. They have sent me a harassing notice that they are in the process of foreclosing my loan because the amount due on 1/27/16 is $110.70. I do all my banking online on my bank account and I am not in default, I am paid up in full." Response: Unfortunately, Ms. [redacted] has gotten behind in making her payments and did receive a Notice of Default letter, which I have attached for your review. As you can see, the account was 60 days past due at the time of the notice and was not an attempt to harass Ms. [redacted]. On the contrary, it was providing her with the opportunity to bring the account current prior to referral for foreclosure which will add additional costs, or worse, the loss of her home. As of today, Ms. [redacted] is still due for the November 28, 2015 payment. Claim 2: "I have in the past asked for a statement to be sent because my main mortgage company sends me one. Third Federal is a line of credit. I had filed bankruptcy and have paid both. It is unacceptable that they refuse to send me a statement yet are capable of sending me a foreclosure letter threat for such a small amount and an amount that has been paid." Response: As Ms. [redacted] has stated, Third Federal did received notice from the Bankruptcy Court that she filed for Chapter 7 bankruptcy protection on March 17, 2014. According to the court records, Ms. [redacted] did not reaffirm the Third Federal equity loan mortgage and in accordance with the Bankruptcy, a full discharge of all her debts, including this mortgage, was granted and filed by the courts on July 18, 2014. As you are aware, and in accordance with the Bankruptcy laws, once a debt is discharged, all collection efforts must cease as the debt is no longer obligated. As the act of sending loan statements is considered an attempt to collect a debt, all loan statements are ceased once a discharged has occurred. Although the debt cannot be collected under the Note, Third Federal's security interest (via recorded mortgage or Deed of Trust) in the property remains. The Chap. 7 bankruptcy discharge leaves Third Federal with the option of foreclosing on the mortgage lien, selling the property and collecting the amount owed; or continuing to accept voluntary payments from the customer occupying the property in exchange for agreeing not to foreclose. Although Ms. [redacted] was making payments and Third Federal was accepting them, statements cannot be provided to the borrower, or else we are in violation of the bankruptcy stay. In closing, the Notice of Default is not an attempt to harass Ms. [redacted] but is informational in nature. It advises her that she is behind in payments and what the consequences are for lack of payment. We hope she brings the account current quickly to avoid legal action. In addition, as the Note has been discharged through the bankruptcy, no statement will be provided. While we have responded to each of the borrowers claims in our initial correspondence, please find below our response to her new comments. New Claim 1: "I have consulted a lawyer and was told that they could send me a statement if I request and not hold them accountable for violating bankruptcy laws." Response: Please be aware that Third Federal is well versed in the Federal Bankruptcy laws and guidance established by the Consumer Finance Protection Bureau regarding the proper handling of discharged loans. As already stated, Third Federal cannot, and will not, send statements to the borrower, or any borrower whose debt was discharged through the bankruptcy courts as it is a clear violation of the law. New Claim 2: "If they want to work with me the would send paper statements at my request and unfreeze my account to accept money rather than trying o get ride over a minute amount" Response: As noted in our repose to claiml above, we cannot and will not provide statements. Please be aware the the borrower's account is 84 days past due and is due for the 11/28/2015 payment. The total to bring the account current is $169.94. We require the full balance to be paid in order to cease any legal action. While the mortgage has not been referred for foreclosure, it will be soon. Once it is, additional costs and fees will be due in addition to the past due amount which will add unnecessary expenses that the borrower will need to pay. application. After researching the application, it has been determined that [redacted] along with his spouse Linda L. [redacted] applied for an Equity Line of Credit, they did not complete a refinance application, as stated in the applicant's complaint. The denial for the loan application was due to credit.  Yet, Mr. [redacted] is under the impression that the denial was because of a recent federal law, [redacted] -- restricting his ability to be approved. There is no record of any Third Federal associate telling the applicants they were denied due to the [redacted] Act. Next, Mr. [redacted] indicates that he was not able to speak to an underwriter, yet our records show that he spoke to a representative in our underwriting department on August 4, 2015. Lastly, Mr. [redacted] makes a statement that he would like a review of his credit to determine whether his credit score was negatively impacted by this denial and is asking for the point(s) to be restored if this impact was negative. Mr. [redacted] chose to make an application with Third Federal Savings and Loan and in doing so authorized a credit pull. Unfortunately, the outcome in this case was adverse. Third Federal cannot remove the credit inquire from Mr. [redacted]'s profile based solely on the adverse action. Thank you for the opportunity to respond to this inquiry.
