[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed Administratively Resolved] Complaint: [redacted] I am rejecting this response because:: When ** [redacted] "s workmen were installing the floor pan they did not reenforce the floor pan at the drain We are concerned that the added pressure on the drain at the drain area in the floor pan will cause a leak We had other home improvement contractors come in to evaluate the condition and they advised us that in time the drain will leak The age of the house nor the earthquake has nothing to do with the conplaint No connections at our other bathrooms were affected by the earthquake or by the age of the house It is true as he stated that he would repair the drain at no cost but he refused to repair the ceiling to return it to it original state at no cost to us If he has to go in to the ceiling to repair what should have been done at the time of installation, then he should be responsible to return the ceiling to its original condition That is our position Regards, [redacted] ***

installed an acrylic [redacted] shower pan. In my professional opinion [redacted] is the best manufacturer of shower pans. I have been using their pans for many years and have installed thousands of them. [redacted]. [redacted] is not a contractor and her stating that the pan is sagging is totally false. The pan is acrylic and is molded with a slope downward to move water to the center drain hole. It will flex but it is not sagging, nor will it break as [redacted]. [redacted] fears.When I installed her shower pan, I attach the pan to the existing pipe above the drain trap. The drain trap is below floor level. My work was done above the floor level and had nothing to do with the drain trap. The house was built in the late 1960’s by **. [redacted]. In my experience, I have found that **. [redacted] would drill holes in the joist and run the drain pipe through them. Sometimes the holes were much larger then the size of the pipe so shims or wood wedges were used to fill the extra space between the pipe and the hole. Sometimes the pipes were secured with a strap it in order to keep the pipe secure. Houses shift and settle plus we had an earthquake several years ago. My opinion is that the drain pipe has become lose because of the age and normal wear and tear of the use of the shower.I have been trying to resolve this issue with [redacted]. [redacted] since she brought it to my attention in the summer of 2013. Please note that the work was done in 2008. I went to her home to discuss the issue. I explained the situation to her as I did in the above paragraph. She argued with me and could not seem to grasp what I was saying and wanted only to blame me as doing poor work and that it was my fault.I am a small business owner and I highly value by reputation. Customer service is of utmost importance to me. Even though the issue was not due to something I did or didn’t do, I was willing to work things out with her. I suggested cutting the ceiling and seeing if there was a problem and attempt to fix it. I would do this at no cost to her but she would be responsible for the cost of repairing the ceiling drywall patch and paint. She was not agreeable to this solution. We spoke again over the phone, I tried to work with her but it seemed as if nothing would make her happy.Clearly my workmanship is not shoddy otherwise there would have been a problem(s) right away and not 5 years later. I stand behind my work and take full responsibility for any issues that may arise at one of my jobs. In this case I am NOT responsible for the creaking noise [redacted]. [redacted] hears. Because I do not want her to continue to say bad things about me and my company (as she told me she has) I want to settle this. I am willing to compromise and meet her half way.I will cut the ceiling and attempt to fix the creaking noise (at no charge to her) but again we are talking about an older home. I can only do what I can do, I cannot rebuild her home. I am not responsible for having her ceiling repaired. I feel this is fair because the fact that she now hears a creaking noise has NOTHING to do with the work I performed in 2005.Neither I nor Third Generation will be held responsible for any creaking noises she hears after I try to fix the problem.Thank you,
