Review: In November 2012, I ate at the 3rd Street Diner having just arrived late into town and not eating yet. The service and meal were average, and when it came time to pay my tab I explained the my waitress that I was here on business and needed the checks separated, yet rang through the same credit card to be able to be reimbursed through work. I then received two slips, which I filled out entirely, and left a cash tip for both receipts. Upon reviewing my bank statement a few weeks later I noticed that the waitress had provided herself with an addition $4 tip ($2 on each receipt) rang from my credit card illegally without my consent. I immediately called and spoke to a manager who was given all the information and who was supposed to get back to me. I called a week later (a few times) and never received a call back. When I finally did reach someone the initial manager I was working with was no longer with the company so a second manager took the information and I was supposed to get it cleared up. Again no phone call- or response. Finally I spoke to 3 other managers ending with [redacted] who ensured me it would be taken care of and it should be in the mail due to the error that was for sure found showing they over rang my check without consent. It has been months and I still have not heard back from, or received the money as I was supposed to. They have my correct information, I've provided it to them numerous times- yet nothing has been done to financially cover the situation. To my knowledge it's illegal to purposefully adjust credit card totals, know it was done incorrectly, and not correct the financial error with the paying customer. I would like for this to all be done and over with, yet I'm obviously not getting anywhere on my own. I don't not recommend this restaurant, or service to anyone in the local area.Desired Settlement: At this point, not even for the sake of the money, I would like to be financially compensated the money that was incorrectly, immorally, and knowingly taken from my credit card as soon as possible.

Please allow this letter to convey my sincere apology to you for the unfortunate
circumstance that took place at 3rd Street Diner regarding your
credit card. After investigating the situation and realizing that one of our
waitresses had added a tip to your credit card without your knowledge I was
very upset. The waitress, in question is no longer with us, and I am sincerely
sorry for this inexcusable behavior. There is no excuse for what she did and
this type of behavior is completely unacceptable. 3rd Street
Diner has a zero tolerance for this type of conduct. I would like to send
you a check for $** to cover the tip and cost of the meal and apologize for the
length of time it took to respond to your complaint. I am so sorry this
happened and if there is anything else I can do to rectify this incident please
let me know. Please contact me directly on my cell phone at [redacted] day
or evening and I sincerely apologize once again. We clearly dropped the ball
regarding this matter and hope that you may one day give us a second chance in
which we would like to offer you a complimentary breakfast, lunch or dinner for
two.
