Initial Business Response / [redacted] (1000, 12, 2015/06/25) */ this is the statement of our certified mechanic: "The customer brought in his [redacted] to the shop to have his headlight fixed because it had moisture in the headlight. I looked at the car and told the customer that it was possible that... the bumper had to be removed due to the bolts being under the cover are not easy to get to unless removed. I was unsure how long it was going to take but giving him an estimate of between 3 - 5 hours. The customer asked if he could have a loaner and was told that we could not provide a loaner as per our policy as a used car dealer. [redacted] I proceeded with the job and removed the right front wheel well liner and unbolted the bolts from behind the headlight , then removed the bumper. I then removed the front two bolts and removed his headlight. I sealed the headlight around the front glass cover where they are known to leak and blew air into the headlight to remove the water out the holes where the headlight bulbs go. I put the headlight in and bolted it back up and REMOUNTED the cover and inner fender wall at this time. I backed his car out because the customer had not yet come back. When the customer came back he came into the bay. I told him it was all sealed up and good to go if he had any more trouble to give us a call. He asked for his keys which I gave to him and went back to work on the job I now had in the bay. He [redacted] walked around his car inspecting it, came into the bay for the keys, drove off and never returned. He never reported any damage at that time. I DID NOT see any damage done to his car while at out car lot. Absolutely, no damaged occurred to his car by us. WHen he left, the headlight was sealed! occurred while the repairs were done at out lot." Our entire car lot, including the mechanical and detailing bays are under camera surveillance 24/7. When the car was picked up after the repair. the mechanic threw the keys and said the repairs we done and waked away, back inside.. [redacted] never looked it over at that time because it was pouring rain. He left and started for home. [redacted] . When he got out of the car it wasn't raining so he looked it over. That is when he noticed the damage. The damage is all around the headlight on the fender and bumper. This is what he worked on. Looks like he used a screwdriver to pry the headlight from the car. Could he explain how driving down the road could cause damage around the headlight and no where else on the front of the car. This vehicle was on our car lot as a consignment vehicle and was purchased by this customer three (3) years ago. It had 2 previous owners. this customer searched out the previous owners and spoke with them directly. The vehicle has not been in...

When the vehicle was purchased it included a 3 year [redacted] warranty. As we understand, all claims have been paid in full.
the first we have heard of any problems is three years after the car was purchased. we cannot be responsible for any of the problems claimed three years later.

We bought the vehicle late[redacted] 2013, making it 2.5 years ago. We contacted [redacted] when the car was at [redacted] with faulty injectors and at this time, [redacted] noted the reason we had to add a liter of oil every 5,000 kms was because both turbos were leaking. When we called [redacted], he [redacted] said this is why he made it mandatory we bought the aftermarket warranty and hung up. He states teh warranty was included in the purchase. No, we were made to pay the $[redacted]+HST to purchase this mandatory warranty. The car was never registered to the 2nd owner, no[redacted] was provided at the time of purchase, and only disclosed it was on consignment when we contacted him last month. [redacted] Warranty DID NOT cover all the repairs to the vehicle.

Again, your client sought out and spoke with the previous two owners of the car. Any issues would have been declared and discussed at that time. This was all done prior to purchase of car.
Client never called and complained about any issues while the 3 year [redacted] warranty was in effect. Never have we been made aware of any expenditures until mid-[redacted] 2016. As far as we know, all claims made to the warranty company have been paid in full.

IN [redacted] 2016 I answered a call from the wife with a story and complaint, three years after purchase, that the vehicle has a leak and water in the trunk!! [redacted]
This is a new[redacted] vehicle, purchased as a used vehicle [redacted] They want a full refund plus money they spent for repairs (when you have a full 3 year platimun warranty). [redacted]

[redacted]? Here is my response to the last comments.
1. I reached out to the previous owner on[redacted], never before. I have an email to confirm the conversation.
2. No declaration was ever made by the dealerships who the previous owner was and that the car was allegedly on "consignment".
3. No conversations with [redacted] prior to the purchase in[redacted] 2013.
4. Contact was made in [redacted] 2013 with [redacted] about the injectors and turbos. His response was "that's why we made the warranty mandatory" and hung up.
5. The warranty hasn't expired, it expires[redacted] of 2016.
6. Phone call from my wife was not after 3 years, we only purhcased the vehicle in[redacted] 2013.
7. Water in the trunk was caused by an improperly sealed tail light, from a previous accident, and mechanic confirmed it wasn't from manufacturing and the timeline on when it happened to accumulate that much water.

The dealerships response is quite clear they aren't even looking at the sales file from 2013.
Making an after market warranty mandatory with the sale of a vehicle doesn't shift any future responsibility of a dealership when they are selling a vehicle that was in an accident or has mechanical issues[redacted]
