On May 20, 2015, this company installed sod at my property. Today, the sod is dead despite regular watering and fertilizer.
On May 20, 2015, this company installed sod at my property. Today, the sod is dead despite regular watering and fertilizer. On this invoice, the company describes the yard as "approximately 200 square feet". In actuality, the yard is 1,400 square feet.
After discovering the dead sod, I contacted the company for supports. However, the company refused to replace. Apparently, they no longer complete this work. They also referred me to another company that refused to replace the sod at my expense.

Hey ***,
I can guarantee the work, but not the sod. I guarantee that we will give the back lawn the best chance possible survival for the future.
This means quality products and quality workmanship. Unfortunately so much relies upon the Care that the sod receives after we leave the property. I will send you detailed instructions on how to properly care for your investment.
May 19th works for us.

I sent the client watering instructions, provided the sod to them at cost, charging only labour and rental fees for the specialized equipment needed to complete the job. The client provided post dated checks as payment through the remainder of the 2015 season. The client signed up for other services during 2016. The client signed up for other services during 2017. The client signed up for other services during 2018. The client signed up for other services during 2019. During this 4 year period of time, the client would make various requests regarding the other services that I offer. I did my best to comply with all requests and the client seemed satisfied and continued to sign up each year.
When the client contacted me on May 20, 2019, I informed them that I no longer offer sod installation services. I referred the client to a 3rd party who apparently was unable to perform the work. I then referred the client to another 3rd party who placed a quote but did not receive the job.
The client has signed with my company for other services every year since the sod was installed. I have always stood by my contracts and my word with the client. I was very clear that the workmanship was covered but I could not guarantee the sod's survival due to the care of the sod being out of my hands.
I believe that I have satisfied our agreement.
