I am not requesting mediation nor collection of moneys owed. I am
reporting unfair and unlawful business practices by Thomas BBuilders.
I
am rejecting this response on several grounds:
As
admitted by the builder, it was only after I hired an attorney and he
communicated with Thomas Builder's that they refunded the money that I had paid
for pavers that were never delivered. Return of a stolen good or refund
under legal threat, does not erase the crime.
As
admitted by the Builder in their response, there is also outstanding money that
has been paid to Thomas BBuilders in advance for work that, to this day, has
not been completed by them.
Furthermore,
because Thomas Builders could not finish the project in a timely fashion, they
approached a contractor to do the work for them. (We actually hired the
contractor they approached). However, they had offered to pay
him $(though they told us they had allotted $5,for this
project). Three independent quotes were obtained. All were above
$10,000.00, as admitted by the builder, an amount that exceeded what they had
allotted for the project Hence, it is evident that the intent was to
provide a low quality service to begin with and even lower when they reached
out to a third party contractor. In fact , our contractor told us that, had he done what Thomas Builder's asked him, we would have had water issues in our basement
I have been
forced to hire an attorney and file a suit, hence incurring in unplanned legal
fees and will proceed with civil and criminal complaints in view of the obvious
disregard for fairness and good customer practices as well a blatant disregard
of the law. Only through zealous reporting by customers like me, intense
investigation by agencies like yours and prosecution by law enforcers will
other customers be spared abusive and unlawful practices, Thomas BBuilders on
point, that often go unpunished

the projectUnfortunately, *** *** has obtained legal counsel and initiated a lawsuit against this companyNevertheless, because our reputation with the Revdex.com is important to us, we will address *** ***’s complaint in hopes that your organization may help us reach a solution, or at the very least, understand that our company values our customers and reputation.Due to unforeseen circumstances, mainly time constraints, we were unable to complete the last part of the project in a timely mannerIt should be noted that 90% of the project was completedWith respect to the last part of the project, *** *** was to supply the paversUnable to do so, she paid us an additional fee for securing the pavers ourselves ($2,991.32)Foreseeing that the project was not going to be completed on time, our company offered to find another professional to finish the project and we would pay them directlyThe Client decided to find someone on their own and would get us an estimate for the completion.The estimate that she submitted to our Company has exceeded what our project budgeted for that specific taskThe reason for this is that *** *** was getting an estimate for services that were not agreed uponHowever, we do agree that some amount of refund is due.Our company offered to return and finish the projectAfter our offer, we received a letter from their attorneyAs a result, we obtained counsel and refunded $2,(money *** *** advanced for the last part of the project).Unfortunately, *** *** initiated a lawsuit against our CompanyWe hope that this gives your organization some background into her complaint and would be happy to provide more information if you so request.Sincerely,Paula B

has been paid to Thomas B. Builders in advance for work that, to this day, has

him $3000.00 (though they told us they had allotted $5,000.00 for this
project).  Three independent quotes were obtained.  All were above
$10,000.00, as admitted by the builder, an amount that exceeded what they had
allotted for the project.  Hence, it is evident that the intent was to
provide a low quality service to begin with and even lower when they reached

December 11, 2015Dear [redacted]As per your letter dated December 1, 2015, here is our response to the following comments from [redacted].With the job 80 to 90 plus percent complete we mutually agreed that we became too busy to complete the project as previously agreed upon in a timely manner. We at first tried to sub the job to their landscaper with us funding the entire cost, but while doing so they asked if they could just end the contract and they would handle the job directly with there landscaper. We maintain from the beginning we need to compensate the client for the left over part of the contract.The discussions of the amount to be returned started with a letter from the client dated 10/14/15.Their total was a little over $10,000 plus the $2991.32 for the pavers. We responded on 10/16/15 that our figure was more like $5000 plus the $2991.32 for the pavers. Their answer was they would get another two estimates and get back to us. While waiting to hear back on the other two estimates on 10/27/15 we received a notice from a lawyer saying that they were retained by our client. We never received the other two estimates nor any communication from the client, perhaps in hindsite we maybe should have tried to see after a few days why no communication for this we are sorry. We were forced at that time to get a lawyer and never had an opportunity to talk through why the differences in dollars might have occurred and to come to an agreement on the refund amount.As far as the paver amount was concerned we were unsure if they wanted the pavers delivered so their person could use them or to just return the money. We originally didn't deliver them so that they weren’t just sitting on site waiting, we had them held at our distributer to arrive when we needed them not before. Once the lawyers were involved we asked our attorney how to go about returning the money and we did right away as per his instructions. This had nothing to do with a legal thereat it had to do with the fact we had our answer that they did not want the pavers.To this date we are trying to figure out the difference in the estimates so we may refund the correct money ASAP to the client. We believe we have finally found out the differences in the estimates and are in the process of forwarding our responses to their lawyer so we may all resolve this and refund their money.We have completed many projects for this customer as well as helped them out personally through out the years and want nothing more than happiness for all and to return the money due.Attached is correspondence we feel may help explain our position.Sincerely,Paula and Tom B
