December 11, Dear [redacted] As per your letter dated December 1, 2015, here is our response to the following comments from [redacted] ***.With the job to plus percent complete we mutually agreed that we became too busy to complete the project as previously agreed upon in a timely mannerWe at first tried to sub the job to their landscaper with us funding the entire cost, but while doing so they asked if they could just end the contract and they would handle the job directly with there landscaperWe maintain from the beginning we need to compensate the client for the left over part of the contract.The discussions of the amount to be returned started with a letter from the client dated 10/14/15.Their total was a little over $10,plus the $for the paversWe responded on 10/16/that our figure was more like $plus the $for the paversTheir answer was they would get another two estimates and get back to usWhile waiting to hear back on the other two estimates on 10/27/we received a notice from a lawyer saying that they were retained by our clientWe never received the other two estimates nor any communication from the client, perhaps in hindsite we maybe should have tried to see after a few days why no communication for this we are sorryWe were forced at that time to get a lawyer and never had an opportunity to talk through why the differences in dollars might have occurred and to come to an agreement on the refund amount.As far as the paver amount was concerned we were unsure if they wanted the pavers delivered so their person could use them or to just return the moneyWe originally didn't deliver them so that they weren’t just sitting on site waiting, we had them held at our distributer to arrive when we needed them not beforeOnce the lawyers were involved we asked our attorney how to go about returning the money and we did right away as per his instructionsThis had nothing to do with a legal thereat it had to do with the fact we had our answer that they did not want the pavers.To this date we are trying to figure out the difference in the estimates so we may refund the correct money ASAP to the clientWe believe we have finally found out the differences in the estimates and are in the process of forwarding our responses to their lawyer so we may all resolve this and refund their money.We have completed many projects for this customer as well as helped them out personally through out the years and want nothing more than happiness for all and to return the money due.Attached is correspondence we feel may help explain our position.Sincerely,Paula and Tom B
