The attached forms were sent certified mail to the builder at *** *** ** *** ** *** We will not accept any answer until the work has been completed correctly or we are provided with a suitable amount of money to have the work done We have fulfilled our obligations and have paid for a house that should not be plagued with unresolved issues within the first months of ownership I will continue to stand my ground and make sure that it be known what kind of a business (morals, ethics and products) Thomas JFarone Homebuilders, Inctruly represents

The attorney's response does not take in consideration the fact that we made both Tom F[redacted] and his foreman, Matt F[redacted]  aware of these problems both verbally and through text messages which is why they were not on the punch list because we were told they were getting fixed.  "They will be taken care of."  It also does not take in consideration the fact that some of these issues could not have been discovered prior to moving in, ie. foundation and basement window leaking.  Come on were we supposed to take a shower before we closed in order to find out that the one shower head does not work and add it to the punch list?The attorney should refer to our contract that we have a limited warranty on the defective workmanship performed by the Builder, an agent of the Builder, or subcontractor of the Builder.  Pages 139-146. Finally it should be noted that throughout the construction of this home my husband and I renegotiated the price ONLY when the builder failed to meet the contract date.  The negotiation was on behalf of the builder and real estate agent to keep us as clients.  Finance was never an issue for my husband and I at any point throughout the process but while speaking to all of the subcontractors that have worked for Farone finance seems to be a problem for him. 
We want the issues of our house fixed or the funds to have them fixed by a reputable company.  Our first option was to go to the builder and his company, our second option was to file a complaint with Revdex.com.  We will continue with as many options as needed to get this house fixed properly and not just "acceptable".

Complaint.First, attached please find Punch List which was signed by the Complainant and her husband on April 13, 2015.Second, attached please find first Addendum to the Purchase Agreement signed by the parties which set up an escrow for work to be completed, This Addendum was signed on or about February 23, 2015.Please note that items 3, 4,5,6,7,8,9 and 10 of the Complainant's complaint are not on the Punch List. This punch list is created just prior to closing and spells out the items which the Purchaser states needs to be corrected. Items 3 through 10 could all be physically seen/inspected prior to closing, why were they not on the punch list?Please be further advised that the Complainant's bank inspected the home prior to closing and found the home, as constructed, acceptable.As to the Addendum, please be advised that the Complainant's bank recently inspected the home and issued a check to Thomas 1. Farone & Son, Inc. for items 1,2,3,4 and 5, My client acknowledges that items 6 and 7 of the Addendum were not completed but the Purchaser had agreed to their costs and can receive the cost to complete these items from their lender. This arrangement was approved by Complainant, her husband, their attorney and their real estate agent.
