Thomas J. Mack Construction, Incorporated Reviews (3)

We responded previously to his ever changing punch list,
including 3 new issues on this response.
The issues on the punch list established with [redacted]’s parent’s were
completed with the exception of the deck boards which were unresolved as
previously addressed.  [redacted] has
issues not related to our proposed work, which he continues to include.  Our agreement with his parents was to
complete the items on our list, which we had responded to.  Our efforts involved several days work, again
to items not included in his proposal.
We stand by our work as demonstrated by this.
[redacted]’s response was to send a partial payment as “Payment
In Full for the Satisfactory Completion of this Project.”  The amount he withheld was towards a remedy
of his alleged unresolved items, which noted were for an inflated amount.
[redacted] has never put forth an offer to pay his bill in
full in response to the completion of a mutually agreed upon punch list.
Our company has enjoyed a long time relationship  as a member of the Revdex.com.  Our threat of suspension of accreditation after
such a long period of complaintless service to our community is an insult.

It is obvious that the Revdex.com has no interest in resolving this matter. Tom Mack Builders has done a substandard job on my home. I have stated the issues time and time again yet the Revdex.com keeps having us reiterate the same issues from both sides time and time again. If the Revdex.com had any interest in the truth, they would send a representative to visually inspect my claims. My words are obviously not enough. My evidence is my house and the physical work Tom Mack has done to it. In Mr. Macks first response to my complaint, he stated that I was posturing because I knew he would be suing me for the balance of what he feels I owe him. It has been close to a year now since his crew pulled out of my house and I have received no papers from anyone regarding impending civil suits. This is because he knows that he can not win. I am very particular in telling all that I interact with about the quality of service I received from Tom Mack Builders. Since the Revdex.com just wants us to continue taunting each other through email, I feel my next option is to spread word and evidence of the job he has done through social media. I hired Tom Mack because I knew of his long standing reputation. Even the best has a bad day. I feel that Tom Mack problem with this particular project was caused by a few reasons. 1- He spent about 15 minutes in my home during the initial walk through so he could formulated a bid. He did not take time to examine what would actually be needed to complete the job properly based on the conditions. 2- His crew that he sent to work on my home was very unprofessional and unreliable. Constant bickering between workers and even a physical altercation in the street in front of my house. My wife and I never knew when they were coming to work on the house. They would just show up on one day and not show up on another with no notification for either. 3- Tom Mack was very hard to get in touch with. Messages left for his were rarely returned. Most of my issues were brought to the attention of the foreman said he would pass my concerns on to Mr. Mack. In closing I say; Tom, if the work your men did on my house was representative of the work you did in general, you would have gone out of business years ago. I invite you to post pictures of this job on your web page. I invite you to bring potential customers to come see first hand what they too can get from you. Tom has been defending his work on my house all this time but he hasn't even come to see my issues in person. Tom, you have egg on your face. Its time to accept the fact that you made a mistake. [To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the response. If no reason is received your complaint will be closed Administratively Resolved]

I am rejecting this response because:

Ref #:  [redacted]
November 14, 2014
The Complainant appears to be posturing for what he realizes
will be a collection action that is...

in process with our attorney (The
[redacted] Law Firm).
Invoice #[redacted]:            March
31, 2014
Paid:                            $25,800,
July 10, 2014, along with a letter quoting “I consider thepayment of $25,800 as payment in full for work
your company satisfactorily completed.
Complaint Filed:         November
11, 2014
First and foremost, the complainant’s parents have made a
payment of $25,800 on a completed work invoice of $30,430.  No progress payments were made as the work
progressed.  There remains a balance of
$5,430 which he assumes is to small amount for us to pursue legal action.  There was additional work to the second floor
bath amounting to $9,855 that was part of the original agreement.  The complainant could not proceed, because he
had run out of funds.
Regarding the “Services Issues”:
1)
The front porch was contracted to be PVC decking, not
the mahogany [redacted] that he had substituted after work was started.  The complainant applied a sealant to the top
surface of the material at his discretion and without my prior knowledge.  The complainant estimate to replace the
decking surface at $3,500 for 120SF amount to $29/SF.
2)
The structure in which the referenced bathroom was an
existing enclosed portion of 100 plus year old semi-detached house.  This part structure has two independent floor
systems under it.  While we had no
insulation of that space in our proposal for the bath, we insulated the walls,
floor & ceiling for the bath at no charge.
The proposal included hot water baseboard heat to that area on the
existing system.  The complainant hung a
blanket to the area in question, not permitting circulation of air through the
area, despite our advising him not to do so.
We returned and re-routed the system with a separate heating loop, zone
control valve and thermostat, an $850 service at no charge.  The complainant was also advised that his
existing boiler was improperly configured causing it to constantly cycle
on.  He was advised to consult his heating
service provider.  The unfinished
baseboard heat cover was left incomplete at the complainant’s request as he was
deciding to reconfigure the space into a pantry,

3)
The referenced storm window remained as directed by the
complainant.
4)
The electrical service to the house was upgraded to 200
AMP with a new electrical panel, period.
Much of the existing house is knob & tube wiring.  We had nothing in our proposal
alluding to re-wiring any portion of the dwelling other than the new
bathroom,  We submitted a separate proposal
for the replacement of existing knob and tube in the rear mudroom area of the
house, adjacent to the new bath.   We attempted to repair the kitchen circuit at
no charge.  The complainant was advised
that his kitchen wiring needed to be replaced with new circuits to each
appliance as per code.
The complainant had directed a
letter regarding service issues on April 30, 2014.  I requested & set a meeting to review his
punch list.  The complainant was not
present for the meeting and did not inform me he would not be there.  I met with his parents, who were financing
his project.  We established a punch list
and completed all items as per that list.
The complainant refusal to pay the balance on his account is a
collection matter, not a Revdex.com issue.
