Regarding Ms***'s concerns, it is my understanding that prior to this last visit in August, the last time her *** *** ** was at BMW of West Houston was on January of at which time the vehicle maintenance was not due. This last time Ms*** brought the vehicle in to us on August
of 2016, at which time, we realized that the oil changes had not been performed by Ms*** and as a result of this lapse in conducting required maintenance, her engine failed. We have discussed with Ms*** that her mechanical issues were a result of failing to perform the required oil changes on her vehicle, she explained that she was unaware her vehicle needed maintenance, at which time the Service Manager showed her that on her instrument cluster it clearly displays maintenance was due, in August it showed 13,miles past due. At this time, we do not feel we failed Ms*** in any way, and the mechanical failure of her vehicle is a result of neglect on her part and not the dealer. Please feel free to contact me directly at 832-772-9001. Thank you

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint
I will be in tomorrow,9/18/to pick up my vehicle I am rejecting your response because you are insinuating that I am attempting to recover or obtain "free" work on my automobile. This is not the caseYour quality of work was far from par and was totally unacceptable. In your response, you did NOT acknowledge that there was COMPOUND splattered across my bumper (that sir, was not pre-existing, but damage caused by your establishment), or that your technicians cracked my windshiled, or the fact that the vehicle was not even cleaned before or after the completed work. The misaligned bumber and pretruding side panels WERE damage caused by the accident (and the reason for being in your shop) and were returned to me unrepairedI have detailed pictures of my auto before and after being brought to your shop that attest to this factWhen I brought my auto in, I expained to MrS*** that there was a temporary red glitter (that washes off), that was sprayed on the car the day before the accident because I went to a special engagementI told him I didn't have the car detailed after the accident because of the damages sustainedI also expressed to him that the car was painted jet black. Yet your shop painted the panels a multi colored metallic color (not even a red metallic) - the shop foreman told me that MrS*** NEVER told the shop workers that the car was painted blackActually the only apology that I received during this entire ordeal was from that shop foreman. And in regards to my glovebox - It was fully functional before I left your shopIt is clear that someone attempted to force open the locked box. And it is not true that "no one was in the car", the car was driven by technicians while on propertyIn your response, you place blame on me and the prior bodyshop for the damages obtained at your shop and for the underpar workmanship on the repairs you did completeI will accept your next reponse without question as I understand that you are unapologetic in regards to my experience with your bodyshop
Regards,
Ms*** ***

Dear Ms*** ***,First, thank you for giving us the opportunity to work on your vehicle, we know you have many choices and we appreciate you choosing our shop. That being said, you stated that your *** ** was previously completely repainted by another shop, we inspected the vehicle and
it looks like the prior color was dark green, and the car is now black. That being said, some of the concerns you mentioned in your email seem to stem from the previous paint job, or prior damage, unrelated to your current accident. Nonentheless, we repainted the Quarter panel and rear bumper the correct
color, to match the prior paint job. We realigned the “protruding” panels and we corrected the
alignment between the trunk and side panel We are replacing the sill
plate that was damaged from the door rubbing on it, unrelated to the accident
or anything we did, this is a goodwill gesture. Also, we are replacing the windshield that was cracked. You stated
that the passenger door window was not operating properly which we checked and
it is working properly. Ms*** ***, you stated that the dents in the hood were not there before
you brought your vehicle in to us;however, it is obviously damage and it seems the folks that did your prior paint job, painted over those dents, and these were preexisting. The glove box was not part of the claim, and was not touched by any technician, again, because that area was untouched by our Technicians, it seems that the damage was existing prior damage
The vehicle came with dents and dings throughout, and this is all previous damage unrelated to the accident you asked us to repair, and unrelated to what you brought the vehicle in forPlease advise when would be a good time for you to come inspect the vehicle for the items repaired and mentioned above. Again, thank you for your patronage

Unfortunately since this has now been forwarded to a collections agency we are not allowed to negotiate the account*** should contact the agency and attempt to negotiate a settlement which they will run by us to get approved by the owner
of the propertyI'm certain we attempted to mail out the statement of claim and would love to have resolved this previouslyUnfortunately it is now out of our hands

Ms. [redacted], We have repaired the items that were on your claim, we will need you to come inspect the vehicle to insure it is to your satisfaction. Thank you.

Initial Business Response /* (1000, 5, 2017/01/30) */
I reviewed the resident's letter and spoke with our maintenance department. We do verify that any items that were damaged prior to move in and documented on the move in sheet do not appear on the deposit statement. From what I understand that...

did not happen. In interest to settle this we would be willing to offer remove of the door repair charge, tub stopper, and cleaning the register. The reference to the wall washing out is for the previous house you occupied and not the house in question that you referenced from what I understand. If that is not the case please let us know. Removing those charges would bring the balance owed on [redacted] down to [redacted] and you can make arrangements to pay that through our office.
Initial Consumer Rebuttal /* (3000, 7, 2017/02/08) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I'm not satisfied with that resolve that. I cleaned the house when it was empty before turning over the keys I also was presented with pictures of a clean house and refrigerator with no proof the house needed additional cleaned.any additional cleaning that you feel is needed would be covered under your cost. The cracks as you state on the wall are the seems of the wall which were their on move in. The master room sliding door blinds were also damaged on move in and as stated by a member of your office staff you do not perform pre move in inspections of the house after previous tenant repairs were made. I would like to see documentation on last tenant and what you charged them to fix. If the drape was broken then it would have been logged, their for you can not charge me for what you have previously charged the last tenant but failed to make repairs. I will be checking my lease if it require carpet cleaning but we were their for 3 months I would say you can't dirty a carpet in three months to need cleaning, cleaning a carpet that much does damage it. I would also like to see receipts for the carpet cleaning of the charges for me and previous tenant. With totals. Were are fine with paying the rent balance of [redacted] dollars.

In effort to rectify Ms. [redacted]'s concerns, we have issued a check to our client for the $25 penalty resulting from the late registration as a result of the state's requirement to have personal property taxes paid.
