To Whom It May Concern,What follows is a timeline of my correspondence and interaction with the owners/occupants at the property adjacent to [redacted] (Occupants):May 5 - July 29": I had various conversations, meetings and text exchanges with the occupants regarding our...

plans, demolition, loud music, etc. As far as I know, none of these conversations involve this specific complaint. Oct. 20th: I spoke with the occupants regarding our intentions for building the perimeter fence around our property. I informed them that the new fence would be entirely contained within our property line and that I would be willing to remove the existing fence if they agreed. Additionally, I explained the details, schedule, and method of construction of the fence, Oct. 25th: I received the following message from the occupants, “When we spoke on Thursday, we discussed you replacing and removing the existing fence with a wood fence that looks the same on both sides. You explained that the fence would start in the corner of the backyard and end at the front of the new house. Like we discussed, I spoke to my family, and they agree with this plan but we would like to confirm a few details. First, we will have a surveyor out on Monday to confirm the property line. You mentioned the fence being completed in a few weeks and I assumed we would talk before the work started but some of the posts were installed today. I'm glad we are moving forward and as long as we communicate with each other I see no reason for this process not to go smoothly. Thank you.” At this point we had neither removed any existing fence, nor installed any new fence, excluding posts on our property. I advised her of this, Additionally, I verbally corrected her statement that the fence “would look the same on both sides.” Furthermore, I advised that she was welcome to have her property surveyed; however, because our property had already been surveyed and because I had already identified the position of our perimeter fence, I would not impede the progress of our work, Nov. 17": I contacted the occupants stating that we would be removing the existing fence and building the new fence on the following day November 18'. I expected to be completed in one day. She responded: “Okay. I want to confirm that you will that you will be able to continue the fence (about 5 feet) past the front of the house to where our fence currently ends like we discussed. Also, I would like a written estimate to finish our side of the fence.” I did not respond to this message, as I had already explained all details of the fence. Nov. 23: I received the following message from the occupants: "Hi [redacted]. I’ve been working and just had a chance to look more closely at the fence. The portion of the fence that we have to look at is very ugly compared to the rest of the fence towards the backyard. The wood is repurposed and covered with cement while the rest of the fence is uniform and nice looking, The wood is not straight. It looks like they ran out of wood and used whatever they could find. It looks terrible. Please fix this or make our side look the Same as yourS. Nov. 28th: I responded: “Sorry, I've been away for the Holliday Thanksgiving. I haven’t seen what you're talking about yet but, if there's an issue, we will correct it.” o Dec. 6": I received a message asking if I had seen the fence and I did not respond as I Subsequently met the occupant at the property to review their concern. I saw the areas that they were talking about and said, “I will look into correcting their concerns and get back to them.'0 Dec. 12: The occupant called me four consecutive times, but I was on the phone. WhenI picked up, the occupant threatened, yelled, and cursed at me. I advised him that from here on out I would only correspond via email. That was our last direct correspondence.Opinion:Due to a lack of records, I have omitted a great deal of the verbal communication from this timeline; nevertheless, I have described everything for which I have a physical record or documented interaction. No other conversations or interactions, which have been omitted, would further elucidate the nature of the relationship or complaint.As for the nature of the complaint, the documented interactions demonstrate the following:1. The communication between both parties has been extensive and, for the most part,agreeable. Unless, of course, you include the final phone call.2. We have completed everything that we explicitly agreed to complete. Furthermore, we explained the process, procedure, and schedule clearly. In no way, have we failed tokeep our word.3. None of this correspondence includes any mention of serious damage caused duringconstruction. However, I did receive a phone call from the occupants regarding a 'water leak. I am uncertain of the day and time, so it has been omitted from this conversation. Nonetheless, it was not a water leak, it was the pool being drained after heavy rains. I have no reason to believe that this would cause any damage.4. None of this correspondence includes any mention of any failures to disclose permit orcontact information. If the occupants had asked, I would have shown them that our permit number and all pertinent information was posted on the side of the portable toilet. In any case, I think these records indicate that I was easily available if there were any questionsO COCCS.As a personal aside, I would point out that all work performed and completed was done so on the owners property at [redacted]. We have at no time been contracted to or obligated to perform work for the complaining party.
