Initial Business Response / [redacted] (1000, 8, 2015/08/05) */ Contact Name and Title: Jay Lauer, Attorney Contact Phone: XXX-XXX-XXXX Contact Email: ***@jaylauerlaw.com I am responding to the Complaint filed by [redacted] I have had my secretary retype the Will with the substitution of the Personal Representative, which was mailed out late todayHowever, it was not legally necessary to retype the Will because the codicil, which I drafted and was signed by MsNickerson, was sufficientNevertheless, I stated that I would have the Will retyped because MsNickerson had requested it be done I need to correct one of their claims that they paid to have the Will retypedThey were not paying for my secretary's time to type this WillThey did pay for my time for the appointment and for me to do codicilsBut they were not charged anything my secretary retyping the WillI do not charge clients for my secretary's timeI only charge them for my timeIf I had billed them at an hourly rate, they would have paid more for my timeInstead, they were given a partial discount by paying for the consultation and codicils at a set rate With respect to the last issue, the researchThere is very little research regarding a codicil to a living willI'm still of the legal opinion that they can do a codicil to a living will without having to redo the whole living willTherefore, I have sent them another copy of the codicilI have also left several messages with estate attorneys regarding this issueI should hear something within the next day or twoI will then send MsNickerson another letter if I hear anything from these attorneysI did not bill any additional time for this research or phone calls to the attorneys If they have any questions, they may contact me OFFER: I have had my secretary retype the Will and it was placed into today's mail along with the codicil Initial Consumer Rebuttal / [redacted] (3000, 11, 2015/08/14) */ (The consumer indicated he/she DID NOT accept the response from the business.) My mother did receive the will that Mr[redacted] had his secretary retype and mail outHowever, my father was removed from being her primary beneficiary in errorMy mother did not ask to have her beneficiary information changedShe needed a signed will and was prepared to have a new will draftedMr [redacted] did not want to take the time to do that at her appointment and offered to retype her existing will and mail it to her so she could sign and have it witnessedThe codicil was to make the change in personal representative designation which was all she needed to have changedShe agreed to that solution We find it confusing that the excuse given is that he does not charge for his secretary's timeDoes that mean he planned to retype it himself? If he did not charge enough to do the things he said he would do then who's fault is that? My mom's? She was prepared to pay the fee that he wanted to accomplish the things she needed to have done We hope that in the future, Mr[redacted] would consider being sure he is charging enough to cover what he is promising to doWe are very disappointed in the quality of work and in the lack of professionalism we experiencedMy mom says that at least she didn't pay for something she didn't getWe have moved on to finding other means to satisfy my mother's wishes
